HomeMy WebLinkAboutORDINANCE - 40 - 12/16/1957 - ZONING ORDINANCE AMENDEDOrdinance No. 40 AN ORDINANCE amending the Village of Elk: Grove Village Zoning Ordinance. WHEREAS, the Zoning Board of Appeals of the Village of Elk Grove Village sitting as a Commission at a public meeting duly called and held according to law, considered the question of amending Sections 5 (a) (2) of Articles V, VI and VII to provide for a smaller front yard along the side and length of corner lots; and WHEREAS, the President and Board of Trustees haying considered the recommendations of said Zoning Board of Appeals find merit in the recommendation NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Cook County, Illinois: SECTION 1. That Sections 5 (a) (2) of Articles V, Vl and VII of an ordinance entitled "An Ordinance to regulate, and limit the height and bulk of buildings; to regulate and limit the intensity of the use of lot areas, and to regulate and determine the areas of open spaces within and surrounding such buildings; to classify, regulate and restrict the location of trades and 'industries and the location of buildings designed for specified industrial, business, residential and other uses; to divide the entire Village of Elk Grove Village into districts for the purpose of this ordinance; to fix standards to which buildings or structures shall conform; to prohibit uses, buildings or structures incompatible with the character of such districts respectively; and to prevent additions to and alterations or remodeling of existing buildings or structures in such a way as to avoid the restrictions and limitations lawfully imposed here - under, and to provide penalties for violation hereof" passed and approved July 8, 1957, known as Ordinance No. 20 as amended, be further amended as follows: By adding to each of said sections, the following: "Provided, however, if one such frontage is that of a corner lot, then there shall be a front yard along the side or length of such lot having a depth of not less than fifteen (15) feet." SECTION 2. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this Ordinance shall be fined not more than One Hundred Dollars ($100. 00) for each offense and each day that a violation is permitted to exist shall constitute a separate offense. SECTION 3. That this ordinance ^hall be in full force and effect from and after its passage, approval and publication according to law. Petrie '(Tillage Clerk PUBLISHED the 21st day of Deā€žmember 0 1957 December 13, 1957 President and Board of Trustees Elk Grove Village, Illinois Gentlemen: We transmit herewith for your consideration a recommendation adopted by the Zoning Board of Appeals of Elk Grove Village on the question of amending Sections 5 (a) (Z) of Articles V, VI and VIA which provide "where lots have a double frontage, the required front yard shall be provided on both streets ". This request for an amendment of said sections arises out of the fact that a number of homes have been built in the Village which do not meet the requirements above cited and that it would be desirable that said Sections insofar as they pertain to corner lots have a front yard of 15 feet along the side or length of such corner lot. Your Zoning Board of Appeals held a public hearing as provided by laky and finds: Case 57-4, (1) That due notice was given as provided by law; (2) That the side yard of corner lots should be less than that required for the front of the lot; (3) The testimony presented is convincing of the public need and general desirability of making such a change. Your Zoning Board of Appeals therefore recommends that the amendment as above stated be corrected and that the ordinance which is transmitted herewith be passed by the President and Board of Trustees of the Village.
