HomeMy WebLinkAboutRESOLUTION - 80-69 - 7/15/1969 - MUTUAL AID AGRMT/POLICE DEPT ' RESOLUTION No. 80-69 WHEREAS Member Municipalities are so located in relation to each other that it is to the advantage of each such participant to extend aid to the others in respect to police services, and WIIEREAS, it is recognized that in certain situations the use of police officers to perform police duties outside of the territorial limits of the municipality where such officers are legally employed may be desirable and necessary in order to preserve and protect the health, safety and welfare and morals of the public, and WHEREAS participants herein deem mutual aid police services to be in the best interest of the municipality, NOW THEREFORE. IT IS MUTUALLY AGREED betwoen the parties as follows: 1. Authorization. Fach member municipality does hereby authorize and direct its police chief or the officer commanding in his absence to render and request mutual police aid to and from other member municipalities to the extent of available personnel and equipment not required for adequate protection of the municipality rendering aid. The judgment of the police chief or officer commanding in his absence, of each municipality rendering aid, as to the amount of personnel and ego.ipment available, shall be final. 2. Power and Authority Police officers who shall be commanded by their superior authority to maintain the peace cr perforin police duties outside the territorial limits of the city or village which regularly employs such officers, shall be under the direction and authority of one person designated by all police chiefs of participating municipalities , such person shall in turn be under the direction and authority of the local commanding police officer of the municipality to which they are called to perform police or peace duties, and shall be peace officers thereof; they shall have all powers and authority of police and peace officers as provided by law, including the power of arrest. 3. Compensation_ Mutual aid police service shall be rendered without charge to a member municipality; provided, however, that as a result of having furnished aid, should the assisting municipality be required to seek assistance from another nonmember municipality, which imposes a charge for same, then in that event, the municipality origin- ally seeking such aid shall reimbuse the assisting municipality in the amount equal to the charge imposed upon the assisting municipality by the municipality assisting it. 4. Liability All wage and disability payments, pension and workman's compensation claims, damage to equipment and clothing, and medical expense shall be paid by the City or Village regularly employing such police officer. In addition to the foregoing, each City or. Village regularly employing such police officer shall be liable to its police officer pursuant to the provisions of Section 1-4-6 of the Illinois Municipal Code. 5. Waiver. Every participant herein waives as to each and every other participant hereto, any and all claims against the other participant for compensation for any loss, damage, personal. injury or death, that shall arise in consequence of the performance under this Agreement. No participant hereto shall., under any circumstances, be held liable for any lose or damage by reason of its failure to effectively combat or handle any police problem in the territory of the other party. 6. Rules and Regulations The police chiefs of the member municipalities shall establish uniform rules and regulations for giving and receiving aid, which shall be subject to the approval of each governing body. A copy thereof shall be filed with the clerk of each member municipality. The rules and regulations may be revised and amended from time to time by the police chiefs upon their unanimous agreement, subject to the approval of each governing body, and a copy of each revision or amendment shall be filed with the clerk of each member municipality. Effective Date of Agreement The clerk of each member municipality shall furnish a certified copy of its resolution approv- ing mutual avid police service to each of the member municipalities. Each resolution shall become effective as and between municipalities who exchange identical resolutions upon the date of such exchange. The adoption and filing of the resolutions shall constitute an agree- ment between all member municipalities for mutual aid-police service. 8. Termination. The agreement evidenced by the filing of certified copies of resolutions with the clerk of each municipality shall remain in full force and effect until such time as a munici- pality files with other member municipall.ties a certified copy of a resolution terminating this ag:ceement, which date of termination shall not be less than thirty (30) days after the date of filing a certified copy of such resolution with the clerk of each member municipality.
