On February 2, 1959, a petition for a referendum vote was filed
with the Village Clerk of the Village of Elk Grove Village requesting
that the proposition for the adoption of the provisions of Chapter 24,
Article 14, Illinois Revised Statutes 1957, entitled "Optional Fire
and Police Commissioners" submitted to the voters of Elk Grove Villa ;e
at the next regular election to be held on April 21, 1959.
On April 21, 1958, said proposition was submitted to their
electorate and a total of 839 votes were cast on the proposition with
the following results:

Defective Ballots 18
On May 11, 1959, Elk Grove Village Ordinance No. 99, confirming
the election, was adopted by unanimous vote by the Village Trustees and
was signed into law by the Village President.
The Commission is composed of three (3) Commissioners appointed
by the Village President with the consent of the Village Board of
Trustees. The term of office is three (3) years or until the Commissioners'
respective successors are appointed and have qualified, except that one
member of the first board was appointed to serve until the end of the
then current Municipal year, another to serve until the end of the
Municipal year next ensuing and a third to serve until the end of the
Municipal year second ensuing.

The powers and duties of the Commission are concerned with the
enactment and administration of the? rules relative to the appointment,
promotion, suspension, reinstatement or dismissal of all officers of the
Fire and Police Department of the Village of Elk Grove Village exce?t
the respective chiefs of the Police. and Fire Department whose appointments
or removals have expressly been reserved by the Board of Trustees.
RULES AND REGULATIONS OF THE BOARD OF FIRE AND POLICE COMMISSIONERS
OF THE VILLAGE OF ELK GROVE VILLAGE, STATE OF ILLINOIS
As adopted by the Board of Fire and Police Commissioners of the
Village of Elk Grove Village, Illinois, effective May 11, 1959, as
amended March 21, 1966.
CHAPTER I ---- ADMINISTRATION
Section 1 -- SOURCE OF AUTHORITY
The Board of Fire and Police Commissioners of the Village of Elk
Grove Village derives its power and authority from an act of the General
Assembly entitled "Division 2, Board of Fire & Police Commissioners" of
Chapter 24 of the Illinois Revised Statutes.
Section 2 -- DEFINITIONS
The word "Commission" and/or "Board" wherever used shall mean the
Board of Fire and Police Commissioners of the Village of Elk Grove
Village. The word "Officer" shall mean any person holding a permanent
office in the Police or Fire Department of Elk Grove Village. The
masculine noun or pronoun includes the feminine. The singular includes
the plural and the plural the singular.
Section 3 -- OFFICERS OF BOARD AND THEIR DUTIES
The Board shall elect annually on the first Thursday of May of each
year a Chairman, Secretary and Comptroller who shall hold their offices
for one year or until their successors are duly elected and qualified.
The Chairman shall be the presiding officer at all meetings and at all
hearings before the Board and shall attend to all duties ordinarily per-
taining to his office. The Secretary shall keep a record of the pro-
cedings of the Commission in a book kept for that purpose and is to be

custodian of all papers pertaining to the business of the Commission
and the Seal of the Commission. The Comptroller shall be the purchasing
agent and keep a record of all expenditures made by the Commission. All
of the officers shall perform any other duties as the Board may from
time to time prescribe.
Section 4 -- MEETINGS
(a) Regular meetings shall be held on the first Thursday of each
month at 8:00 P,M, at the Village Hall.
(b) Special meetings may be called by the filing of a notice in
writing with the Secretary of the Board signed by any two members. This
notice shall contain a brief statement of the business to be submitted
for the consideration of the Board as such special meetings and shall set
forth a time and place of such special meeting and no other business shall
be considered at such special meeting.
(c) Special meetings may also be called by the Chairman of the
Board and he shall designate in a notice to be filed with the Secreta --y
of the Board the time and place of the special meeting and the business
to be considered at such special meeting, and no other business shall
be considered at such special meeting.
(d) Notice of special meetings shall be given orally or in writing
at least 24 hours in advance of the meeting. Such notice may be waived
in writing,
Section 5 -- QITCRUM
Two members of the Board shall constitute a quorum for the conduct
of business other than conducting a hearing.

