A RESOLUTION AUTHORIZING TILE VILLAGE PRESIDENT AND TIME VILLAGE CLERK TO SIGN AN ANNEXATION AGREEMENT BETWEEN THE LA SALLE NATIONAL BANK UNDER TRUST AGREEMENT DATED JANUARY 26, 1973 AND KNOWN AS TRUST NO. 45667 (KIZMERLE PROPERTY) AND THE VILLAGE OF ELK GROVE VILLAGE NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois, as follows: Section 1: That the Village President and the Village Clerk are hereby authorized to sign an Annexation Agreement between the La Salle National Bank, not personally or individually, but as trustee under Trust Agreement dated January 26, 1973, and known as Trust No. 45667 and the Village of Elk Grove Village, a copy of which is attached hereto and made a part hereof as if fully set forth. Section 2: That this Resolution shall be in full force and effect from and after its passage and approval according to law. PASSED this 4th day of March , 1975. APPROVED this 4th day of Marrh 1975. VOTE: AYES 6 NAYS 0 ABSENT 0 7 APPROVE � ` 1� VILLAG ' RESIDENT ATTES'Tj: VILLAGE CLERK ANNEXATION AGREEMENT THIS AGREEMENT made and entered into this 2,1'—of 1975, by and between the VILLAGE OF ELK GROVE VILLAGE, a Municipal Corporation, Cook and DuPage Counties, Illinois, hereinafter referred to as "the Village" and LASALLE NATIONAL BANK, not personally or individually, but as Trustee under Trust Agreement dated January 26, 1973 and known as Trust No. 45667, hereinafter referred to as the "Owner". WHEREAS, the Owner is desirous and has petitioned to annex to the Village of Vlk Grove Village 7.23 acres, which property lies north on Lee Road and is contiguous to the Village and in all respects eligible for annexation to the Village; and, WHEREAS, said property has access to Lee Street by way of a 60 -foot easement, and there is no other ingress or egress to the property; and, WHEREAS, Owner contemplates the improvement of the property with a single building for office and/or industrial use and Owner does not presently desire to subdivide said property; and, WHEREAS, there is a sanitary sewer line and a water main in Lee Road; and, WHEREAS, the Village is amenable to granting the Owner's Annexation Petition and to permit said property to be improved by Owner with a single building for office and/or industrial use and to waive the requirement of a publicly dedicated right of way in this instance only. NOW, THEREFORE, for and in consideration of the mutual pro- mises and agreements herein contained, the parties agree as follows: 1. The Village does hereby agree to annex to said Village the territory described in Exhibit "A" upon the terms and condi- tions set forth in this Agreement. 2. The Village agrees to pass necessary ordinances to implement the annexation of said property to the Village and to zone the same I-1 Industrial. 3. The owner agrees to grant the Village any and all ease- ments which the Village deems necessary for fire and emergency service and for public utilities over and upon the premises described in Exhibits A and B referred to above upon request and prior to the issuance of any building permits. The owner does further agree to construct all necessary public utilities including fire hydrants to serve the premises described above as determined by the Village Engineer and agrees to donate same to the Village by Bill of Sale for the sum of $1.00 upon the request of the Village. 4. The Owner agrees, that should Owner at a subsequent time desire to subdivide the property into two or more parcels, Owner shall provide such publicly dedicated roads as are required by the Village and these ordinances. Owner acknowledges that if Owner fails to provide said dedicated roads that the property cannot, nor will not be, subdivided unless the parties mutually agree, and then only in accordance with a mutual agreement between them, if any be achieved. 5. The Village agrees to permit Owner to tie into the sani- tary sewer and the water main located in Lee Road upon payment of the applicable fees. 6. The Owner agrees to pay annexation fees and charges in the amount of $4,115.00, 20% at time of annexation and 20% of said amount annually thereafter on the anniversary of this Agreement until the full amount is paid, provided, however, that no building permit shall issue until the balance of said amount is fully paid. 7. EXHIBIT "B" PARCEL 2-- EASEMENT :EASEMENT FORINGRESS AND EGRESS FOR THE BENEFIT OF PARCEL 1 OVER THE FOLLOWING DESCRIBED LAND: That East 28.25 feet of Lot 58 and the West 31.75 feet of Lot 59 in Higgins Road Commercial Subdivision Unit 3, being a subdivision in the west z of section 22, township 41 north, range 11 east of the third principal meridian by easement agreement dated November 27, 1973 and recorded April 30, 1974 made by Malden Corporation, an Illinois Corporation and La Salle National Bank as trustee under Trust Agreement 45667 and Dominion Life Assurance Company, a canadian corporation as Document No. 22701327.
