HomeMy WebLinkAboutORDINANCE - 164 - 3/27/1961 - REZONE/NW CORNER OF DEVON ANDTONNEI ORDINANCE NO. 164 AN ORDINANCE REZONING CERTAIN PROPERTY LOCATED ON THE NORTHWEST CCRNER OF DEVON AVENUE AND TON14E ROAD IN THE VILLAGE CF ELK GROVE VILLAGE, COOK COUNTY, ILLINOIS WHEREAS, the Zoning Board of Appeals of the Village of Elk Grove Village, Cook County, Illinois, sitting as a commission at a public meeting duly called and held according to law, considered the question of reclassifying from R-1 20,000 Square Foot Single Family Dwelling District (so classified upon annexation) to B-1 Business District, the real estate hereinafter described; and WHEREAS, the Chicago Title and Trust Company as trustee under Trust Agreement dated April 25, 1960 and known as Trust No. 42169, and John Bolger, having assured the President and Board of Trustees of the Village of Elk Grove Village of its and his fixed intention to develop the whole of the property hereinafter described with a shopping center in accordance with the provisions of a decree of the Circuit Court of Cook County in a case designated as Chicago Title and Trust Company as trustee under Trust Agreement dated April 25, 1960 and known as Trust No. 42169, plaintiff, -vs- Village of Elk Grove Village, a municipal corporation, defendant, No. 60 C 11807; and WHEREAS, the President and Board cf Trustees of the Village of Elk Grove Village has considered the recommendations of the Zoning Board of Appeals, the decree of the Circuit Court of Cook County noted above, and the agreement and promises of the Chicago Title and Trust Company as trustee under Trust No. 42169 and John Bolger to develop the whole of the hereinafter described property as a shopping center, with deliberate speed; and WHEREAS, the for reasons stated above the President and Board of Trustees of the Village of Elk Grove Village consider the highest and best use for said real estate is that of B-1 Business District use; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Cook County, Illinois: Section 1 That an ordinance entitled "An Ordinance to regulate and limit the hcight and bulk of buildir4s; to regulate and limit the intensity of the use of lot areas, and to regulate and determine the areas of open spaces within and surrounding such buildings; to classify*, regulate and restrict the location of trades and industries and the location of buildings designed for specified industrial, business, residential and other uses; to divide the entire Village of Elk Grove Village into districts for the purpose of this ordinance; to fix stan- dards to which buildings or structures shall conform; to prohibit uses, buildings or structures incompatible with the character of such districts respectively; and to prevent additions to and alterations or remodeling of existing buildings or structures in such a way as to avoid the re- strictions and limitations lawfully imposed hereunder, and to provide penalties for violation hereof," passed and approved July 8, 1957, known as Ordinance No. 2n, as amended, be amended by reclassifying from $-1 20,000 Square Foot Single Family Dwelling District to B-1 Business District, the following described real estate: Lot 28 in William Lumpp's Devon Avenue Farms, being a Subdivision in the South half of Section 33, Township 41 North, Range 11 East of the Third Principal Meridian, Cook County, Illinois; ALSO That part of the Southeast quarter of Section 33, Township 41 North, Range 11 East of the Third Principal Meridian, described by begin- ning at the point of intersection of the South line of said South- east quarter with the center line of Tann Road; and running thence North 120301 East along the center line of said Tome Road, 454.0 feet for a place of beginning; thence North 780221 West, 434.8 feet; thence North 3023' East, 151.47 feet; thence South 87008f East, 465.37 feet to the center line of said Tonne Road; thence -1- Unn (contId) South 120301 West, 221.41 feet to the place of beginning, Cook County, Illinois; ALSO That part of the Southeast quarter of Section 33, Township 41 North, Range 11 East of the Third Principal Meridian, described by commencing at the point of intersection of the center line of Tonne Road with the South line of said Southeast quarter and running thence North 120301 East along the center line of Tcnne Road, 284.0 feet for a place of beginning; thence North 780221 West, 407.5 feet; thence North 30 231 East, 171.75 feet; thence South 780 221 East, 434.8 feet to the center line of Tonne Road; thence South 120 30: West along the center line of Tonne Road, 170.0 feet to the place of beginning, Cook County, Illinois. .Station 2 That said real estate as reclassified shall be subject to all limitations and conditions placed upon properties in the B-1 Business District as defined in Ordinance No. 20 as amended. Section 3 Any person, firm or corporation who violates, dis- obeys, omits, neglects or refuses to comply with or who resists the en- forcement of any of the provisions of this ordinance, shall be fined not more than One hundred (6100.) Dollars for each offense, and each day that a violation is permitted to exist shall constitute a separate of- fense. Section 4 This ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
