A RESOLUTION OF APPROVAL OF A LICENSE AGREEMENT WITH THE FOREST PRESERVE
DISTRICT OF COOK COUNTY
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage, State
of Illinois:
Section 1. That the Village President be and is hereby authorized to
sign the attached documents marked License agreement with the Forest Preserve
District of Cook County
a copy of which is attached hereto and made a part
hereof as if fully set forth and the Village Clerk is authorized to
attest said documents upon the signature of the Village President.
Section 2. That this resolution shall be in full force and effect
from and after its passage and approval according to law.

PROVISIONS
1. This license shall permit the afore..-,d Licensee to construct, operate and main, in the.facilities described herein and
is granted in consideration of the payment to the Forest i'r�serve District of fees or charges as determined by its )bard
of Commissioners or as stipulated by official ordinances. See below 1 A.
2. The plans and manner of execution or operation shall meet the approval of and be done to the satisfaction of the
General Superintendent of the Forest Preserve District or his authorized representative. Any or all of the aforesaid
facilities shall be maintained by the Licensee at his sole expense; also, said facilities, except when installed for a fixed,
period of time by terms of existing ordinance, or by the Board of Forest Preserve District Commissioners, are to be
relocated or removed by said Licensee at the sole cost and expense of said Licensee, upon not less than ninety (90) days
written notice to the Licensee at his last known address. Upon failure of the Licensee to properly maintain said facili-
ties, or failure to relocate or remove the same upon due notice as aforesaid, the Forest Preserve District shall have the
right to cause the same to be done, and it is understood and agreed the said Licensee shall reimburse the Forest
Preserve District for cost or expense of such maintenance, relocation or removal.
3. It is further agreed that no trees, shrubs, or forest growth shall be cut, trimmed or removed nor shall any building or
utilities of the Forest Preserve District be disturbed without the permission of the General Superintendent of the
District or his authorized representative.
4. It is further understood and agreed that the Forest Preserve District shall not be liable for any damage or injury to any
person or property arising from, growing out of or incident to the construction, operation, or maintenance of the afore-
said facilities for which the license is issued and the Licensee hereby agrees to indemnify and hold harmless the said
Forest Preserve District, its Commissioners, officers, agents and employees against any loss, claim, expense, damage
or claim from damages on account of any injury to persons or property, whether that of the District or otherwise,
which may be occasioned by or result from the issuance of this license. -
5. All Licensees herein other than (1) Public Utility Companies, (2) the City of Chicago, (3) the State of Illinois, (4) the
Federal Government, (5) the County of Cook, Illinois, (6) the Sanitary District of Chicago, or (7) a Department of the
foregoing, shall, in accordance with Section 26 of the Forest Preserve District Ordinance, deposit a Certified or a
Cashier's Check drawn to the order of the said District in the amount of

and also shall furnish the Forest Preserve District with a CERTIFICATE OF INSURANCE prepared by said Licensee's
Public Liability and Property Damage insurance carrier, satisfactory to said District.In the event the INSURANCE is
deemed unsatisfactory by said District, the said Licensee shall upon request furnish the District with a SURETY BOND
in accordance with Section 28 of the Forest Preserve District Ordinance in the amount of

6. It is further understood that if the Licensee herein elects to construct, operate, or maintain the aforesaid facilities
through the services of an independent contractor, then the Licensee shall require the said independent contractor to
deposit with the Forest Preserve District a Certified or Cashier's Check all as hereinbefore outlined under Provision
(5) in the amount o1

CERTIFICATE OF INSURANCE or a SURETY BOND as hereinbefore outlined in Provision Five (5) in the amount of

The Licensee' s Independent Contractor shall furnish the District with a certificate
of insurance or policy naming the Forest Preserve District of Cook County as insured
or additional insured with amounts of not less than $400,000 for public liability
and $20,000 for property damage, and give thq District ten (10) days written notice
before changing or cancelling the policy.
1A. The Licensee shall furnish coater service gratis to the Forest Preserve District at
640 Cosman Road, Elk Grove Village. Also fire and ambulance service shall be
furnished gratis by the Licensee at 640 Cosman Road, Elk Grove, Illinois.
The quantity of water used gratis shall not exceed 200,000 gals. per year.

SPECIAL PROVISIONS
10. TREE REMOVAL AND PROTECTION:
If any tree trimming takes place, it shall be done in the standard method for such
work. Only trees designated by the Forest Preserve District shall be removed. All
trees removed shall be cut flush with the existing ground and painted with Ammate.
11. CONSTRUCTION:
All constriction operations, movement of equipment and storage of equipment and
materials shall be confined to the width required for construction as directed
by the District. All surplus excavated materials shall be disposed of off the
District's property, All trees, stumps, and other debris resulting from const-
ruction operations shall be disposed of off the District's property. Temporary
fencing consisting of standard snow fencing material or three strands of wire
shall be erected on steel or wood posts as indicated on the plans marked(Exhibit
"A").
All manhole covers shall be equipped with locking devices and the top of the man-
hole shall be flush with existing ground. Signs, barricades, lights, etc., shall
be erected to indicate construction operation.
Immediately after construction operations have been completed, all areas disturbed
by construction operations shall be graded as nearly as possible to their orig-
inal contours, the trenches shall be mechanically completed to eliminate settlement.
Underground utility facilities to be crossed or paralleled shall be located by
the owner of the facilities upon the request of the Contractor. Contractor shall
notify owner 24 hours prior to construction. Contractor, at his expense, shall
expose by hand any underground facility to be crossed before any machinery is used.
12. RESTORATION: All areas disturbed by construction operations shall be topdressed
after final settlement with topsoil to a depth of four (4) inches cultivated, fine
graded, and seeded with approved grass seed at a rate of 175 pounds per acre, and
mulched with 1" straw or stable bedding, as directed by the District.
The Contractor shall furnish approved topsoil to insure a four (4) inch coverage
over the area to be seeded. The seed is to be mixed in the following proportions:
40 lbs. Kentucky Blue Grass
40 lbs. Alta Fescue Grass
20 lbs., Perennial Rye. Grass
All trees and shrubs removed. shall•,,be: replaced in kind:as-directed by the District.
All slopes steeper than 4 to 1 shall be sodded and pegged with nursery grown sod.
All ditches shall be restored back to their original contours.
13. The Licensee or its independent contractor shall retain a landscape contractor,
approved by the District to perform all fine grading, seeding work and mulching,
at no cost to the District as required in provision No. 12 of the license, and
as directed by the Forest Preserve District. The seeding work and planting work
shall be done under the supervision of the Forest Preserve District in the proper
season for such work. This item shall be included in the Licensee specifications
as a separate contract.

14. All notations as indicated on the plan marked Exhibit "A", are part of this
License.
15. It is understood and agreed that Licensee shall be responsible for any and all
assessments caused by Licensee's use of :the :property described;he,rein.
16. The Forest Preserve District reserves the right to connect to the watermain in
the future at no cost to the District for connection.
