HomeMy WebLinkAboutRESOLUTION - 21-91 - 4/9/1991 - APPROPRIATING FUNDSRESOLUTION NO. 21-91 A RESOLUTION APPROPRIATING FUNDS IN THE AMOUNT OF $151,400 FOR THE CONSTRUCTION OF BRIDGE IMPROVEMENTS ON JOHN F. KENNEDY BOULEVARD AT SALT CREEK - FAUS PROJECT NO. BR -OS -D1(254) WHEREAS, the Federal Highway Administration, acting through the Illinois Department of Transportation has agreed to fund portions of construction and construction engineering costs associated with bridge improvements on John F. Kennedy Boulevard over Salt Creek identified as Village Section: 91 -00033 -00 -BR; Federal Project No. BR -OS -D1(254); and Job No. C-91-006-91; and, WHEREAS, the improvements to be constructed will be constructed within the Corporate limits of the Village of Elk Grove Village; and WHEREAS, the Village of Elk Grove Village has heretofore committed to contributing certain funds for the construction of said bridge improvements within its Corporate limits; and WHEREAS, the Corporate Authorities of the Village of Elk Grove Village deem the passage of this Resolution to be in the best interest and furtherance of the general welfare of the Village of Elk Grove Village. NOW, THEREFORE, BE IT RESOLVED by the Corporate Authorities of the Village of Elk Grove Village, Cook and DuPage Counties of Illinois, as follows: Section 1: That the provisions of the preamble hereinbefore set forth are hereby restated as though herein fully set forth. Section 2: That there is hereby appropriated the sum of $151,400 for construction and construction engineering costs associated with proposed bridge improvements on John F. Kennedy Boulevard in accordance with the engineering plans for the proposed Federal Aid Urban Project identified as John F. Kennedy Boulevard over Salt Creek, Federal Aid No. BR -OS -D1(254); Village Section 91 -00033 -00 -BR, Village of Elk Grove Village, Cook County, Job No. C-91-006-91. Section 3: That the Village Clerk of the Village of Elk Grove Village shall immediately transmit two (2) certified copies of this Resolution to the District Office of the Department of Transportation, at Schaumburg, Illinois. -1- Section 4: That the Village Clerk is hereby authorized to publish this Resolution in pamphlet form. Section 5: That this Resolution shall be in full force and effect from and after its passage, approval and publication according to law. Under "THE LOCAL AGENCY AGREES": A. Item (3) is revised to read: "To provide for surveys and the preparation of plans for the proposed improvement and engineering supervision during construction of the proposed improvement, including acceptance sampling and testing of the materials in accordance with the specifications, Project Procedures Guide and methods prescribed by the STATE"; The following items are added: (12) To furnish to the STATE, not later than 60 days after reporting construction 100% complete, all construction records for docu- mentation review and retention for audit purposes until the close of the calendar year during which documentation is completed, at which time said records will be returned to the LA for completion of the period of retention stipulated in Item (6). (13) That execution of this agreement constitutes the LA's concurrence on the award of the construction contract to the responsible low bidder as determined by the STATE. (14) The Local Agency certifies to the best of its knowledge and belief its officials: (a) are not presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from covered transactions by any Federal department or agency; (b) have not within a three-year period preceding this AGREEMENT been convicted of or had a civil judgement rendered against them for commission of fraud or a criminal offense in connection with obtaining, attempting to obtain or performing a public (Federal, State, or local) transaction or contract under a public transaction; violation of Federal or State antitrust statutes or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, or receiving stolen property; -3- Village of Elk Grove Cook County 18921 (c) are not presently indicted for or otherwise criminally or civilly charged by a governmental entity (Federal, State, local) with commission of any of the offenses enumerated in item (2) of this certification; (d) have not within a three-year period preceding this AGREEMENT had one or more public transactions (Federal, State, local) terminated for cause or default; II. Under "THE STATE AGREES": A. The following items are added: (6) To provide independent assurance sampling, to furnish off-site material inspection and testing, at sources normally visited by STATE inspectors of steel, cement, aggregates, structural steel, and other materials customarily tested by the STATE, and to provide contract construction administration and general super- vision of the resident engineer. (7) To reimburse the LA for the Federal share of construction engineering on the basis of periodic billings, provided each bill includes evidence of payment by the LA. -4- CERTIFICATION OF RESTRICTIONS ON LOBBYING j� Charles J. (2) If any funds other than Federal appropriated funds have been paid or will be paid to any person for influencing or attempting to influence an officer or employee of any agency, a Member of Congress, an officer or employee of Congress, or an employee of a Member of Congress in connection with this Federal contract, grant, loan, or cooperative agreement, the undersigned shall complete and submit Standard Form -LLL, "Disclosure Form to Report Lobbying," in accordance with its instructions. (3) The undersigned shall require that the language of this certification be included in the award documents for all subawards at all tiers (including subcontracts, subgrants, and contracts under grants, loans, and cooperative agreements) and that all subrecipients shall certify and disclose accordingly. This certification is a material representation of fact upon which reliance is Placed when this transaction was made or entered into. Submission of this certification is a prerequisite for making or entering into this transaction imposed by section 1352, title 31, U. S. Code. Any person who fails to file the required certification shall be subject to a civil penalty of not less than 510,000 and not more than $100,000 for each such failure.
