HomeMy WebLinkAboutRESOLUTION - 1-82 - 1/12/1982 - LOC/REGENCY SQUARERESOLUTION NO. 1-82 A RESOLUTION ACCEPTING A BILL OF SALE, LETTER OF CREDIT NO. 6625 FROM THE LA SALLE NATIONAL BANK OF CHICAGO AND ACCEPTING FOR PERMANENT OWNERSHIP THE SIDEWALKS AND PARKWAY TREES IN REGENCY SQUARE PHASE 2a AND 2b AS SHOWN ON ENGINEERING PLANS OF R.B. NEUKRANS & ASSOCIATES, PROJECT NO. 8369 DATED 1971 AND ENGINEERING PLANS OF COWEY ASSOCIATES . PLAN NO. 155 DATED 1978 WHEREAS, the developer Regency Associates II, an Illinois limited partnership, Ben Rozansky and Robert Brodley (the sellers) have submitted a Bill of Sale and Letter of Credit in lieu of a Maintenance Bond in the amount of$3,750.00 expiring October 30, 1983 to the Village of Elk Grove Village as required by the Subdivision Control Ordinance and has fully complied with all provisions of any and all ordinances appertaining and; WHEREAS, the developer has completed sidewalk improvements and parkway trees as required by the Village. NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois: Section 1. That the Village President and Board of Trustees do hereby accept a Bill of Sale accepting for permanent ownership the sidewalks and parkway trees at the Regency Square Development(Phase 2a and 2b only) and shown on R. B. Neukranz & Associates, project No. 8369m dated July 1971 and the engineering plans prepared by Cowey Associates, plan No. 155 dated December 12, 1978, and a Letter of Credit from LaSalle National Bank No. 6625, in the amount of $3,750.00, guaranteeing said improvements to October 30, 1983, all as attached hereto and made a part hereof as if fully set forth. Section 2. That this resolution shall be in full force and effect -from and after its passage and approval according to law. PASSED this 12th day of January 1982. Zettek Ilage President BILL OF SALE THIS INDENTURE WITNESSETH: That Regency Associates II, an Illinois limited partnership, Ben Rozansky and Robert Brodley (the Sellers) in consideration of the sum of TEN Dollars and other consideration, bargain, sell and transfer and deliver unto the VILLAGE OF ELK GROVE, a municipal corp- oration (the Village) the following: The sidewalk improvements and trees listed and located on the engineering plans of R. B Neukranz & Associates, project # 8369, dated July 1971 and the engineering plans prepared by Cowey Associates, plan # 155 dated 12/26/78 entitled Regency Square [Phase 2a and 2b only] which plans are incorporated by reference and made a part hereof and in place all as pertaining to Phase II. TO HAVE AND TO HOLD all of the property hereby granted, bargained, sold, transferred, set over and conveyed unto the Village. AND the Sellers hereby covenant with the Village that they are the lawful owner of and have good and marketable title to said properties: that the Sellers have the right to sell the same as aforesaid; that they will warrant and defend said property against the lawful claims and demands of all persons.
