A RESOLUTION OPPOSING THE REGULATION BY
ILLINOIS COMMERCE COMMISSION OF THE CON-
TINUING OPERATIONS OF 911 EMERGENCY COM-
MUNICATIONS CENTERS BY LOCAL AGENCIES OR
LOCAL PULLIC SAFETY AGENCIES
WHEREAS, the Illinois Commerce Commission has in the matter
of General Order 207, Standards of Service Applicable to 911
Emergency Systems adopted by resolution dated June 8, 1977 proposed
"Standards" to regulate the operation of 911 emergency answering
points; and
WHEREAS, said Standards of Service Applicable to 911 Emergency
Systems are proposed as mandatory rules binding on all public agencies,
and require a formal "Order of Authority to Operate a 911 System"
issued by the Illinois Commerce Commission; and
WHEREAS, the enabling legislation for these regulations
entitled "An Act In Relation To The Designation Of An Emergency
Telephone Number For Use Throughout The State" (Illinois Revised
Statutes, Chapter 134, Section 31 et seq) place the mandatory rules
regulating the continuing operation of 911 emergency communication
centers beyond the authority granted to the Illinois Commerce Com-
mission by such enabling legislation; and
WHEREAS, the Village President and Board of Trustees for the
Village of Elk Grove Village recognize the expertise of the Illinois
Commerce Commission in the field of telecommunications and their duty
to regulate telephone companies in the State of Illinois and the
responsibility of the Illinois Commerce Commission to oversee the
development of 911 emergency communication systems;
NOW, THEREFORE, the Village President and Board of Trustees for
the Village of Elk Grove Village goes on record in opposition to the
regulation by the Illinois Commerce Commission of the continuing oper-
ations of 911 emergency communication centers by local agencies or
local public safety agencies;
FURTHER, the Village President and Board of Trustees for the
Village of Elk Grove Village takes the strongest possible exception
to the principle that the ongoing operation of the emergency com-
munications center of a public safety agency should be placed under
the jurisdiction of the Illinois Commerce Commission to be regulated
as a public utility;
FURTHER, the Village President and Board of Trustees for the
Village of Elk Grove Village welcome the technical assistance of the
Illinois Commerce Commission for the further development and
improvement of its 911 emergency communication system and the
coordination of that system with others to be developed in the
immediate area.
