A RESOLUTION ACCEPTING A DEED OF CONVEYANCE, MAINTENANCE BOND AND ACCEPTING
FOR PERMANENT OWNERSHIP AND MAINTENANCE THE STREETS, CURB AND GUTTER, STORM
SEWER, SANITARY SEWER AND WATER MAINS INSTALLED IN ELK GROVE VILLAGE ON CARL
STREET AS SHOWN ON ELK GROVE ENGINEERING COMPANY PLAN NUMBER 6174-5 DATED
July 27, 1973, IN ELK GROVE INDUSTRIAL PARK.
WHEREAS, the Developer has submitted a Deed of Conveyance and Maintenance
Bond in the amount of $17,000.00 expiring on September 30, 1977, to the Village
of Elk Grove Village as required by the Subdivision Control Ordinance and has
fully complied with all provisions of any and all Ordinances appertaining; and
WHEREAS, the Developer has completed all repairs to public improvements as
required by the Village, has made full payment of fees, and has submitted required
As-Built- Engineering Plans;
NOW, THEREFORE BE IT RESOLVED by the President and Board of Trustees of the
Village of Elk Grove Village, Counties of Cook and DuPage, Illinois:
Section l : That the Village of Elk Grove Village does hereby accept a Deed of
Conveyance and Maintenance Bond for public imporvements as shown on Elk Grove Engine-
ering Plan Number 6174-5 dated July 27, 1973, otherwise described as Carl Street
from Mark Street to Thorndale Road.
Section 2: This resolution shall be in full force and effect from and after
its passage and approval according to law.

THIS INDENTURE WITNESSETH: THAT LA SALLE NATIONAL BANK,
a national banking association, not personally, but as Trustee
under the provisions of a Trust Agreement dated March 14 , 1909
and known as Trust No. 39270 (hereinafter sometimes referred to
as the "Trustee") , for and in- consideration of the sum of Ten
Dollars ($10. 00) and other good and valuable consideration in
hand paid, the receipt and sufficiency of which are hereby ac-
knowledged, does hereby grant , bargain, sell , transfer, set
over, assign, convey and deliver unto THE VILLAGE OF ELK GROVE
VILLAGE, Cook and DuPage Counties , Illinois , a municipal corpora-
tion (hereinafter sometimes referred to as the "Village") , the
following:
Water, Sanitary sewer and storm mains and drains
'^ and equipment as listed and located on engineering
plans prepared by Elk Grove Engineering Company
identified as Plan Number 6174-5 , Sheets 1 through
4 , dated September 22 , 1975 , otherwise described
in Elk Grove Industrial Park, Unit 9, which plans
are incorporated by reference and made a part
hereof and any additions thereto and improvements
thereon and easements for construction, reconstruc-
tion and maintenance as are necessary to operate
and maintain the aforesaid mains , drains and
equipment.
TO HAVE TO HOLD all of the property hereby granted, bar-
gained, sold , transferred , set over, assigned , conveyed and de-
livered unto the Village , its successors and assigns , to and for
itw own use forCVCr .
AND the Trustee does hereby covenant with the Village that
it is the lawful owner of and has good and marketable title to
said properties hereby granted , bargained, sold, transferred, set
over, assigned, conveyed and delivered ; that said property is free
from all encumbrances ; that the Trustee has good right to sell the

KNOW ALL MEN BY THESE PRESENTS: That we, Elk Grove Village Industrial Park,
Ltd. , as Principal, and Westchester Fire Insurance Company, of Morris County, New
Jersey, as Surety, are held and firmly bound unto the Village of Elk Grove Village,
Illinois, as Obligee, in the sum of Seventeen Thousand and No/100 Dollars ($17,000. 00)
lawful money of the United States, for the payment of which sum well and truly to be made,
we hereby bind ourselves, our successors and assigns, jointly and severally, firmly by
these presents.
WHEREAS, the Principal has entered into a contract for sanitary sewers, storm sewers,
watermains, street lights, pavement, curbs and gutters, sidewalks as indicated on
engineering drawings prepared by Elk Grove Engineering Company, 860 Lively Boulevard,
Elk Grove Village, Illinois, entitled Elk Grove Industrial Park, Carl Street, Elk Grove
Village, DuPage County, Illinois Drawings 1 through 4, dated 7-27-73.
NOW, THEREFORE, if the Principal shall repair any defects in said work occasioned by
and resulting from defects in materials furnished by, or workmanship of, the Principal
in performing the work covered by said contract, occurring within a period ending
September 30, 1977, then this obligation shall be null and void, otherwise to remain in
Rill force and effect

This Power of Attorney is granted pursuant to Article IV, Sections A and B of the By-Laws of the
WESTCHESTER FIRE INSURANCE COMPANY as amended on the 7th day of May, 1971, and now in full
force and effect.
ARTICLE IV.
Execution of Instruments
The Chairman of the Board, President, or any Vice-President, in conjunction with the Secretary, or any
Secretary, if more than one shall be appointed by the Board, or an Assistant Secretary, shall have power on
behalf of the Corporation:
(a) to execute, affix the corporate seal manually or by facsimile to, acknowledge, verify and deliver
any contracts, obligations, instruments and documents whatsoever in connection with its business including,
without limiting the foregoing, any bonds, guarantees, undertakings, recognizances, powers of attorney or
revocations of any powers of attorney, stipulations, policies of insurance, deeds, leases, mortgages, releases,
satisfactions and agency agreements;
(b) to appoint, in writing, one or more persons for any or all of the purposes mentioned in the preced-
ing paragraph(a),including affixing the seal of the Corporation.
This Power of Attorney is signed and sealed under and by the authority of Article III, Section 9 of the By-
Laws of the WESTCHESTER FIRE INSURANCE COMPANY as amended on the 7th day of May, 1971,and now
in full force and effect.
Article III, Section 9. Facsimile Signatures — The signature of any officer authorized by the Corporation to
sign any bonds, guarantees, undertakings, recognizances, stipulations, powers of attorney or revocations of
any powers of attorney and policies of insurance issued by the Corporation may be printed facsimile, litho-
graphed, or otherwise produced . . . . . The Corporation may continue to use for the purposes herein stated
the facsimile signature of any person or persons who shall have been such officer or officers of the Corpora-
tion, notwithstanding the fact that he may have ceased to be such at the time when such instruments shall be
issued.
