TO THE BUSSE ROAD IMPROVEMENT PROJECT, SOUTH OF DEVON AVENUE

of the Village of Elk Grove Village, Counties of Cook and DuPage, State
of Illinois:
Section 1. That the Village President be and is hereby authorized to
sign the attached documents marked Letter of Understanding for the Illinois
Route 83 (Busse Road) project, from Devon Avenue to Woodland Avenue in DuPage
County. , a copy of ehich is attached hereto and made a part
hereof as if fully set forth and the Village Clerk is authorized to
attest said documents upon the signature of the Village President.
Section 2. That this resolution shall be in full force and effect
from and after its passage and approval according to law.

Dear Mr. Zettek:
This letter is to serve as a letter of understanding, in order
that we might have a written record of our mutual understanding as to
the scope of this improvement. If you are in agreement, please affix
your signature on this letter in the place provided and return the
original to this office. The carbon copy is for your files.
This improvement will consist of reconstructing approximately
18,480 (3.5 miles) lineal feet of Illinois Route 83 (F.A. Route 102,
Section (540-1) R&T, between Woodland Avenue, on the south (northern
limits of F.A.I. Route )0 interchange complex), and Devon Avenue
intersection on the north, wicianing the roadbed from its present typical
pavement width of 22 feet, to a width of ;4 feet, and variable edge to
edge of pavement (providing for six (6) twelve -foot traffic lanes, a
22 -foot wide and variable barrier median and combination concrete curb
and gutter), channalizing and signalizing tiha intersections of Illinois
Route 83 aith Third i�venu::, Grove Aveaue-. u;horaood Drive, 3illside Drive,
and Foster F_venue; ccastructing highway chrainage facilities and all
appurtenances relatad thereto; modernizing and relocating the traffic
control signals at the intersection of Illinois Route 83 and Thornuale

1. It is understood and agreed that tnc STATE will make

2. It is understood and agreed that upon completion of
the improvement and so .Long as the route is used as
a State Highway, tae ST,aTE will maintain or cause to
be maintained the median, the 6 through traffic lanes lying
3 on either side of the median, and the left -turn and
right -turn lanes being 12 feet and variable in width,
the curb and gutters ac_Sacent to these traffic lanes,
drainage facilities, and all related appurtenances lying
within the Illinois Route 83 right-of-way, except
municipal improvement.
3. It is understood and agreed that the VILLAGE has adopted
and put into effect an ordinance requiring that parking
be prohibited within the limits of this improvement, a
copy of which is attached hereto as "Exhibit A", and will
in the future prohibit parking at such locations on or
immediately adjacent to this improvement as may be de-
termined to lie necessary by the STATE from traffic
capacity studies.
4. It is understood and agreed that the VILLAGE has adopted
and will put- into effect, prior to the STATE'S advertising
for the work to be perform-&, an appropriate ordinance
prohibiting the cischarge of sanitary sewage and industrial
waste water into any sto;_,n sewers constructed as a Part of
this improv4.aent, a copy of which is attached hereto as
"Exhibit L".
5. It is understood and agreed that the plans for this
improvement have been examined and were found to be
acceptable to the VILI.FG:.
6. It is understood and agreed that the VILLAGE will not
permit driveway entrances to be connected to Illinois
Route 83 as constructed, without the consent of the STATE.
7. It is understood and agreed that the STATL shall cause
private and municipally owned utilities to be relocated at
no expense to the VILLAGE.
8. It is understood and agreed that upon completion of the
improvement, the VILLAGrI will maintain or cause to be
maintained witiiin the VILLAGE limits, those improvements,
constructed, or caused to be constructed by the VILLAGE
within the Illinois Route 83 right-of-way, including all
curbs and gutters not maintained by the STATE, sidewalks,
manholes, catch basins, storm sewers, utilities and
appurtenances.
9. It is understood and agreed that prior to the STATE
advertising for the wort to be performed hereunder, the
disposition of encroachments will be cooperatively de-
teziai.ned with representatives from the VILLAGr, the 6,xATL,
and the Feueral i ighway C,admi.nistration.
The VILLAGE has adcpteU and will put into effect, prior to the
STATE'S advertising for the work to ue performad herc_nder, an appro-
priate ordinance relative to the disposition of encroachments and
prohibiting, in the future, any :new encroachments within the limits of
the improvement, a cony of which is attachea as "Exhibit C".

