A RESOLUTION APPROVING A STATEMENT OF COMMITMENT TO
INSTALL PUBLIC SIDEWALKS BETWEEN THE VILLAGE OF ELK
GROVE VILLAGE AND SLP REALTY (2100 Landmeier Rd.)
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage, State of
Illinois:
Section 1: That the Village of Elk Grove Village does hereby accept
the attached document marked:
"Statement of Commitment to Install Public Sidewalks"
(SLP Realty - Scott Lift Truck - 2100 Landmeier Road)
a copy of which is attached hereto and made a part hereof as if fully set
forth.
Section 2: That this Resolution shall be in full force and effect
from and after its passage and approval according to law.

STATEMENT OF COMMENT

CONSTRUCT PUBLIC SIDEWALK
LEGAL, DESCRIPTION OF SUBJECT PROPERTY:
LOr 14 IN CENTEX INDUSTRIAL PARKNORTH UNIT 10, BEING A
SUBDIVISION IN SECTION 26, TOWNSHIP 41 NOEM, RANGE 11, EAST OF
THE THIRD PRINCIPAL MERIDAN, IN COOK COUNTY, ILLINOIS.
SLP Realty, a partnership and beneficial owner of the above-
described real estate ("SLP") agrees to construct a public side-
walk along Landmeier Road frontage of the above-described
property in the Village of Elk Grove Village (the "Village')
immediately upon receiving notice to do so from the Village,
provided, however, that no compliance with such request shall be
required unless the '`illage is ready, willing and able to
construct, or to require others to construct, a public sidewalk
extending west of the above-described property along the frontage
of Landmeier Road towards Dierking Road, and further provided
that SLP shall not be required to construct any pubiic sidewalk
that will encroach more than 48" onto SLP's property. SLP agrees
to construct all storm sewers and appurtenances required for the
public sidewalk construction and will secure all necessary
permits for the construction. In the event construction of such
sidewalk is required, SLP shall grant to the Village a Limited
easement over its over its property. solely for the purposes of
maintenance, repair .and public use ;f such sidewaik.

Should the Village award a contract for the sidewalk and/or storm
sewer construction, SLP agrees to pay its pro -rata share of the
cost (based upon frontage). If ownership of the above-described
property is to be transferred prior to the construction of a
public sidewalk and/or storm sewer, SLP agrees to require the new
owner to execute a "Statement of Commitment to Install Public
Sidewalk" on these same terms and to deliver same to the Village
prior to the transfer of ownership.
We understand that this "Statement of Commitment to Construct
Public Sidewalk" will be recorded in the County Clerk's office by
the Village of Elk Grove Village and the cost thereof is the
responsibility of the applicant.
