HomeMy WebLinkAboutRESOLUTION - 31-98 - 7/14/1998 - LETTER OF UNDERSTANDING AGREEMENT/IDOTRESOLUTION NO. 31-98 A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT AND VILLAGE CLERK TO EXECUTE A LETTER OF UNDERSTANDING AGREEMENT BETWEEN THE ILLINOIS DEPARTMENT OF TRANSPORTATION AND THE VILLAGE OF ELK GROVE,VILLAGE (SALT STORAGE FACILITY/BIESTERFIELD RD) NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois as follows: Section 1: That the Village President be and is hereby authorized to sign the attached documents marked: LETTER OF UNDERSTANDING AGREEMENT JOINT USE OF ILLINOIS DEPARTMENT OF TRANSPORTATION SALT STORAGE FACILITY AT BIESTERFIELD ROAD AND I-290 a copy of which is attached hereto and made a part hereof as if fully set forth and the Village Clerk is authorized to attest said documents upon the signature of the Village President. Section 2: That this Resolution shall be in full force and effect from and after its passage and approval according to law. Walsh g/RES0602M.doc Deputy Village Clerk LETTER OF UNDERSTANDING AGREEMENT JOINT USE OF ILLINOIS DEPARTMENT OF TRANSPORTATION SALT STORAGE FACILITY AT BIESTERFIELD ROAD AND 1-290 It is hereby understood and agreed that the Illinois Department of Transportation (IDOT) will allow the Village of Elk Grove Village (Village) use of its salt storage Facility located at Biesterfield Road and I- 290 (Facility) to serve as the Village's primary facility for its winter operations. The Village utilizes an annual average of 3,600 tons of salt and has a need to store and load salt for approximately ten (10) Village trucks. IDOT's Facility can accommodate that need and usage. When IDOT is in Snow & Ice operations at the Facility, IDOT will load all Village trucks. The Village will provide an endloader and an operator to load trucks on a back-up basis in emergency situations or when IDOT is not in Snow & Ice operations at the Facility. The Village will also provide an asphalt paving machine and roller to assist in the improvement of the Facility. Subject to the approval of IDOT, the Village will store liquid calcium chloride and install dispensing equipment at the Facility. IDOT shall have access to and may utilize said material and equipment. All material provided by either IDOT or the Village and utilized by the other will be tracked as best as possible and reconciled so that each entity is responsible for the cost of the material used by that entity. The Village will replace all salt which it utilizes and shall coordinate delivery of such replacement salt with IDOT. The Village hereby agrees to hold IDOT its officers, agents and employees, harmless from any and all losses resulting from any injury or damage to person or property which may be occasioned by the Village's use of the Facility, except for any loss or damage occasioned by the negligence of IDOT, its officers, agents or employees. This agreement between IDOT and the Village shall begin on July 1, 1998, and may be extended by IDOT in 12 month increments unless terminated by either party. It is further understood and agreed that IDOT, at its discretion, has the right to terminate this agreement by giving written notice to the Village at least 120 days prior to any July 1st renewal date. Acceptance and agreement of all terms of this letter shall be evidenced by the respective signatures of IDOT and the Village by their authorized representatives set forth below with the effective date designated thereafter.
