C172318-03-0 WITH THE UNITED STATES ENVIORNMENTAL PROTECTION AGENCY NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois: Section 1. That the Village Manager is hereby authorized to sign the attached documents marked: U.S. Environmental Protection Agency EPA Assistance Agreement/Amendment a copy of which is attached hereto and made a part hereof as if fully set forth. GENERAL CONDITIONS - The recipient covenants and agrees that it will expeditiously initiate and timely complete the project work for which assistance has been awarded under this agreement, in accordance with all applicable provisions of 40 CFR Chapter 1, Subpart B. The recipient warrants, represents, and agrees that it, and its contractors, subcontractors, amp oyeas and representatives, will comply with: (1) all applicable provisions of 40 CFR Chapter 1, Subchapter B* INCLUDING BUT NOT LIMITED TO the provisions of Appendix A to 40 CFP Part 30, and (2) any special conditions set forth in this assistance agreement or any assistance amendment pursuant to 40 CFR 30.425. b. SPECIAL CONDITIONS: (For Step 3 Grant, Identification No. C17231ii 03-0 ) (For cooperative agreements include identification or summarization W EPA responsrbr�es t t m ect or contribute to substantial involvement.) *The principal "PARTS" of 40 CFR applicable to all "Wastewater Treatment Works" grants with their most recent promulgation dates are: -PART 30 "General Regulation for Assistance Programs," September 30, 1983, -PART 32 "Debarment and Suspension Under EPA Assistance Programs," August 17, 1982,, -PART 33 "Procurement Under Assistance Agreements," March 28, 1983, and -PART 35 "Grants for Construction of Treatment Works" (Subpart I), February 17, 1984. This Step 3 grant is subject to all applicable provisions of the codified regula- tions including grantee compliance with the following Special Conditions that emphasize portions of 40 CFR 35.2200 "Grant Conditions" of PART 35, Subpart I: That in accepting the subject grant offer, the grantee acknowledges its responsi- bilities as reflected in 40 CFR 35.2214 and agrees to: (A) manage the expeditious initiation and completion of the project pursuant to 40 CFR 35.2212 and 2216 in accordance with the "project schedule", which is hereby incorporated by reference (major events and dates are reflected on page 3A hereof); (B) promptly provide notice of accomplishment of "project schedule" events or delays of same including a complete explanation of reasons; (C) request and receive a formal amendment before implementing project changes covered by 40 CFR 35.2204(b)(1)-(5), and (D) maintain and operate the project for its design life to meet project performance standards. 2. That the grantee agrees pursuant to 40 CFR 35.2218 "Project performance," to: (A) provide written notice of the date of initiation of operation within 30 days of same; (B) select the engineer/engineering firm to provide services for one year after initiation of operation; (C) on the date one year after initiation of operation, certify the project is meeting project performance standards or if it is not, submit a corrective action report including an analysis of the cause and the schedule for implementation with a date for certifying the project is meeting said performance standards, and (D) except as provided in 40 CFR 35.2032(c) complete any needed corrective action at its own expense. 3. That the grantee agrees to request payments on a monthly basis and that such pay- ments shall be made pursuant to 40 CFR 35.2300 provided the grantee complies with all grant conditions. 4. That whenever during the subject grant budget period any subagreement involving Minority or Women Business Enterprise (MBE/WBE) is awarded, the grantee agrees to report such MBE/WBE involvement by submitting EPA Form 6005-1 to the award official through the State Agency no later than the fifteenth (15th) day of each January, April, July, and October after which such a subagreement is awarded. (Subagreement is defined at 40 CFR 33.005(b), as "a written agreement between an EPA recipient (grantee) and another party and any lower tier agreement for services, supplies or construction." Any change to the Agreement by the recipient subsequent to the document being signed by the EPA Award Official which the Award Official determines to materially alter the Agreement shall void the Agreement.
