A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT
AND VILLAGE CLERK TO EXECUTE AN AGREEMENT BETWEEN
THE VILLAGE OF ELK GROVE VILLAGE AND THE OWNERS
OF REAL PROPERTY LOCATED AT 1701 NICHOLAS/2201 LUNT
AVENUE, ELK GROVE VILLAGE. ILLINOIS
BE IT RESOLVED, by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and
DuPage, Illinois, as follows:
Section 1: That the Village President and Village Clerk
are hereby authorized to execute an Agreement by and between
the Village of Elk Grove Village and the Owners of real
property located at 1701 Nicholas/2201 Lunt Avenue, Elk
Grove Village, Illinois, a copy of which is attached hereto
and by this reference incorporated herein.
Section 2: That this Resolution shall be in full
force and effect from and after its passage and approval
according to law.

A G R E E M E N T
This Agreement dated the 10th day of February, 1981,
by and between the Village of Elk Grove Village, an Illinois
Municipal Corporation (hereinafter "Village") and the owners
of real property and buildings of property identified as
1701 Nicholas/2201 Lunt Avenue (hereinafter "Owners").
W I T N E S S E T H:
WHEREAS, the Village proposes to enter into a contract
for the cleaning of certain ditches located on the property
of Owners; and
WHEREAS, in order to accomplish same it is necessary
for the Village or its duly authorized agent to enter upon
the property of Owners; and
WHEREAS, the cleaning of said ditches will inure to
to the benefit of the Village and the Owners:
NOW, THEREFORE, in consideration of the mutual promises
and agreements hereinafter set forth, the sufficiency of which
are hereby acknowledged, and other good and valuable considera-
tion, the parties hereto agree as follows:
1). That the Owners shall and by this Agreement do
grant to the Village and its agents or contractors a temporary
license to enter upon the rear fifty (50') feet of owners'
property in order to clean the ditches located thereon, which
license shall expire on the 15th day of March, 1981.
2). The Village hereby agrees to indemnify the Owners
and by this Agreement shall hold the owners harmless from and
against any claim, damage or loss arising out of or resulting
from said cleaning project including any action or inaction by
the Village, its agents, contractors or subcontractors in
connection with the performance of work on this project. The

term Owners shall indicate the Owners of record, beneficial
Owners, and all lessees, tenants and assignees of said
Owners.
IN WITNESS WHEREOF, the parties hereto do set their
hands and seals this 10th day of February, 1981.
