HomeMy WebLinkAboutORDINANCE - 172 - 6/26/1961 - FIRE PREVENTION CODE/BUREAU/LICENSINGORDINANCE NO. 172 AN ORDINANCE ESTABLISHING A FIRE, PREVENTION CODE, A FIRE PREVENTION BUREAU, ESTABLISHING TIT DUTIES OF TEE FIRE PREVENTION BUREAU AND ESTABLISHING THE LICENSING OF BUSIITSSES DEALING WITfi FLAMABLE LIQUIDS AND AMENDING THE MUNICIPAL CODE 0 TIT VILLAGE OF ELK GROVE VILLAGE OF 1961, NOW3 THEREFOPti, BE IT ORDAINED by the President and Board of Trustees of the Village of Els Grose Village, Cook County, Illinois: Section 1. That Rection 6,010, Chapter 6, Fire Department, of the Municipal Code of Elk Grove Village of 1.?61 is hereby repealed. Section 2, T!,at Chapter 6, Firs Department, of the Municipal Code of Elk Grore Villas of 1551 is horalry a ended by the addition of the following sections which sh5.il read as follows; Section 6,010 ADOPTION OF FIRE PP.EVENTION CODE RECO&YNDED BY THE NATIONAL BOARD 0^ FIRE U;�IDERWR.TTERS. The Fire Prevention Code, other than the provisions thereof re)ating to fees for licenses and permits and relating to penalties, re-omaor'3d by the National Board of Fire Underwriters, 1960 Edition, and subsequent ans r_dments thc-reto, adopted prior to the adoption of this Code, is hereby adeptcd as the Fire Prsvention Code of the Village and is hereby made a part of Viis Code, Three copies of such Fire Prevention Code and amendments thereto have for more than the past fifteen days been, now are and hereafter shall be kept on file in the office of the Village Clerk. Where arjy provisions of such Fire Prevention Code are in conflict with the state law, the provisions of this Code or other ordinances of the Village, the state law, the provisions of thi Code and such Village ordinances shall prevail. Section 6„011 ESTABLISHhENT AND DUTIES OF BUREAU OF FIRE PREVENTION. A. The Fire Pre—,ention Cede shall be enforced by the Bureau of Fire Prevention in the Fixe Department of the Villa.ge of Elk Grove Village which is hereby established and which shall be operated under the supervision of the Chief of the Fire Departmcni, B. The Fire Chief shall be Chief of the Bureau of Fire Prevention, which bureau shall consist of the Fire Chief, Superintendent of Building, and three other members to be appointed by the Chief of the Bureau. C. The Chief of the Fire Department may detail such members of the Fire Department as inspect .-s as shall from time to time be necessary. The Chief of the Fire Department may recommend to the corporate authorities of the Village of Elk Grave Village the employ7�ent of technical inspectors. Section 6.012 DEFINITIONS. Wherever the work "Municipality" is used in the Fire Prevention Code, it shall be held to mean the Village of Elk Grove Village, Section 6.013 PROHIBITION OF STORAGE AND LOCATION OF CERTAIN MATTER. A. Storage of flammable liquids in outside aboveground tanks referred to in Section 16.22a of the Fire Prevention Code is hereby prohibited. B. New bulk plants for flammable liquids referred to in Section 16.51 of the Fire Prevention Code are hereby prohibited. C. Bulk storage of liquified petroleum gas referred to in Section 21.6a of the Fire Prevention Cede is hereby prohibited. D. Storage of explosives and blasting agents referred to in Section 12.6b of the Fire Prevention Code is hereby prohibited. Section 6.014 MODIFICATIONS. The Bureau of Fire Prevention shall have power to modify any of the provisions of the Fire Prevention Code upon application in writing by the owner or lessee, or his duly authorized agent, when there are practical difficulties in the way of carrying out the strict letter of the Code, provided that the spi_-it of the Code shall be observed, public safety secured, and substantial justice done. The particulars of such modification when granted or allowed and the decision of the Bureau of Fire Prevention shall be entered upon the records of the department and a signed copy shall be furnished the applicant. Section 6,015 NEW MATERIALS OR PROCESSES WHICH MAY REQUIRE PERMITS. The Village President, the Chief of the Fire Department and the Bureau of Fire Prevention shall act as a commit`.ee to dstermine and specify, after giving affected persons an opportunity t.o be heard, any r_.w materials, processes or occupancies, which shall require pernits, in addition to those now enumerated in said Code. The Chief of the Fire Departs nt shall post such list in a conspicuous place in his office, and diotr-hi;te copies thereof to interested persons. Ord., $172 Section 6.016 APPEALS. Whenever the Chief of the Fire Department shall disapprove an application or refuse to grant a license or permit applied for, or when it is claimed that the provisions of the Code do not apply or that the true intent and meaning of the Code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the Chief of the Fire Department to the President and Board of Trustees within 30 days from the date of the decision of the appeal. Thereupon the said President and Trustees shall designate a time and place for a public hearing thereon and the applicant and Fire Chief may present pertinent information. The decision of the President and Trustees shall be final. Section 6.017 PERMITS. It shall be unlawful to construct, install or enlarge any tank, pump or piping equipment for the storage or handling of flammable or volatile liquid such as defined in this article without having first obtained a permit therefor. Application for such permits shall be made to the Village Clerk, and shall be accompanied by a drawing to scale showing the location as well as plans showing the type and nature of installation or alteration. Section 6.018 APPROVAL. No such permit shall be issued until the Building Inspector has certified that the contemplated work fully complies with the ordinances of the Village. For installation of fuel oil tanks having a capacity of more than two thousand gallons and less than 20,000 gallons - $75.00. For installation of tanks for storage of gasoline having a capacity of less than 10,000 gallons - $75.00. For installation of fuel oil tanks having a capacity of 20,000 gallons or more - $75.00. For installation of gasoline storage tanks having a capacity of 1,000 or over - $75.00. For installation of tanks for other flammable liquids - $75.00.. Section 6.019 LICENSES. It shall be unlawful for any person, firm or corporation to sell or deal in flammable liquids, gasses and solids including the sale of paints but excluding automobile service stations without having first obtained a license therefor. The annual fee for said license shall be 630.OQ. Section 6.020. PENALTIES. A. Any person who shall violate any of the provisions of the Code hereby adopted or fail to comply therewith, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder, or any certificate or permit issued thereunder and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modified by the Chief of the Fire Prevention Bureau or by a court of competent jurisdiction, within the time fixed herein, shall severally for each and every such violation and noncompliance respectively, be guilty of a misdemeanor, punishable by a fine of not less than $10.00 nor more than $200.00 or by imprisonment for not less than 10 days nor more than six months, or by both such fine and imprisonment. The imposition of one penalty for any and all such persons shall be required to correct or remedy such violations or defects within a reasonable time; and when not otherwise specified, each ten days that prohibited conditions are maintained shall constitute a separate offense. B. The application of the above penality shall not be held to prevent the enforced removal of prohibited conditions. Section 3. That all ordinances of this Village in conflict herewith are herety repealed. Section 4. This ordinance shall be in full force and effect upon its passage, approval and publication according to law.
