A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT AND VILLAGE
CLERK TO EXECUTE A MEMORANDUM OF UNDERSTANDING BETWEEN THE
VILLAGE OF ELK GROVE VILLAGE AND THE COOK COUNTY DEPARTMENT
OF PUBLIC HEALTH
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage, State of
Illinois as follows:
Section 1: That the Village President be and is hereby authorized
to sign the attached documents marked:
Memorandum of Understanding
between the Village of Elk Grove and
the Cook County Department of Public Health
a copy of which is attached hereto and made a part hereof as if fully set
forth and the Village Clerk is authorized to attest said documents upon the
signature of the Village President.
Section 2: That this Resolution shall'be in full force and effect
from and after its passage and approval according to law.

Memorandum of Understanding
between the Cook County Department of Public Health and the municipality/township of
Village of
Elk Grove Village in regard to the conduct of suspect food -borne illness investigation.
WHEREAS, the Cook County Department of Public Health (hereinafter referred to as
"CCDPH") is charged with the investigation, control and follow-up of all reports of suspected
or confirmed food -borne illness within suburban Cook County exclusive of the municipalities
of Evanston, Oak Park, Skokie, and Burbank/Sticknay; and
WHEREAS, municipal health departments may be responsible for inspection and licensing
of retail food service establishments within their corporate boundaries; and
WHEREAS, CCDPH and municipal health departments recognize that it is to their mutual
benefit and that of the public they serve to cooperate and collaborate in activities related to
complaints of possible food -borne illness and food -borne outbreaks;
NOW THEREFORE, CCDPH and Village of Elk Grove Village (hereinafter referred
to as °Municipality/rownship") do agree an follows:
1. That the duties and responsibilities of each party are, while not mutually exclusive,
distinct. As the state recognized public health authority for suburban Cook County
exclusive of the municipalities of Evanston, Oak Park, Skokie and Burbank/Stickney,
CCDPH is responsible for data collection (including food and clinical histories) and
analysis, determination of the possible cause and source of the food -borne Illness, and
the ultimate determination and institution of control measures. The
Municipality/rownship may be the, licensing agent and" subsequently is usually
responsible for assuring that the retail food service establishment meets requirements
of the current Food Service Sanitation Code (as amended), IDPH Retail Food Store
and Sanitation Code and local ordinances by physically inspecting the establishment
for deficiencies.
2. It is the duty of the Municipalityfrownship, as outlined in the IDPH Rules and
Regulations for the Control of Communicable Diaesse (as amended), or any other
person having knowledge of a known or suspected case of communicable disease, to
report the suspected food -borne illness to the state recognized local health authority
(i.e. CCDPH) by telephone within 24 hours of notification of such illness. Further,
such reports shall be made to the state recognized local health authority in whose
Jurisdiction the reporter is looted. The reporter may collect any information germane
to the situation (e.g., number of persons involved, list of foods served). Finally, the
reporter shall cooperate in any investigation conducted by health officials.
3. As CCDPH is required, as outlined in the IDPH Rules and Regulations for the Control
of Communicable Diseases (as amended), to maintain the confidentiality of all
individuals named in a report of communicable disease; and as data collected
pursuant to investigation of a report of communicable disease shall also remain
confidential; and as such data so obtained shall be held confidential in accordance
with Section 8-2101 of the Code of Civil Procedure all Rev Stat. as amended, ch. 110
par 8-2101), CCDPH shall not disclose the identity of the complainant in a food -borne
illness complaint to the Municipality/Township.
4. Upon receipt of a complaint of possible food -borne illness, CCDPH will attempt to
