AN ORDINANCE REGULATING AND LICENSIN➢ SERVICE STATIONS SUPPLEMENTING THE
MUNICIPAL CODE OF ELK GROVE VILLAGE OF 1961
NCW9 THEREFORE' BE IT ORDAINED by the President and Board of Trustees of the
Village of Elk Grove Village, Cook County, Illinois:
Section 1. That Chapter 22 of the Municipal Code of Elk Grove Village of 1961
be amended and supplemented by adding the following article and sections which
shall read as follows:
ARTICLE XIII SERVICE STATIONS
Section 22.1301 DEFINITIONS. When used in this article unless the context
otherwise requires, the following definitions shall apply:
(a) "Person' means any natural individual, fi.m.. trust, estate.. partnerships
association, joint stock company, joint adventure, corporation, public
or private, or a receiver, trustee, conservator, or other representative
appointed by cider of any court.
(b) "Motor fuel" to mean the same as defined by the "Motor Fuel Tax Law of
the State of Illinoia" and the meaning of "motor fuel" in this article
shall change from time to time in accordance with aW changes affected
by amendment to the "Motor Fusl Tax Lawe"
(c) "Service S+::ion" means any store, factory, Pilling station, garage,
lot or other place at which equipment is provided.
(1) For dispensing, motor fuel to consumers..
(2) For disp--nsing motor fuel into the fuel tanks of motor vehicles
for operating the motors thereof for the purpose of propelling
the said mr.tor vehicles (in whole or in part) upon the public
highways
(d) "Tanks" means any receptacle, container or equipment for the storage
of motor fool of whatov.r construction, whether placed above or below
ground.
(1) Except containers having a capacity of ]e ss than twenty-one gallons.
(2) Except contal.mrs having a capacity Less than fifty-five gallons
when such storage is exclusively for industrial purposes other than
for the propulsion of motor vehicles in whole or in part upon the
public highways,
(e) "Gasoline Buggy" means a portable container used for storing or dispensing
motor fuel into the fuel tanks of motor vehicles having a capacity of more
than two gallor,,,, arranged to be carried or moved on wheels or skids, having
as a part of or havi.rg provisions for the use of dispensing equipment in
the form of a puz-p or otharwi.se.
Section 22.1?0-1 PERMIT RESTRICTIONS. No service station or tank for the storage
of ..rotor fuel as herein defined, shall hereafter be erected, built, constructed
or installed by any p-,rscn within the limits of the Village except on a permit
duly issued by the Bul leftng Inspector and countersigtied by the Village Clerk.
No permit shall be isscnd for the erection, construction, installation or building
of any service station or motor fuel storage tank when the number of and capacity
of the stcrege tacks exceeds `..:ne limitations thereof as prescribed by the ordinances
of this Village or where the area within such contemplated erection, construction,
installation, or building lies within the following areas:
(a) Within 200 feet of any church,, school, hospital, fraternal lodge, hall, of
theat_-e.
Section 22.1303 APPLICATION, CONTENTS. The application for a permit required by
this article shall state the interest of the applicant in the lot, parcel or land
on which th:, eraction, ca- truction, build`,. ng or installation is contemplated, and
there shall accompany said application the plans and specifications for the con-
struction of such contemplatad station, tank or appurtenances thereto, and a plat
of survey showing the location of the contemplated structure on the lot upon which
the structure is to be erected„

Section 22.1304 FEES, INSPECTION OF PLANS, ETC. The application for the permit
required by this article shall be made to the Building Inspector and he shall within
fifteen days from the receipt of such application inspect or cause to be inspected
the site of such contemplated construction, erection, or installation, and he shall
ascertain whether such contemplated construction complies with all zoning crdi.nances,
building ordinances, and fire ordinances of the Village. In the event said appli-
cations, plans and specifications and contents conform to this article and the
zoning ordinances, building ordinances, and fire ordinances of the Village said
Building Inspector shall grant the permit requested provided, however, that such
permit shall not become valid until the applicant has paid to the village an
inspection fee of one hundred twenty-five dollars and until said permit is counter-
signed by the Village Clerk.
Section 22.1305. INSPECTION DURING CONSTRUCTION. It shall be the duty of the
Building Inspector to inspect such premises for which a permit is granted during the
course of construction arra said Building Inspector shall have full authority to
order construction stopped in all cases where the construction is not in accordance
with the plans or specifications as approved by the Building Committee.
Section 22.1306 SALE OF GASOLINE AT RETAIL IN PORTABLE CONTAINERS PROHIBITED.
It shall be unlawful for any person, firm or corporation to sell motor fuel at
retail from any gasoline buggy or other vehicle equipped with a tank (the tank
in which motor fuel is carried for the operation of said vehicle being excepted)
having a capacity greater than five gallons or containing separate container or
containers in the aggregate, more than five gallons.
Section 22.1307 EXISTING STATIONS. The provisions of the preceding section of
this article, excepting those regarding gasoline buggies and other portable con-
tainers, shall not affect any existing gasoline service stations or storage tank
installations in actual operation or use on the day of the enactment of this
article, provided, however, that when any such service station or tank installation
shall not have been used or shall have been abandoned for a period of six months or
more after this article becomes effective, the same procedure and requirements of
this article as applicable to new stations or new tank installations shall apply
before such abandoned stations or storage tank can be reoccupied or used for the
sale or storage of motor fuel.
Section 22.1308 LICENSE REQUIRED. It shall be unlawful to conduct or operate a
service station without having first obtained a license therefor, The annual fee
for such license shall be ten dollars for each pump operated.
Section 22.1309 NON -BUSINESS SERVICE STATIONS. Argy person, firm or corporation
maintaining or operating any storage tank for gasoline for the use of automobiles
of the owner, lessee, employees, or agents of such person, firm or corporation
shall comply with all of the provisions of this article other than the requirement
for the payment of a fee.
Section 2. Any and all ordinances of the Village of Elk Grove Village in conflict
herewith are hereby repealed.
Section 3. PENALTY. Any person, firm or corporation violating any provision of this
article shall be fined not less than five dollars nor more than two hundred dollars
for each offense; and a separate offense shall be deemed committed on each day during
or on which a violation occurs or continues.
Section 4. That this ordinance shall be in full force and effect upon its passage,
approval and publication according to law.
