HomeMy WebLinkAboutRESOLUTION - 67-82 - 11/23/1982 - COMPLY WITH EPA REGULATIONS Pa- - 1 of 2 RESOLUTION NO. 67-82 Pis act Elk Grove Village C17 2318-03 RESOLUTION OF INTENT TO COMPLY WITH THE ENVIRONMENTAL PROTECTION AGENCY REGULATIONS FOR USER CHARGE, INDUSTRIAL COST RECOVERY, AND SEWER USE Whereas, regulations of the U. S. Environmental Protection Agency regarding grants for construction of sewage treatment works, 40 CFR 35 E, require that a user charge and industrial cost recovery system be adopted by the Village of Elk Grove Village therefore, be it resolved that: A) User Charge System: 1) the Village of Elk Grove Village hereby provides assurance t t has legal, institutional, managerial and financial capability to insure adequate construction, operation, and maintenance of treatment works throughout its jurisdiction. 2) the Village ofElk Grove Village hereby provides assurance Eh—at, prior to request for fifty percent (50%) payment of Step 3 grant, it will provide adequate evidence of timely development (for example, a draft user charge system) of a system of user charges to assure that each recipient of waste treatment services within the jurisdiction of the - Villaqe ofElk Grove Village will pay its proportionate share of the costs of operation and maintenance (including replacement of treatment works) provided by the Village — OfElk Grove Village and that, prior to request for eighty percent (80%) payment of Step 3 grant, it will provide the system of user charges for approval. 3) the vi I J�a� ofElk Grove Village hereby provides assurance that it will not utilize ad valorem taxes in the development of the user charge system. An industrial user is any non-governmental user of the treatment works provided through the grant project which is identified in the Standard Industrial Classi- fication Manual, 1972, Office of Management and Budget and the following Divisions: Division A - Agriculture, Forestry, and Fishing Division B - Mining Division D - Manufacturing Division E - Transportation, Communications, Electric, Gas, and Sanitary Services Division I - Services However, a user in the listed divisions may be excluded from the classification of industrial user (and, accordingly, may be excluded from the requirements of industrial cost recovery) if that user will introduce primarily segregated .domestic waste or wastes from sanitary conveniences. A significant industrial user is one that will contribute greater than 10 percent of the design flow or design pollutant loading of the treatment works. 23rd November 82 Resolved this day of 19 .
