A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT TO SIGN A LETTER
OF UNDERSTANDING BETWEEN THE VILLAGE OF ELK GROVE VILLAGE AND
THE ILLINOIS DEPARTMENT OF TRANSPORTATION FOR THE INSTALLATION
OF PERMANENT TRAFFIC CONTROL SIGNALS AT THE INTERSECTION OF
ILLINOIS ROUTE 72 AND KING/STANLEY STREET UNDER STATE SECTION
31 TS -1(83)
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage, State of
Illinois:
Section 1: That the Village President be and is hereby authorized
to sign the attached documents marked:
ILLINOIS DEPARTMENT OF TRANSPORTATION
LETTER OF UNDERSTANDING
a copy of which is attached hereto and made a part hereof as if fully set
forth and the Village Clerk is authorized to attest said documents upon
the signature of the Village President.—
Section 2: That this Resolution -shall be in full force and effect
from and after its passage and approval according to law.

SUBJECT: HIGGINS/KING TRAFFIC SIGNAL
- LETTER OF UNDERSTANDING WITH IDOT
Attached for signature by the Village President are two
copies of the Letter of Understanding with IDOT for the proposed
traffic signal at Higgins Rd. and King St.
A summary of the agreement follows:
1) The State will pay all construction and
engineering costs.
2) The State will pay for 75% of the maintenance
costs. _
3) The Village will pay 100% of the energy costs.
4) The Village shall pass an ordinance prohibiting
parking adjacent to the improvement on the
approaches within the Corporate Limits. This
has been done by Ordinance No.'s 674, 918 and 925.
I recommend the execution of this Letter of Understanding.
The Agreement, parking ban ordinances and the attached copy of
"Plan Approval" must be returned to IDOT, Attn: Mr. Ben La'O,
Bureau of Traffic.

LETTER OF UNDERSTANDING

Dear Mr. Zettek:
The Illinois Department of Transportation has tentatively
scheduled the installation of permanent traffic control signals at
the intersection of Illinois Route 72 and King Street/Stanley
Street under STATE Section 31 TS -1(83).
If you are in agreement with this Letter of Understanding, please
affix your signature on this letter and return the original to the
attention of the Bureau of Traffic. The copy is for your files.
The Village of Elk Grove Village, hereinafter referred to as the
VILLAGE , and the State of Illinois, hereinafter referred to as
the STATE, mutually understand and agree to the following:
1. The STATE agrees to make the surveys, prepare plans and
specifications, receive bids, award the contract, furnish
engineering inspection during construction, and cause the
improvement to be built in accordance with the plans,
specifications,.and contract.
2. The STATE agrees to pay all non-federal construction and
engineering costs for the installation of the traffic signals.
3. The estimated cost of the traffic signal installation is as
follows:
Construction Costs $80,000.00
Engineering Costs (15%) $12,000.00
TOTAL $92,000.00
4. The VILLAGE agrees to approve the plans and specifications by
letter or resolution prior to the STATE advertising for the
work to be performed hereunder.

5. Upon acceptance by the STATE of the traffic signal work
included herein, it is mutually agreed that the financial
responsibility for maintenance of the traffic signals shall
be divided as follows:

6. Upon the completion of this improvement is agreed that the
actual signal maintenance will be performed by the STATE,
either with its own forces or through an ongoing contractual
agreement.
It is further agreed that the signals shall be maintained to
at least the Level of Maintnenace II specified in the
attached Exhibit "A" and made a part hereof.
It is understood that Level of Maintenance I meets the
minimum requirements of the Illinois Manual on Uniform
Traffic Control Devices for Streets and Highways and Level of
Maintenance II exceeds the manual requirements and is
prescribed for those signals that the District Engineer, with
the concurrence of the Engineer of Traffic, determines to
require a higher level of service for adequate operation of
the highway system at those locations.
7. It is mutually agreed that the financial responsibility for
electrical energy charges for the operation of the traffic
signals shall be borne entirely by the VILLAGE.
8. The STATE agrees to bill the VILLAGE for its proportionate
share of the signal maintenance costs on a three-month
basis. Upon receipt of said maintenance bill the Village
shall reimburse the STATE in the amount of the bill made
payable to the "Treasurer of the State of Illinois". Any
proposed expenditures in excess of $5,000 for repair of
damage to single signal installations must be approved by the
billed party before the expenditure is made.
Payment by the STATE of any or all of its share of
maintenance costs is contingent upon the STATE receiving
adequate funds in its annual appropriation.
The parties hereto agree that the traffic signal maintenance
and energy provisions of this Letter of Understanding shall
remain in effect for a period of twenty (20) years from the
date of its execution or so long as the traffic signals
covered by the terms of this Letter of Understanding or any
amendment hereto remain in place either in their current or
some modified configuration, whichever, is the shorter period
of time. Such an effective term shall apply unless otherwise
agreed in writing by the parties hereto.

