A RESOLUTION DIRECTED TO THE COOK COUNTY BOARD OF COMMISSIONERS,
COOK COUNTY BOARD OF APPEALS, AND THE COUNTY CLERK FOR TRANSMITTAL
TO COOK COUNTY BOARD OF COMMISSIONERS IN RESPONSE TO THE PUBLIC
HEARING HELD BY THE COOK COUNTY BOARD OF APPEALS ON MARCH 3, 1989
REGARDING THE REZONING OF PROPERTY LOCATED ON THE NORTH SIDE OF
DEVON AVENUE APPROXIMATELY 454 FEET WEST OF RIDGE AVENUE
WHEREAS, the petitioner and owner, Michael Seay, of the property
legally described as follows:
Lot 9 and 10 (except N. 210 ft. thereof), in Wm. Lumpp's
Devon Avenue Farms Subdivision of part of South 1/2 of
Section 33, Township 41 North, Range 11, East of the
Third Principal Meridian in Cook County, Illinois
has petitioned for a map amendment to rezone from R-4 Single Family
Residential District to C-3 General Service District for office and retail
service business,
WHEREAS, said case has been docketed as Docket Number 5150 by the Cook
County Zoning Board of Appeals: and
WHEREAS, the Village of Elk Grove Village is contiguous to this
property on the North side.
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage, State of
Illinois as follows:
Section 1: That the Village of Elk Grove Village does hereby submit
the following response and recommendation regarding the petitioner's
request for rezoning of the subject property described above:
a. The petitioner stated that he intends to connect to Elk Grove
Village water and provide a septic system until sanitary
sewer is extended to lots 9 and 10. However, the parcels of
property are outside the corporate limits of Elk Grove Village
and, therefore, will not receive sanitary sewer or water
service from the Vi age of Elk Grove.
b. The State of Illinois regulatory flood plain maps reflect
approximately fifty percent of Lots 9 and 10 to be located
within the flood plain.
c. The County of Cook should require a hydrologic study using
Illinois Department of Transportation hydrologic model in
order to determine the quantity of water that will be dis-
placed by the development as well as the necessary
compensatory storage.
d. The Illinois Department of Transportation, in a report
dated March 10, 1989 and attached as Exhibit "A" states
that care should be exercised for developments on Devon
Avenue (including Lots 9 and 10 in Wm. Lumpp's Devon
Avenue Farms Subdivision) to ensure that development in
the area does not increase flood potential in Elk Grove
Village.
Section 2: That Elk Grove Village objects to the rezoning and
development of Lots 9 and 10 in the Wm. Lumpp's Devon Avenue Farms
Subdivision until such time that the owner/developer submits unequivocal
proof that the development in the floodplain will not increase flood
potential in Elk Grove Village.
Section 3: That this Resolution shall be in full force and effect
from and after its passage and approval according to law.
Section 4: That the Village Clerk's Office is hereby directed to
submit the foregoing Resolution to all governmental bodies that have
jurisdiction and/or interest in the development of the premises as set
forth above and set forth in the caption thereto.
