HomeMy WebLinkAboutRESOLUTION - 19-99 - 9/14/1999 - LETTER OF UNDERSTANDINGRESOLUTION NO, 19-99 A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT AND VILLAGE CLERK TO EXECUTE A LETTER OF UNDERSTANDING BETWEEN THE COOK COUNTY HIGHWAY DEPARTMENT AND THE VILLAGE OF ELK GROVE VILLAGE (DEVON AVENUE AT TONNE ROAD AND AT BUSSE ROAD AND LANDMEIER ROAD NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DUPage, State of Illinois as follows: Section 1: That the Village President be and is hereby authorized to sign the attached documents marked: LETTER OF UNDERSTANDING DEVON AVENUE AT TONNE ROAD AND AT BUSSE ROAD AND LANDMEIER ROAD AT BUSSE ROAD a copy of which is attached hereto and made a part hereof as if fully set forth and the Village Clerk is authorized to attest said documents upon the signature of the Village President. Section 2: That this Resolution shall be in full force and effect from and after its passage and approval according to law. (3121603-9945 re: Letter of Understanding Devon Avenue at Tonne Road and at Busse Road and Landmeier Road at Busse Road In response to your letter of July 19, 1999, we have prepared this Letter of Understanding, in duplicate, regarding Improvements to the intersections of Devon Avenue at Tonne Road and at Busse Road and Landmeier Road at Busse Road. Following successful application for Federal funding, the VILLAGE will enter into a formal agreement with the COUNTY which in part will contain the following provisions: 1. The VILLAGE will be responsible for Phase I engineering for each of the referenced intersections, in their entirety. The COUNTY will have the opportunity to review and comment on the Phase I studies. 2. The VILLAGE will be responsible for Phase 11 engineering for each of the referenced intersections and pay for seventy (70%) percent of the Phase II engineering cost. The COUNTY will pay thirty (30%) percent of said engineering costs. The COUNTY will have the opportunity to review and approve the Phase 11 engineering plans. Hon. Craig B. The VILLAGE will be responsible for securing seventy (70%) percent of the construction and construction engineering costs for improvements to each of the referenced intersections. The COUNTY will pay thirty (30%) percent of the construction and construction engineering costs of each intersection except for the south leg of the Devon Avenue and Tonne Road intersection for which VILLAGE will be responsible for securing thirty (30%) percent of construction and construction engineering costs. The COUNTY will be the Local Match Agency on any Local Agency Agreement for Federal Participation and appropriate sufficient funds for those obligations. 4. The VILLAGE and the COUNTY will jointly determine, at a later date, the scheduling of construction for each of the intersections and which agency will be the lead agency for the construction of the improvements. S. The VILLAGE will be responsible to pay one hundred (100%) percent (regardless of funding source) of the costs for VILLAGE infrastructure, i.e., sidewalk, watermain, sanitary sewer, trees, etc. included in the improvements including the cost of construction engineering. S. The VILLAGE will acquire all right-of-way necessary for the project at its sole expense regardless of funding source. Failure of the VILLAGE to secure Federal funding and/or a local funding source to accomplish the Improvements shall cause this Letter of Understanding to become null and void.
