HomeMy WebLinkAboutRESOLUTION - 40-88 - 6/14/1988 - STATEMENT OF COMMITMENT/SIDEWALKRESOLUTION NO. 40-88 A RESOLUTION APPROVING A STATEMENT OF COMMITMENT TO INSTALL PUBLIC SIDEWALKS BETWEEN THE VILLAGE OF ELK GROVE VILLAGE AND AMERICAN NATIONAL BANK AND TRUST COMPANY OF CHICAGO (2121 LANDMEIER ROAD) NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois: Section 1: That the Village of Elk Grove Village does hereby accept the attached document marked: "Statement of Commitment to Install Public Sidewalks" a copy of which is attached hereto and made of part hereof as if fully set forth. Section 2: That this Resolution shall be in full force and effect from and after its passage approval according to law. PASSED this 14th day of June f988. APPROVED this 14th day of _ _ June 198 8. Smith Village Clerk 01871 04-14-88 STATEMENT OF COMMITMENT TO CONSTRUCT PUBLIC SIDEWALK American National Bank and Trust Company of Chicago, not personally but solely as trustee of a Trust Agreement dated August 30, 1967, and known as Trust No. 25391 (the "Trustee"), states that it is the legal owner of the real estate described in Exhibit A attached hereto. The Trustee agrees to construct a public sidewalk within the public right-of-way along the Landmeier Road frontage of the above-described property in the Village of Elk Grove Village, Illinois, promptly upon receiving notice from said Village that it is requiring the Trustee and the owners of adjacent properties fronting Landmeier Road to construct such sidewalks. The Trustee further agrees to construct such culverts transversing across and beneath said sidewalk as may be necessary to restore the free flow of storm waters interrupted by the construction of said sidewalk and agrees to secure all necessary permits for such construction. Should the Village of Elk Grove award a contract for said sidewalk construction, the Trustee agrees to pay its pro rata share of the cost. If the property described in Exhibit A is to be transferred prior to the construction of a public sidewalk, the Trustee agrees to require the new owner to execute a statement of commitment to install public sidewalk similar in form to this instrument prior to the transfer of ownership. The Trustee understands that this instrument will be recorded in the County Clerk's office by the Village of Elk Grove Village and the cost thereof is to be the responsibility of the Trustee.
