HomeMy WebLinkAboutRESOLUTION - 48-88 - 7/26/1988 - AGRMNT FOR TRAFFIC CONTROL SIGNALSRESOLUTION NO. 48-88 A RESOLUTION AUTHORIZING THE PRESIDENT AND VILLAGE CLERK TO EXECUTE AN AGREEMENT BETWEEN THE VILLAGE OF ELK GROVE VILLAGE AND THE STATE OF ILLINOIS FOR THE INSTALLATION OF TRAFFIC CONTROL SIGNALS (Busse Road and Howard Street) NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois: Section 1: That the Village President be and is hereby authorized to sign the attached documents marked: a copy of which is attached hereto and made a part hereof as if fully set forth and the Village Clerk is authorized to attest said documents upon the signature of the Village President. This agreement entered into this day of A.D., 19 , by and between the STATE OF ILLINOIS, acting by and through its Department of Transportation, hereinafter called the STATE, and E1K Grove Village, of Cook County, of the State of Illinois, hereinafter called the VILLAGE. WITNESSETH: WHEREAS, the STATE, in order to facilitate the free flow of traffic and insure safety to the motoring public, is desirous of improving the intersection of IL Rte 83 (Busse Rd) @ Howard Street by installing traffic control signals (to be known as STATE Section 540TS-87 and as VILLAGE Section 88 -00032 -00 -TL), by installing coordination equipment, i.e. time base coordinator compatible with the existing signal system on IL Route 83 (Busse Rd), and by performing all other work necessary to complete the improvement in accordance with the plans and specifications; and, WHEREAS, the STATE'S traffic signal improvement on IL Rte 83 (Busse Rd) @ Howard Street is in anticipation of the VILLAGE'S intent to construct a fourth leg and appurtenant left turn lane at said intersection; and, WHEREAS, the roadwork revisions described above are to be completed by the VILLAGE prior to the start of construction of the STATES traffic signal improvement. Failure to do so will be cause for the STATE to revise the traffic signal improvement to accomodate the present intersection geometrics. All costs thereafter to modify the new traffic signal installation due to roadwork intersection revisions, will be the sole responsibility of the VILLAGE. WHEREAS, the VILLAGE is desirous of said improvement in that same will be of immediate benefit to the VILLAGE residents, and permanent in nature; and, WHEREAS, the intersection of IL Rte 83 (Busse Rd) @ Howard Street lies within the corporate limits of the VILLAGE. NOW THEREFORE, in consideration of the mutual covenants contained herein, the parties hereto agree as follows: 1. The STATE agrees to prepare plans and specifications, receive bids, award the contract, furnish engineering inspection during construction, and cause the improvement to be built in accordance with the plans, specifications, and contract. The STATE also agrees to pay all construction and engineering costs subject to reimbursement by the VILLAGE as hereinafter stipulatea. -2- 2. The VILLAGE agrees to approve the plans and specifications by letter or resolution prior to the STATE advertising for the work to be performed hereunder. 3. It is mutually agreed that the proportional participation for the construction costs and engineering costs of this improvement shall be as follows: STATE VILLAGE FUNDS FUNDS Traffic Signals 508 508 s Coordination Equipment Traffic Signal 508 508 Engineering 4. It is mutually agreed that the VILLAGE will reimburse the STATE in an amount equal to the VILLAGE'S share of the actual cost as determined in accordance with Item 3 above. It is mutually agreed that upon award of the contract for this improvement, the VILLAGE will pay to the Department of Transportation of the State of Illinois, in a lump sum from any funds allotted to the VILLAGE, under the Motor Fuel Tax Law, an amount equal to 958 of its obligation incurred under this Agreement, and will pay to the said Department the remainder of its obligation in a lump sum, upon completion of the pr'oject based upon final costs. 6. The VILLAGE has passed a resolution appropriating sufficient funds to pay its share of the cost of this improvement, a copy of which is attached hereto as Exhibit "A" and made a part hereof. =P_ 7. Upon acceptance by the STATE of the installation of the new traffic signal and coordination equipment, the financial responsibility for maintenance and electrical energy for the operation of the signals and coordination equipment shall be proportioned as follows: Maintenance Electrical Energy Traffic Signals 508 STATE 08 STATE and Coordination 508 VILLAGE 1008 VILLAGE Equipment It is agreed that the actual signal and coordination equipment maintenance will be performed by the STATE, either with its own forces or through an ongoing contractual agreement and that the signals shall be maintained to at least Level of Maintenance II. It is understood that Level of Maintenance I meets the minimum requirements of the Illinois Manual on Uniform Traffic Control Devices for Streets and Highways and Level of Maintenance II exceeds the Manual requirements and is prescribed for those signals that the District Engineer, with the concurrence of the Engineer of Traffic, determines to require a higher level of service for adequate operations of the highway system at those locations. The STATE agrees to bill the VILLAGE for its proportionate share of the signal maintenance costs on a three-month basis. Upon receipt of said maintenance bill the VILLAGE shall reimburse the STATE in the amount of the bill made payable to the "Treasurer of the State of Illinois". Any proposed expenditures in excess of $5,000.00 for repair of damage to signal installations must be approved by the billed party before the expenditure is made. 8. Payment by the STATE of any or all of its share of maintenance costs is contingent upon the STATE receiving adequate funds in its annual appropriation. 9. The parties hereto agree that the traffic signal maintenance and energy provisions of this Agreement shall remain in effect for a period of twenty (20) years from the date of its execution or so long as the traffic signals covered by the terms of this Agreement or any Amendment hereto remain in place either in their current or some modified configuration, whichever is the shorter period of time. Such an effective term shall apply unless otherwise agreed in writing by the parties hereto. 10. The STATE retains the right to control the sequence of timing of the traffic signals. -4- 11. The STATE will be responsible for maintenance of lane line and median line markings on State maintained routes. The VILLAGE will be responsible for maintenance of stop line markings on all affected routes. 12. The STATE agrees to make arrangements with the local power company to furnish the electrical energy for the operation of the traffic signals. The VILLAGE agrees to pay 100% of this cost as billed by the local power company. 13. The VILLAGE has adopted and will put into effect, prior to advertising for the work to be performed hereunder, an ordinance requiring that parking be prohibited adjacent to this improvement on the approaches lying within the corporate limits of the VILLAGE, a copy of which is attached hereto as Exhibit "B" or immediately adjacent to this improvement as may be determined to be necessary by the STATE from traffic capacity studies. 14. The VILLAGE agrees to exercise its franchise right to cause private utilities to be relocated at no expense to the STATE. 15. The STATE agrees to comply with all applicable Executive Orders and Federal Highway Acts pursuant to the Equal Employment Opportunity and Nondiscrimination Regulations required by the U.S. Department of Transportation. 16. This agreement and the covenants contained herein shall become null and void in the event the contract covering the construction work contemplated herein is not awarded by August 31, 1991.. 17. This agreement shall be binding upon and inure to the benefit of the parties hereto, their successors and assigns. ELK GROVE VILLAGE By: Charles J.
