HomeMy WebLinkAboutORDINANCE - 51 - 3/10/1958 - PUBLIC IMPROVEMENTS BY PRIVATE CONTRACTSOrdinance No. 51 AN ORDINANCE pertaininito construction of public imp ove- ments by private contract. BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Cook County, Illinois; That: Section 1. No street, sidewalk, water main, sewer or any other public improvement on public property by private contract, shall hereafter he constructed in the Village of Elk Grove Village until a permit therefor shall have been obtained. Section Z. No improvements shall be constructed which do not conform with the requirements act forth in the Village Plan of the Village of Elk Grove Village as adopted or other applicable ordinances; and all such plans and specifications shall be prepared by or under the direction of the Engineers for the Village and all such work shall be done under the supervision of said Engineers for the Village. In any case where plans and specifications shall be prepared by an engineer other than the Engineers for the Village then in that event, such plans and specifications shall be reviewed by the Engineers for the Village and the person submitting said plans shall pay to the Village a sum equal to two and one-half per cent (2 1/216) of the estimated cost of such improvements, of which two per cent (2%) shall be paid to the Engineers for the Village for reviewing said plans and one-half of one per cent (1/2ofo) shall be retained by the Village for administrative costs. Section 3. Any person,, firm or corporation obtaining a permit shall also give bond conditioned that he or they will suitably guard and protect any excavation or obstruction and defend, save, keep harmless and indemnify the Village of Elk Grove Village of and from any and all action, suits, costs, damages and expenses whatsoever, including Attorney's fees which shall or may at any time happen to come to it for or on account of any injuries or damages received or sustained by any part or parties by or from acts or omissions of the applicant of his or their services in doing such work.; and that he or they will restore such streets, side- walks or public property to its former condition and to complete such work as quickly as possible and when completed to notify Engineers for the Village of such fact; and guaranteeing that such work so made in the public streets, and public properties, is made and constructed in a good and workmanlike manner and of good and proper material and that the same shall not deteriorate, cave in or require repair or reconstruction for a period of at least two years from the time of the approval of such work as herein mentioned. Section 4. Any person, firm or corporation violating any of the provisions of this ordinance shall upon conviction thereof, be fined not more than Two Hundred Dollars ($200. 00) for each and every offense. Section 5. This ordinance shall be in full force and effect from and after its passage, approval and publication according to law. PASSED: this 10th APPROVED: this 10th ATTEST: Margaret C.
