A RESOLUTION DIRECTED TO THE COUNTY CLERK TO ASSERT
HOME RULE STATUS AND TO INDICATE NO TAX RATE LI[iITATION.
WHEREAS , the Village of Elk Grove Village, did on the 26th day of
— August 1975 by Ordinance No. 1019 adopt its tax
levy; and
WHEREAS, the Village Clerk did file a copy of said tax Levy Ordi-
nance with the County Clerk; and
WHEREAS, said Ordinance did provide for an assertion of home rule
powers and provided that there should be no tax rate limitation as
to the tax levy provided in the Illinois Municipal Code; and
WHEREAS , the Village of Elk Grove Village did attain home rule
status by having a population in excess of 25, 000 people as of
October 3 1974 , which population figure is attested to by
a certificate of the Director of U. S. Census , a copy of which is
marked Exhibit A and attached hereto and made a part hereof.
NOW, THEREFORE, BE IT RESOLVED by the President and Board of
Trustees of the Village of Elk Grove Village, Cook and DuPage Coun-
ties, Illinois, as follows :
Section 1: That the Levy Ordinance adopted by the Village of Elk
Grove Village on the 26thday of August , 1975, Ordinance No. 1019
a copy of which has heretofore been filed :;y the Village Clerk with

the County Clerksof Cook Countyvwhich Ordinance contained a "Home Rule"
provision indicating it was adopted pursuant to the Illinois Municipal
Code providing, however, that any tax rate limitation •asto tax levies
in the Illinois Municipal Code in conflict with the ordinance shall not
be applicable to said ordinance since the Village of Elk Grove Village
is a "Home Rule" municipality, having a population in excess of 25, 000
and seeks to exercise all powers granted pursuant to Section 6, Article
VII, of the Constitution of the State of Illinois and particularly does
not choose to be bound by any tax limitations contained in the Illinois
Municipal Code and is re-asserted especially as to the "Home Rule"
provisions hereto referred to indicating that the municipality does not
choose to be bound by any tax limitations contained in the Municipal
Code.
Section 2 : This Resolution shall be filed by the Village Clerk
with the County Clerksas soon as possible after its enactment.
Section 3 : This Resolution shall be in full force and effect
from and after its passage and approval as provided by law.

Coluities, Illinois was 25,303 as of October 3 , 1974. The
population of Elk Grove Village by county is shown below.
