BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ELK GROVE VILLAGE, COOK COUNTY, ILLINOIS - SECTION 1. Establishment. There is hereby created and established for the Village of Elk Grove Village a Police Reserve consisting of not more than forty (40) persona, which shall include in its membership persons not having regular employment at work other than that of a policeman, who have been enrolled as members of said Police Reserve in the manner hereinafter provided. Such persons shall be known as Reserve Policemen. SECTION 2. Membership. Membership in said Police Reserve shall consist of and be limited to those persons who meet the following requirements: (1) Have filed with the Commission„ hereinafter established, an application for membership as Reserve Policeman, which said application shall contain an acknowledgement that said applicant is not acting in this capacity as a regular city employee or officer. (2) Is not less than 21 years of age nor more than 55 years of age. (3) Is approved by the Commission, hereinafter established, as being physically and mentally qualified to act as a Reserve Policeman. (4) Carries property damage and public liability insurance covering the operation of any motor vehicle, not munici- pally owned, to be used by said Reserve Policeman in such amount and form as may be approved by the Commis- sion hereinafter established. (5) Has in force and on file in the Office of the Village Clerk of the Village of :Elk Grove Village„ a bond in the penal sum of $500.00 with security to be approved by Attorney for the Village, payable to the Village of Elk Grove Village, conditioned upon the faithful performance of the duties im- posed upon such Reserve Policeman. (6) Is a citizen of the United States of America. and has been a resident of the Village for ona (1) year prior to appointment. SECTION 3. Termination of Membership. The name of any Reserve Policeman shall be stricken from the rolls of the Police Reserve by the Commission, hereinafter established, if at any time it is determined by the said Commission that said Reserve Policeman (a) is not satisfactorily performing his function, or (b) in writing, notifies said Commission of his election to terminate his membership and responsibility as such Reserve Policeman, or (c) has attained the age of 65 years, or (d) is no longer physically or mentally qualified to act as such Reserve Policeman, or (e) has not maintained property damage and public liability insurance covering the operation of any motor vehicle„ not municipally owned, to be used by him as presckibed and set forth in Subparagraph (4) of Section 2 above, or (f) has not maintained a bond as prescribed and set forth in Subparagraph (5) of Section 2 above, or (g) has failed to comply with a command and direction of his superior officers, or (h) has failed to abide by the regulations adopted by his superior officers or by the Commission herein established, or (i) has failed to render services as such Reserve Police- man equal to 8 hours of active tour of duty in any cal- endar month; sickness, absence from the Village, vaca- tion or illness of some member of the immediate family of such Reserve Policeman shall constitute valid excuse for such failure to render the required amount of service, provided a report in respect to the reason for such absence is transmitted to the officer in command in advance of such absence or within a reasonable time thereafter, or (j) has been guilty of conduct unbecoming a police officer or has been guilty of immoral conduct, disorderly conduct, use of coarse., profane or insolent language to any other member of the department or to a citizen, or the unlavAul use of any weapon. SECTION 4. Membership Roll. The roll of membership in said Polio:;: Reserve shall be permanently maintained by the said Commission, herei=fter established, and a copy thereof shall be filed by said Commission in the Office of the Village Clerk of the Village of Elk. Grove Village. Any additions or -2� e deletions from said membership roll shall be transmitted forthwith by said Commission to said Village Clerk., Only those persons whose names are on the official membership roll, so maintained by said Commission, shall be considered Reserve Policemen. SECTION 5. Use of Municipal Equipment. No one, other than a regular Policeman or Reserve Policeman shall be permitted to use, operate, or partici pate in the use and operation of any municipally owned police equipment and then only pursuant to the orders and commands of his superiors or pursuant to the regulations promulgated for the operation of the Police Department of the Village of Elk Grove Village. SECTION 6, Subject to Command, Every Reserve Policeman shall be subject to the command and direction of his superiors and of the duly con- stituted officers of the Police Department and shall abide by all regulations promulgated by his superiors. SECTION T. Powers, Reserve Policemen shall bave all the powers and duties and obligations now vested in Regular Policemen under the ordinances of the Village of Elk Grove Village and the Statutes of the State of Illinois; but said Reserve Policemen are not to be considered police officers within the meaning of any statutes or ordinances providing for police pension funds. The Reserve Policeman shall be under obligation to attend training sessions as designated from time to time by the Chief of Police. SECTION 8., Always on Duty. A member of the Police Reserve for disciplinary purposes shall be considered as being on duty at all times. Al though certain hours are allotted to a respective member for the performance of duty on ordinary occasions„ yet he is required to respond immediately.. &V or night, in any emergency on notice that his services are needed. SECTION 9. Uniforms and Insignia. Reserve Policemen at all times when on active tour of duty shall wear a uniform and identification,, insignia or badge approved by the Chief of Police. When not on active tour of duty,. such ..3- Reserve Policemen shall not wear said uniform„ said insignia or badge but shall carry on his person an identification card 'issued by the Chief of Police and members of the police reserve unit shall not carry loaded firearms unless specially authorized to do so by the Chief of Police while on emergency or special duties pursuant to call as hereinbefore set forth, and violation of this rule concerning firearms shall be cause for immediate dismissal from the police reserve unit. SECTION 10. Compensation. No member of the Reserve Police Unit shall receive compensation from the Village for his services except that while on continuous emergency duty in excess of four (4) hours. compensation at the rate of not to exceed two ($2.00) dollars per hour may be paid for all hours of continuous emergency duty in excess of four (4) hours occurring during any single emergency or period of duty; provided, however, that such payment shall be subject to prior approval by the Village Board. Such member shall be paid two ($2. 00) Dollars per hour from starting time if on detail,. For the purpose of this paragraph.;, training duty as distinguished from emergency duty shall be part of the training program, and no compensation will be paid by the Village to members of the police reserve unit while on training duty regardless of the length of time of such duty. However, in the event that the police reserve unit is called for special duty created by activities of any civi.c, patriotic or semi -civic organization and such organization voluntarily com- pensates the members of the police reserve unit for such special services„ such compensation may be accepted by the members of the police reserve unit. Maximum allowable compensation which may be accepted by the res€^-r,ro unit for such special services shall be determined by the President and Board of Trustees. SECTIONII. Commission Established, There is hereby established a Police Reserve Commission„ the members of which shall be appointed by the President with the advice and consent of the Board of Trustees. Duties of Commission. Said Commission shall administers the laws as in this ordinance provided and shall perform the acts herein ripec d' rally set forth, including the determination of the membership of the Rasez--,ie Police ae above set forth„ provided,, however, that the Commission shall not be charged with the control or supervision of ,said Reserve or its members, SECTION 13, waiver of Liability, Prior to being commissioned, e,a.ch member of the police reserve; unit shall execute an inetrument releasing the Village of Elk Grove Village, from all liability for injury to or death of the member in the line of duty, except so far as may be attributed to gross nmg)3•• genre on the part of the '`Pillage. Such release shall be in a form approved by the Village .Attorney. SECTION 14.
