A RESOLUTION AMENDING THE VENTURE AGREEMENT WHICH
ESTABLISHED NORTHWEST CENTRAL DISPATCH SYSTEM
WHEREAS, the Villages of Arlington Heights, Buffalo Grove, Elk Grove
Village and Mount Prospect have for many years maintained and operated a
centralized public safety communications system called Northwest Central
Dispatch System; and
WHEREAS, such system was created pursuant to both Article VII, Section
10 of the 1970 Constitution of the State of Illinois, and the
Intergovernmental Cooperation Act, Chapter 127, Paragraphs 741 through 749
of the Illinois Revised Statutes, and
WHEREAS, legislation recently approved by the Illinois General
Assembly provides that an intergovernmental cooperative such as Northwest
Central Dispatch System may participate in the Illinois Municipal
Retirement Fund as an independent entity only if the venture agreement
establishing the cooperative specifically cites the Intergovernmental
Cooperation Act; and
WHEREAS, the venture agreement which originally authorized creation of
Northwest Central Dispatch System and the subsequent replacement agreement
neglected to make express reference to the Intergovernmental Cooperation
Act; and
WHEREAS, The Village of Elk Grove Village deems it appropriate and
beneficial that Northwest Central Dispatch System continues its
participation in IMRF, and
WHEREAS the current NWCDS Venture Agreement which was executed on or
about November 27, 1979 was an update of a valid Venture Agreement executed
on or about October 15, 1974 and was intended to incorporate all of those
valid portions of the October 15, 1974 agreement as if the October 15, 1974
agreement were still in existence.
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage, State
of Illinois as follows:
Section 1: That the Northwest Central Dispatching System Venture
Agreement of November 27, 1979 and the antecedent agreement executed on or
about October 15, 1974 to which the Village of Elk Grove Village was a
party are both hereby amended as follows:

Each reference to Article VII, Section 10 of the
1970 Constitution of the State of Illinois or to
the Illinois Constitution shall be followed by
"and the Intergovernmental Cooperation Act,
Chapter 127, Paragraphs 741 through 749 of the
Illinois Revised Statutes...".
Section 2: That this Resolution shall be in full force and effect
from and after its passage and approval according to law.
