A RESOLUTION GRANTING A TEMPORARY CONSTRUCTION PERMIT
AND HOLD HARMLESS AGREEMENT TO PRINCE OF PEACE UNITED
METHODIST CHURCH FOR THE 1989 DEVON AVENUE/LANDMEIER
ROAD WATERMAIN IMPROVEMENT
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage, State of
Illinois as follows:
Section 1: That the Village President be and is hereby authorized
to sign the attached documents marked:
1. Hold Harmless Agreement 1989 Devon Avenue/Landmeier
Road Watermain Improvement
2. Temporary Construction Permit 1989 Devon Avenue Watermain
Improvement
a copy of which is attached hereto and made a part hereof as if fully set
forth and the Village Clerk is authorized to attest said documents upon the
signature of the Village President.
Section 2: That this Resolution shall be in full force and effect
from and after its passage and approval according to law.

SUBJECT: 1989 DEVON AVENUE/LANDMEIER ROAD WATERMAIN IMPROVEMENT
The Village of Elk Grove Village (Village) agrees to indemnify and
hold harmless the Prince of Peace United Methodist Church (Church),
its Trustees, Officers, Officials and Employees from any and all
losses, claims, actions, costs, expenses, judgements, subrogations
or other damages resulting from injury to any person (including injury
resulting in death) or damage (including loss or destruction) to
property of whatsoever nature or any person arising out of incident
to the performance of work by the village (including but not limited
to its employees, agents, contractors, subcontractors and others
designated by the Village to perform work or services in, about or
attendant to, the work and services under the terms of the contract)
for the project listed above. The Village shall not be held
responsible for any losses, expenses, claims, subrogations, actions,
costs, judgements or other damages, directly, solely and proximately
caused by the negligence of the Church.

PROJECT 1989 WATERMAIN IMPROVEMENT
The undersigned, being the free or beneficial owner(s) of
certain real estate legally described on the rider attached hereto
and made part hereof, Grant(s) to the Village of Elk Grove Village
a body politic and corporate, for its use or the use of others so
designated by it, the right and privilege to enter upon said described
real estate for the purpose of constructing auger pit to auger
watermain under Arlington Heights Road
in connection with the improvement of Devon Avenue Watermain Replacement
The Grantor(s) agree that the Village of Elk Grove Village
and its contractors shall be authorized such Right of Entry to
construct, operate and maintain the above noted item(s) in accordance
with plans approved by the Village of Elk Grove Village.
All disturbed areas will be returned to their original or
better condition. Sod will be used in all lawn areas.
Right of Entry shall commence March 1, 1990
and terminate November 1, 1990