9. The STATE agrees to make arrangements with the local power
company to furnish the electrical energy for the operation of
the traffic signals and to bill the VILLAGE for the entire
cost of the energy charges. The VILLAGE agrees to pay this
cost as billed by the local power company.
10. The STATE retains the right to control the sequence and
timing of the traffic signals.
11. The VILLAGE has adopted and will put into effect, prior to
advertising for the work to be performed_ hereunder, an
ordinance requiring that parking be prohibited adjacent to
this improvement on the approaches lying within the corporate
limits of the VILLAGE, a copy of which is attached hereto as
"Exhibit B" and will, in the future, prohibit parking at such
locations on or immediately adjacent to this improvement as
may be determined to be necessary by the STATE from traffic
capacity studies.
12. The VILLAGE agrees to exercise its franchise right to cause
private utilities to be relocated at no expense to the STATE.
13. This Letter of Understanding shall become null and void in
the event the contract covering the construction work
contemplated herein is not awarded by June 30, 1987.
14. This Letter of Understanding and the covenants contained
herein shall be binding upon and inure to the benefit of the
parties hereto, their successors and assigns.

EXHIBIT A
TRAFFIC SIGNAL MAINTENANCE PROVISIONS
LEVEL II
The maintaining -agency agrees to:
1. Patrol the traffic control signal system a minimum of once every two (2)
weeks and replace burned out lamps or damaged sockets as may be required.
The reflector and lens should be cleaned each time a lamp is replaced.
2. Keep signal posts, controller pedestals, and foundations in alignment at
all times.
3. Keep signal posts and controller pedestals tight on foundation.
4. Keep signal heads and controller cabinets tight on their pedestals and
properly adjusted.
5. Keep detector equipment in proper working order at all times.
6. Check the controllers, relays, and detectors at least once every month to
ascertain that they are functioning properly and make all necessary repairs
and replacements.
7. Furnish and install temporary controller whenever necessary.
8. Keep interior of controller cabinets in a neat condition at all times.
9. Remove to clean and overhaul the controllers, relays, special auxiliary
control equipment, and time clock once a year or more often if necessary.
A record tag shall be attached to each controller on which the date of over-
haul or other service work shall be indicated.
10. Replace burned out fuses.
11. Clean reflectors, lenses, and lamps once every six (6) months.
12. Repaint all signal components exposed to weather at least once every two
(2) years.
13. Group relamp traffic signal heads at the expiration of the average rated
lamp life.
14. Repair or replace any and all equipment damaged by any cause whatsoever.
15. Be responsible to make recovery for damage to any part of the installation
or systems from the party causing the damage.
16. Place a stop sign on each approach to the intersection as a temporary means
of regulating traffic whenever repairs at a signalized intersection require
that the controller be disconnected.
17. Respond to emergency calls from authorized patties twenty-four (24)
hours a day, including Saturdays, Sundays, and holidays. Controller
failure, lights out, knockdowns, or two (2) red lights out at an
intersection are considered emergencies.
18. Provide the DEPARTMENT the name, address, and telephone number of at
least two oersons who will be available for.emergency repair of the
traffic signals and keep the DEPARTMENT informed of anv rhanaas nf aamo.
