HomeMy WebLinkAboutORDINANCE - 132 - 4/25/1960 - PUBLIC IMPROVEMENTSORDINANCE NO. 132 AN ORDINANCE PERTAINING TO THE CONSTRUCTION OF PUBLIC IMPROVESIENTS BY PRIVATE CONTRACT AND AMENDING SECTION 4 OF ORDINANCE NO. 118 BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ELK GROVE VILLAGE, COOK COUNTY, ILLINOIS: SECTION 1 That Section 4 of Ordinance No. 118, said ordinance entitled "An Ordinance Pertaining to Construction of Public Improvements by Private Contract," be and the same is hereby amended to read as follows: SECTION 4 Any person, firm or corporation obtaining a permit shall also give bond conditioned that he or they will suitably guard and protect any excavation or obstruction and defend, save, keep harmless and indemnify the Village of Elk Grove Village of and from any and all action, snits, costs, damaged and expenses whatsoever, including attorney's fees which shall or may at arty time happen to come to it for or on account of any injuries or damages received or sustained by any part or parties by or from acts or omissions of the applicant or his or their services in doing such work; and that he or they will restore such streets, sidewalks or public property to its former condition and to complete such work as quickly as possible and when completed to notify the Village Engineers of such fact; and guaranteeing that such work so made in the public streets, sidewalks and public properties and in properties to be dedicated for such public use, is made and constructed in a good and workmanlike manner and of good and proper material and that the same shall not deteriorate, cave in or require repair or reconstruction for a period of at least one (1) year from the time of the approval of such work as herein mentioned. SECTION 2 That this ordinance shall be in full force and effect upon passage, approval and publication according to law.
