A RESOLUTION APPROVING A STATEMENT OF COMMITMENT
TO INSTALL PUBLIC SIDEWALKS BETWEEN THE VILLAGE
OF ELK GROVE VILLAGE AND RBC TECH CENTER
NOW, THEREFORE, BE IT RESOLVED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and
DuPage, State of Illinois:
Section 1 : That the Village of Elk Grove Village does hereby
accept the attached document marked:
"Statement of Commitment to Install
Public Sidewalks"
a copy of which is attached hereto and made of part hereof as
if fully set forth.
Section 2: That this Resolution shall be in full force and
affect from and after its passage approval according to law.

LEGAL DESCRIPTION OF SUBJECT PROPERTY: That part of Lot 2 in the resubdivision
of Lots 1 and 2 of Everding Subdivision of part of the Southwest Quarter of Section
26, Township 41 North, Range 11, East of the Third Principle Meridian, which lies
Southerly and Westerly of Jarvis Avenue as dedicated by Document 25557358 and West
of the West line of Lots 12 to 16 in SDK Subdivision No. 2, According to the Plat
thereof recorded August 22, 1980 as Document 25557358, in Cook County, Illinois.
Draper and Kramer, Inc. , Partner; SDK Industrial Parks agrees to construct
public sidewalk along Busse Road and Landmeier Road frontages of the above-described
property in the Village of Elk Grove Village immediately upon receiving notice to do
so from the Village of Elk Grove Village. We agree to construct all storm sewers
and appurtenances required for the public sidewalk construction and will secure all
the necessary permits for the construction.
Should the Village of Elk Grove Village award a contract for the sidewalk
and/or storm sewer construction, we agree to pay our pro-rata share of the cost.
If property ownership is to be transferred prior to the construction of a
public sidewalk and/or storm sewer, we agree to require the new owner to execute a
"Statement of Commitment to Install Public Sidewalk" satisfactory to the Village of
Elk Grove Village prior to the transfer of ownership.
I understand that the sidewalk construction waiver and the "Statement of
Commitment to Construct Public Sidewalk" will be recorded in the County Clerk's
office by the Village of Elk Grove Village and the cost thereof is the
responsibility of the applicant.
