HomeMy WebLinkAboutRESOLUTION - 6-84 - 2/28/1984 - AGREEMENT/GEORGE VASSOS RESOLUTION NO. 6-84 A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT TO SIGN AN AGREEMENT BY AND BETWEEN THE VILLAGE OF ELK GROVE VILLAGE AND GEORGE VASSOS NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois: Section 1 : That the Village President be and is hereby authorized to sign the attached documents marked: "AGREEMENT" between the Village of Elk Grove Village and George Vassos . a copy of which is attached hereto and made a part hereof as if fully set forth and the Village Clerk is authorized to attest said documents upon the signature of the Village President. Section 2: That this Resolution shall be in full force and effect from and after its passage and approval according to law. PASSED this 28th day o f February , 1984. V I I J�rge Pesident ATTEST: Village Clerk This Agreement dated this 28th day of February iq�8,4 -by and between the Village of Elk Grove Village , an Illinois Municipal Corporation, (Village) and George Vassos (Vassos) .- WITNESSETH: WHEREAS , on or about Semtemb.er of 1977 the Village conveyed certain property identified as Lot 347 in Centex Industrial Park Unit 212 toVassos for the Purpose of construction by Vassos of a parking area for his restaurant property located immediately adjacent thereto; and WHEREAS , when the parking area was installed, Vassas inadvertently extended said area approximately ten (10) feet on Lot 346 which Lot is owned by the Village, and furthermore, caused the placement of curbing which curbing blocked the surface drainage from said Lot 346, and WHEREAS, the surface drainage blockage resulted in deterioration in several areas of the Village 's narking area located on Lot 346; and WHEREAS , the Village has determined that it has no present use or need for the 10.00 foot strip and the conveyance of same will not impair the use of the remaining portion of Lot 346, and Vassos is desirous of obtaining title to said property. NOW , THEREFORE,. in consideration of the mutual promises and conditions hereinafter set forth, IT IS HEREBY AGREED by and between the parties hereto as follows : 1. The Village will convey the following described property to Vassos within sixty (60) days from the date hereof , provided Vassos has made payment to the Village or its Contractor for the resurfacing of the rear portion of Lot 346: The South 10 .00 feet of Lot 346 in Centex Industrial Park Unit 212, being a Subdivision in the North half of Section 34 , Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County , Illinois . 2 . Vassos shall be responsible for the preparation of all documents and pay all costs attributable to the conveyance of said property by the Village. 3. Vassos will pay for the cost� of resurfacing the parking, lot of Lot 346 owned by the Village including base repair pursuant to plans and specifications prepared by the Village's Department of Engineering. Additional costs for resurfacing- requested by the Village for the connecting drive- way and any other area not previously surfaced will be paid by the Village. 4- Vassos will remove the existing curbing adjacent to Lot 346 and. will install concrete wheel stops in its place, thereby permitting surface drainage to flow from the Village property across property owned by Vassos to an existing drainage ditch. 5 . Vassos shall hold the Village harmless for any and all damage or liability which may occur as a result of the surface drainage flow referred to above . 6 . Vassos will not cause said drainage to be altered or changed in such a manner as would block the flow of surface water from Lot 346 .