Section 6 -- ORDER OF BUSINESS
The order of business at any meeting shall be:
1. Reading of the Minutes
2. Communications
3. Unfinished Business
4. New 3usiness
5. Adjoarnment
Section 7 -- The Parliamentary procedure prescribed in Roberts Rules
of Order shall be followed as far as applicable.
Section B -- Amendments to the rules of the Board may be made at any
meeting of the Board. All amendments shall forthwith be printed for
distribution and notice shall be given of the place or places where
said rules may be obtained. Such notice shall be published in a news-
paper of general circulation in the Village. The notice shall specify
the date, not less than ten days subsequent to the date of such publi-
cation, when said rules shall go into operation.
Section 9 -- ANNUAL REPORT OF BUDGET REQUEST
The Board shall submit an annual report of its activities as
required by Section 10-2, 1-19 of the act, and a budget request for the
ensuing year, on or before the close of each fiscal Municipal year.
CHAPTER II ---- APPLICATIONS
Section 1 -- RESIDENCE
Applicants must be citizens of the United States and agree in
writing to reside before the expiration of their probationary period
within a distance of ten miles of any boundary of Elk Grove Village.
Residents of Elk Grove Village will receive a five -point preference,
other qualifications and examination grades being equal.

Section 2 -- APPLICATION BLANKS
The Commission shall furnish application blanks for positions on the
Fire and Police Departments. The applications shall be supported br
three (3) certificates of good character signed by persons acgiiainted
with the applicant. Application blanks may be obtained from any member
of the Commission at the Village Hall or from the Chief bf the Department
for which they are applying.
The certificates of good character shall be signed by reputable
citizens who do not hold any elective or appointive positions in the
Village, town, county, state or federal government. Persons signing
the character certificates shall know the applicant for at least three (3)
years and shall state that it is their belief that the applicant is of
good moral character, of correct and orderly deportment, and that in
their opinion the applicant is qualified for the position he seeks,
and that such citizen is willing that the certificate signed by him be
made public.
Section 3 -- FILING APPLICATIONS
Applications for the Fire and Police Department shall be addressed
to the Commission and filed with the Secretary. The Secretary shall
endorse thereon the date and hour the application was received, which
time shall determine the priority of filing. All applications shall be
filled out in the handwriting of the applicant and shall be signed and
sworn to before an officer authorized by law to take acknowledgements.
Persons making untruthful answers to questions in said application shall
be rejected by the Board and the applicant notified of such action.

Any applicant for the Fire or Police Departments of the Village of
Elk Grove Village who makes false statements of material facts in his
application and is subsequently appointed to either department, shall
be subject to removal from office in the manner prescribed by statute.
Section 4 -- DISQUALIFICATION
The Commission may refuse to examine an applicant or after examin-
ation to certify him as eligible:
a. who is found lacking in any of the established preliminary
requirements for the service for which he applies.
b. who is physically unable to perform the duties of the position
to which he seeks appointment.
c. who is addicted to the habitual use of narcotics or intoxica"in;
beverages.
d. who has been convicted of a felony or any misdemeanor involving
moral turpitude.
e. who has been dismissed from any public service for a good cause.
f. who has attempted to practice any deception or fraud in his
application.
g. who may be found disqualified in personal qualifications or
health.
h. whose character and employment references are unsatisfactory.
1ny applicant, or eligible, deemed disqualified hereunder shall be
notified by the Commission.
Section 5 -- DEFECTIVE APPLICATIONS
Defective applications shall be returned to the applicant for

correction, provided the applicant is qualified for the position he see'ss,

If the application or examination for a position requires special
qualificationd, the Commission may require evidence of special training
or practical experience,
Section 7 -- PHYSICAL AND MEDICAL kXAMINATICN S
Applicants for criginai appointment shall be re4uired to submit to a
physical and medical examination by a licensed physician appointed by the
Board of Fire and Police Commissioners of the Village of Elk Grove
Village.
Section 8 -- PHYSICAL REQUIREMENTS
Applicants for the position of fireman or patrolman must have the
physical requirements to conform to the following table:

Applicants must have at least 20-30 vision in each eye without glasse;
Section 9 -- AGE REQUIREMENT
Age: At the time of last date for filing application for the
positions in the Fire Department and Police Department, individuals must
have passed their 21st birthday, but must not have passed their 34th
birthday except as otherwise provided by statute. Proof of birthdate will

