A RESOLUTION APPROVING A STATEMENT OF COMMITMENT TO
CONSTRUCT PUBLIC SIDEWALK BETWEEN THE VILLAGE OF ELK
GROVE VILLAGE AND OFFICE DEPOT, INC. (1670 LANDMEIER ROAD)
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage, State of
Illinois:
Section 1: That the Village of Elk Grove Village does hereby accept
the attached document marked:
"Statement of Commitment to Construct Public Sidewalk"
a copy of which is attached hereto and made a part hereof as if fully set
forth.
Section 2: That this Resolution shall be in full force and effect
from and after its passage and approval according to law.
VOTE: AYES: 6 NAYS: 0 ABSENT: 0

Legal Description of subject property: See Attached Exhibit "A"
Office Depot Inc., agrees to construct public sidewalk along the
Busse (S.R- 83) frontage of the above described property in the
village of Elk Grove Village immediately upon receiving notice to
do so from the village of Elk Grove Village. We agree to
construct all storm sewer and appurtenances required for the
public sidewalk construction and will secure all the necessary
permits for the construction.
Should the village of Elk Grove Village award a contract for the
sidewalk and/or storm sewer construction, we agree to pay our
pro -rata share of the cost.
If the property ownership is to be transferred prior to the
construction of a public sidewalk and/or storm sewer, we agree to
require the new owner to execute a "Statement of Commitment to
Install Public Sidewalk" satisfactory to the Village of Elk Grove
Village prior to the transfer of ownership.
I understand that the sidewalk construction waiver and the
"Statement of Commitment to Construct Public Sidewalk" will be
recorded in the County Clerk's office by the Village of Elk Grove
Village and the cost therof is the responsibility of the
applicant.
