HomeMy WebLinkAboutRESOLUTION - 64-75 - 8/26/1975 - DEED OF CONVEY/BILL OF SALE RESOLUTION NO. 64-75 A RESOLUTION ACCEPTING A DEED OF CONVEYANCE AND ACCEPTING FOR PERMANENT OWNERSHIP AND MAINTENANCE THE STREETS, CURB AND GUTTER, SIDEWALKS , STORM SEWER, SANITARY SEWER AND WATER MAINS INSTALLED IN ELK GROVE VILLAGE SECTION 16 AS SHOWN ON ELK GROVE ENGINEERING COMPANY PLAN NUMBER 4300-9 DATED AUGUST 17, 1967. WHEREAS, the Developer has submitted a Deed of Conveyance to the Village of Elk Grove Village as required by the Subdivision Control Ordinance and has fully complied with all provisions of any and all ordinances appertaining; and WHEREAS, the Developer has completed all repairs to public improvements as required by the Village, has made full payment of fees, and has submitted required As-Built- Engineering Plans; NOW, THEREFORE BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, -ounties of Cook and DuPage, Illinois: Section 1 : That the Village of Elk Grove Village does hereby accept a Deed of Conveyance for public improvements as shown on Elk Grove Engineering Plan Number 4300-9, dated August 17, 1967 otherwise described as Section 16: Chelmsford Lane from Arlington Heights Road west, thence south to a point approximately 150 feet north of Wellington Avenue; Ipswich Court in its entirety; Stonehaven Avenue from Chelmsford Lane north to Cosman Road; Walter Avenue from Stonehaven west approximately 110 feet; Cosman Road from a point approximately 110 feet west of Stonehaven Avenue east, thence south to Chelmsford Lane; Northampton Circle in its entirety; Brantwood Avenue from the east side of Chelmsford Lane east to Arlington Heights Road; Smethwick Lane from Brantwood Avenue south, thence west to Chelmsford Lane; Shelley Road from Chelmsford Lane east to Arlington Heights Road; Shelley Court in its entirety; Hastings Avenue in its entirety in Elk Grove Village. Section 2: That the Village of Elk Grove Village does hereby waive submission of a maintenance Bond (as required by Chapter 8 of the Municipal Code) because public improvements were substantially completed in 1971 . Section 3: That the Village of Elk Grove Village accepts a one (1) year guarantee by Centex Homes Corporation of driveway aprons replaced in Section 16 during the period of April 28 to June 13 , 1975 in accordance with a letter dated July 26, 1975. Section 4: This resolution shall be in full force and effect from and after its passage and approval according to law. PASSED this —26th day of August 1975. APPROVED this 26th day of August 1975. TO PAVE AND TO HOLD all of the property hereby granted, bargained, e 14 sold, transferred, set over, assigned, -,conveyed, quitclaimed and � livere, unto the Village, its successors and assigns, to and for it's own use forevar. AND the Company does hereby covenant with the Village that it is the .4 Sfe c lawful owner of said properties hereby granted, bargained, sol�, Iran t rr-- set over, assigned, conveyed, quitclaimed and delivered; that said property is free from all encumbrances; and that 'the Company has good right to sell the same as aforesaid. This conveyance is made by 'the Company pursuant to a resolution -�uly adopted by its Board of Directors.