AN ORDINANCE PROHIBITING PARKING ON BUSSE ROAD IN THE VILLAGE
OF ELK GROVE VILLAGE
NOW THEREFORE, BE IT' ORDAINED by the President and Board
of Trustees of the Village of Elk Grove Village, Counties of
Cook and DuPage, Illinois:
Section 1: That Section 14.512 of the Municipal Code of
Elk Grove Village, the introduction of which reads as follows:
14.512 Additional no parking streets and areas.) It shall
be unlawful for any person, firm or corporation to permit any
vehicle to stand in any of the following places, except when
necessary to avoid conflict with other traffic, in compliance
with police direction, or to discharge passengers. Said places
in which parking is prohibited are as follows:

VILLAGE OF BELK GROVE, ILLINOIS
An ordinance pro Laitiag t:he connection of sanitary or
industrial waste sewers to storm water drainage system.
BE IT ORDAINED by the Board of Trustees of the VILLAGE of
Elk Grove, Illinois;
Section 1: It shall be unlawful for any person, firm, or
corporation to connect or cause to be connected, any drain carry-
ing, or to carry, any toilet, sink, basement, septic tank, cess-
pool, industrial waste, or any fixture or device discharging
polluting substances, to any storm drain or sewer constructed
relative to the improvement of Kinaery Highway (F.A. Route 102,
Illinois Route 83), State Section (540-1)R, or to any storm drainage
or storm sewer line constructed within the corporate linuts of the
Village of Elk Grove Village.
Section 2: Any person, firm, or corporation violating this
ordinance shall be fined not less than One hundred Dollars ($lU0.00)
nor more tLan Five iunured Dollars ($500.00) for each offense,
and a separate offense shall be deemed committed for each and every
day during which a violation continues or exists.
Section 3: This ordinance shall be in full force and effect from
and after its passage, approval and publication, according to law.

AN ORDINANCE REGULAJ ING LNCROACIIrIENT
ON PUBLIC RIGHT OF WAY l:N THE V ILLAGI. OF ELK GROVE
DUPAGE COUNTY, ILLINOIS
WHEREAS, the village of Elk Grove hereinafter known as the
VILLFsGE, and the State of Illinois, acting by and through its
Departcaent of Transportation, have entered into an agyeement
relative to the improvement of Illinois Route 83, (r.A. Route 102)
Section (540-1) R&T, from Woodland Avenue to Devon Avenue; and
WHEREAS, in order to facilitate saiu improvement, it is
necessary for the VILL�,GL to auopt an ordinance regulating encroaca-
ments on the right of way for said improveiaent in accordance with
the following definition:
Road,ay night of 'Way is defined as t iose areas existing
or acquired by dedication or by fee simple for highway
purposes; also, the areas acquired by temporary ease-
ment during the time the easement is in effect;
Project Rint_of TdY is defined as these areas within the
project right-of-way lines esta6iished jointly by the
VILLAGE, STATE and the Federal Highway AGYiii ilia ration,
which will be free of encroachments, as hereinafter
defineu;
Encroaciimant is defined as any building, fences, sign or
any other structure or object of any kind (with the
exception of utilities and pu;.)lic road signs), which is
placed, located or maintained, in, on, under or over
any portion of the project right of way or the roadway
rig:it of way where no projact rijht of way line has been
established.
Construction astTMmant area is defined as the area lying
betwcon the project right-of-e,ay limits and the platted
street lir.its within the VILLRCZ, by concurrence in the
establishment of the project rigrrt-of-way lines, will
permit the STAT:: to enter to perform all necessary con-
struction operations; and,
WHEREAS, representativos of the VIL?,"G , the S'TRfE, and the
Federal Highi,ay «:]ministration will, ay visual inspection,
cooperatively establish project right-of-way lines and mutually
determine the disyosition of encroacuments;
NOW, THEREFORE, BE IT ORDAINLD, by the Village of Elie Grove,
DuPage CotLity, Illinois:
Section 1: It shall be unlawful for any person, firm or
corporation to erect or cause to be erected, to retain or cause

the limits of the project right-of-way or roadway right-of-way
where no project right of way Lines have ba -en. established.

addition to all other ordinances, rules anu regulations concerning
