A RESOLUTION TO RESCIND RESOLUTION NO. 126-73 AND TO AUTHORIZE
REFUNDS OF EXCESS PAYMENTS IN PHASE I IN CONNECTION WITH A WATER
MAIN EXTENSION PROGRAM IN THE HIGGINS, OAKTON AND BUSSE ROAD AREAS
WHEREAS, the Village of Elk Grove Village adopted Resolution No. 126-73
on November 13, 1973, which established a plan to install and finance a
12 -inch water system to serve properties that would eventually be annexed
to the Village of Elk Grove Village; and
WHEREAS, Phase I of the three Phases plan was completed and Phases It
and III have not been started since the properties to be served have not been
annexed; and
WHEREAS, it is in the best interest of the Village to abandon the plan
and thereby leave the construction and financing of further water main exten-
sions to those who require said service.
NOW, THEREFORE, BE IT RESOLVED, by the President and Board of Trustees
of the Village of Elk Grove Village that:
Section 1. Resolution No. 126-73 is hereby rescinded and declared null
and void;
Section 2. The Director of Finance is hereby authorized and directed to
refund the following sums of money to the following parties who have made
previous payments under Phase I of the Water Main Extension Program which
funds will not be necessary under the revised plan:

Charles Frisbie Industrial Park
Slough Parks LTD. Industrial Park

Section 3. Property owners who are affected by this resolution are to
be notified by mail.
Section 4. That this resolution shall be in full force and effect from
and after its passage and approval according to law.
