HomeMy WebLinkAboutRESOLUTION - 15-87 - 2/24/1987 - PROTEST REZONING OF PROPERTYRESOLUTION NO. 15_87 A RESOLUTION DIRECTED TO THE COOK COUNTY BOARD OF COMMISSIONERS, COOK COUNTY BOARD OF APPEALS, AND THE COUNTY CLERK FOR TRANSMITTAL TO COOK COUNTY BOARD OF COMMISSIONERS PROTESTING THE REZONING OF PROPERTY LOCATED APPROXIMATELY 50 FT. SOUTH OF THE CENTER LINE OF BIESTERFIELD ROAD AND APPROXIMATELY 393 FT. EAST OF MARTHA ST. WHEREAS, the Petitioner and Owner, John Riggs, of the property legally described as follows: Lot 8 in Itasca Meadows Farm a Subdivision of part of Section 31, Township 41 North, Range 11, East of the 3rd Principal Meridian have petitioned for rezoning of same from R-4, Single Family Resident District to C-4, General Commercial District and a Special Use in C-4, General Commercial District with a unique use for heating and air conditioning office sales with limited display area. WHEREAS, said case has been docketed as Docket Number 4687 and Docket Number 4688 by the Cook County Zoning Board of Appeals; and WHEREAS, The Village of Elk Grove Village is contiguous to this property on the east side. NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois. Section 1: That the Village of Elk Grove Village does hereby register objection to the petitioner's request for the rezoning of the subject property described above for the following reasons: a. The Elk Grove Village Comprehensive Plan and Official Map adopted on October 22, 1968 and duly filed with the Cook County Clerk declares said land to be within our future annexation plans and for it to be within the corporate limits of Elk Grove Village, with a R-3 Zoning Classification. The proposed commercial use in inconsistent with the Official Map. b. The C-4 Commercial District would permit automobile service stations, billiard and pool halls, bowling alleys, gymnasium, health clubs, and many other intensive and high traffic uses that are normally on a primary thoroughfare. C. That the Cook County Comprehensive Lane Use and Policies Plan (adopted in 1976 and with 1984 revisions) shows this and the properties abutting it on the west and south sides as Single Family Residential. d. That the best and most suitable use of the property is that of Single Family Residential Use; that the Village therefore requests the denial of the application. Section 2: That this Resolution shall be in full force and effect from and after its passage and approval according to law. Section 3: That the Village Clerk's Office is hereby directed to submit the foregoing Resolution to all governmental bodies that have jurisdiction and/or interest in the development of the premises as set forth above and as set forth in the caption thereto.
