HomeMy WebLinkAboutORDINANCE - 54 - 4/21/1958 - LANDMEIER RDOrdinance No. 54 AN ORDINANCE providing for the construction, repair and maintenance of Landmeier Road within the Village of Elk Grove Village, Illinois WHEREAS, Landmeier Road, designated as State Aid Road No. 130, Section 1414, a portion of which lies within the corporate limits of the Village of Elk Grove Village, Cook County, Illinois, is presently improved with a 20 foot pavement constructed and maintained by the County of Cook, State of Illinois; and WHEREAS, the Village of Elk Grove Village is desirous of pro- curing the consent of the Board of Commissioners of the County of Cook, State of Illinois to construct, reconstruct, widen, repair and maintain that part of Landmeier Road lying between the Easterly line of Arlington Heights -State Road and the Easterly line of Tonne Road, extended, in the Village of Elk Grove Village; excepting therefrom that part of the southerly half right of way of Landmeier Road abutting the Branigar's Forest Hills subdivision which is not in the Village; and WHEREAS, the Village of Elk Grove has caused plans and spe- cifications to be prepared to widen Landmeier Road within its corporate limits to make it a 42 foot pavement with curbs, gutters, underground drainage facilities and sidewalks; and WHEREAS, the President and Board of Trustees have determined that it would be for the best interests of the Village of Elk Grove Village that it comply with the request of the authorities of the County of Cook; that the Village pay the costs of construction, reconstruction, widening, installation of drainage facilities and sidewalks and upon completion of said construction to assume the financial responsibility for the maintenance and repair of said portions of Landmeier Road for the use of vehicular and other traffic thereon and to restrict parking thereon. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Cook County, Illinois: Section 1. That the President and Village Clerk be and they are hereby authorized and directed to enter into a written agreement with the County of Cook and State of Illinois for the purpose of assuming financial responsibility of the cost of construction, re- construction, widening and maintenance of that part of Landmeier Road within said village lying between the Easterly line of Arlington Heights -State Road and the Easterly line of Tonne Road, extended, except therefrom that part of the southerly half right of way of Landmeier Road abutting the Branigarts Forest Hills subdivision which is not in the Village; and Section 2. That the President and Board of Trustees upon acquiring said agreement and consent, hereby agree to construct, re- construct and widen said highway, the cost thereof to be paid by Centex Construction Company as per agreement entered into by and be- tween the Village and the said Centex Construction Company; and that upon the construction and reconstruction of said portion of Landmeier Road, the Village of Elk Grove Village hereby agrees to maintain and keep in repair said Landmeier Road including snow removal and weed cutting; and to carry out this commitment, the President and Board of Trustees hereby agree to make a request for allocation of motor fuel tax funds for this purpose. All such construction shall be under the supervision of the County Superintendent of Highways. Section 3. That all plans and specifications for the improve- ment and reconstruction as herein set forth shall be approved by the Highway Commissioner of the County of Cook, the Department of Public Works and Buildings, Division of Highways of the State of Illinois or such other body as may be designated by statute. Section 4. As a further consideration for the agreement proposed herein, the President and Board of Trustees shall adopt an ordinance prohibiting the parking of vehicles upon and along Landmeier Road lying within the Village of Elk Grove Village. Section 5. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 6. That this ordinance shall be in Hall force and effect upon its passage and approval, according to law. PASSED: this 21st day of April, 1958 APPROVED: this 21st day of April, 1958 Charles A. Petrie President Vil.Lage Clark A G R E E M E N T THIS AGREEMENT made and entered into this 15th day of April, A.D. 1958 by and between the VILLAGE OF ELK GROVE VILLAGE, Cook County, Illinois, hereinafter referred to as the "Village" and CENTEX CONSTRUCTION COMPANY, a Corporation, hereinafter re- ferred to as the "Company"; WHEREAS, the Centex Construction Company is presently engaged in the construction of dwellings in a portion of the Village of Elk Grove Village,Cook County, Illinois, together with the con- struction of streets and sidewalks and underground utilities; and WHEREAS, the said Company has requested the Village to procure the construction, reconstruction and widening of that part of Landmeier Road (designated as State Aid Road No. 130, Section 1414) which lies within the Village and more particularly between the Westerly right of way line of Arlington Heights -State Road and the Easterly line of Tonne Road, extended; and WHEREAS, the Village has caused plans and specifications to be prepared to widen Landmeier Road within its corporate limits to make it a 42 foot pavement with curbs, gutters, underground drain- age facilities and sidewalks; and WHEREAS, the Village is about to request the authorities of the County of Cook, who maintain said Landmeier Road, to construct, reconstruct, widening, installation of drainage facilities and sidewalks and upon completion of such construction, to assume the financial responsibility for the maintenance and repair of said portions of Landmeier Road for the use of vehicular and other traffic thereon and to restrict parking thereon; and - 1 - WHEREAS, the Company has heretofore constructed all streets, sidewalks and underground drainage facilities at its own expense and does not seek reimbursement from the Village and is desirous of paying the cost of construction, reconstruction and widening of that portion of Landmeier Road lying within the Village in order that it may carry out its orderly development within the Village. NOW, THEREFORE, for and in consideration of the mutual promises and covenants herein It Is Mutually Agreed as follows: 1. That the Village will adopt an ordinance providing for the construction, repair and maintenance of Landmeier Road within the Village of Elk Grove Village and will make the necessary requests to the County of Cook for such construction reconstruction, widening and maintenance of that part of Landmeier Road lying within said Village and upon completion thereof to maintain and keep in repair said Landmeier Road including snow removal and weed cutting; 2. The Company hereby agrees to pay for the construction set forth in the preambles hereof and will not seek reimbursement for such cost from the Village; 3. The said Company hereby agrees to post a completion bond conditioned upon the construction aforesaid and the payment of the cost thereof in such amount as may be required by the Village, the County of Cook or the Department of Public Works and Buildings, Division of Highways of the State of Illinois; l}. That all such construction shall be in accordance with the plans and specifications prepared by the Village engineers, De Soto B. McCabe & Associates, upon and after the approval of said plans by the Highway Commissioner of the County of Cook, Department of Public Works and Buildings, Division of Highways, State of Illinois, or such other body as may be designated by statute and that all such construction shall be under the supervision of the County Superin- tendent of Highways. This Agreement shall be binding upon, and insure to the successors and assigns of the parties hereto.