be required before appointment.
Section 10 -- EDUCATICNAL REQUIREMENTS
Each applicant must possess a high school education, or equivalent,
to be determined solely by the Commission, and give documentary proof of
his completion of such formal training.
Section 11 -- FINGERPRINT_CRECK
Each eligible applicant must submit to fingerprinting by the Police
Department, and said fingerprints shall be submitted to the appropriate
authorities.
Sedtion 12 -- NOTICE OF ACCEPTANCE
The Secretary will notify all applicants whose applications have
been accepted by the Board to present themselves for examination, with
an executed physician's certificate that they are physically capable of
participating in a strenuous "physical agility test".
Section 13 -- RELEASE OF LIABILITY
All applicants shall execute and deliver to the Board a release of
all liability as a result of taking a "physical agility test" in favor
of the Village of Elk Grove Village on a form to be prescribed by the Board.
CHAPTER III ---- EXAMINATI CIS
ORIGINAL APPOINTMENTS
Section 1 -- NOTICE OF EXAMINATIONS
Examinations shall be held on the dates fixed by the Commission and
advertised in a local paper in accordance with the statutes of the State
of Illinois. Notice of promotional examinations may be waived in
accordance with statute. Examinations may be postponed, however, by order

of the Commission, which order shall state the reason for such postponement
and shall designate a new date for said examination. Applicants shall be
notified of the postponement of any examination and of the date fixed for
said examination.
Section 2 VACANCIES
The Commission shall call examinations to fill vacancies in the class
of service; or to provide eligible lists for the service, in which
vacancies are liable to occur. A dall for such examination shall be
entered in the minutes of the Commission and shall include a statement of;
(a) the time and place where such an examination will be held.
(b) applications will be received for a two—week period, which
shall terminate 24 hours 'before the examination.
(c) the position to be filled from the resulting eligibility list.
Section 3 -- TYPE OF EXAMINATIONS
The subject matter for written and oral examinations shall be such
as will fairly test the capacity of the applicant to discharge the duties
of the position to which the applicant seeks appointment. No examination
shall contain questions regarding applicant's political or religious
opinions or affiliations.
Section 4 .SEQUENCE CF EXAMINATIONS
Failure to achieve the minimum passing grade in any examination
disqualifies the applicant from any further participation. All grades
are based on a maximum of 100;x, plus military credits.

B. ORIGINAL APPOINTMENT:) - PHYSICAL AGILITY TEST
1. All applicants shall submit themselves to a Physical Agility
test to be conducted by such physical director as the Board may direct.
2. The Physical Agility test shall be designed to test the
applicant's muscular coordination and reflexes.
C. ORIGINAL APPOINTMENTS - WRITTEN EXAMINATIONS
1. Eligibility
Only candidates who have had applications approved will be
permitted to participate in the written examination.
2. Nature of Examination
The material used in this examination shall be of such a nature
that it will adequately outline the candidates mental ability to assimi-
late training as a fireman or patrolman. It may be classified as a
general "IQ", "mental ability", and "mechanical aptitude" examination.
3. Test Procedure
Each candidate will be assigned a number, then he will be given
an identification slip on which he will write his number, his name
and his address. These identification slips will be picked up by one of
the members of the Commission giving the examination, and sealed in an
envelope.

At the conclusion of the examination each applicant will deliver
his examination papers to the Secretary or one of the members of the
Commission. No signature will be placed upon the examination papers,
except for the applicant's identification number. No marks of identifi-
cation tending to disclose the identity of the competitors shall be
placed upon the examination papers. Papers of persons violating this
rule shall be marked "rejected upon order of the Commission". At the
next meeting of the Commission, examination papers will be graded,
Candidates who fail to achieve a mark of 70% will be notified.
4. Finality
All examination papers shall become the property of the Board
and the rating thereof by the Board shall be final and conclusive and not
subject to review by any other Board or tribunal of any kind or descriltior,
D. CRIGINAL APPOINTMENTS, ORAL E%AMINATICNS CR INTERVIEW
1. Attendance of Board Members
All Commissioners shall participate in the oral examination
except wherein one Commissioner due to illness, or when matters of an
emergency nature, preclude his attendance. In no event shall less than
two (2) Commissioners conduct the oral examination.
2. Subjects of Examination
Questions shall be asked of the candidate that will enable the
Commissioners to properly evaluate end grade the candidate on voice and
speech, appearance, alertness, ability to present ideas, judgment,
emotional stability, self-confidence, friendliness and personal fitness
for the position.

3. Grading of Examination
On completion of each Oral Interview, the Commissioners will
discuss the candidates ability, using the traits listed in No. 2. Each
Commissioner will then grade the candidate on a percentage basis. The
applicant's final grade will be the average of the three or two
Commissionerst grades. Candidates failing to secure a minimum grade of
70% are automatically eliminated from all further consideration.
4. All candidates who have successfully passed the credit, moral,
physical agility written and oral examinations conducted for the position
of either fireman or patrolman and who would otherwise be eligible to
have their names posted on an "Eligible Register", shall furnish to the
Commissioners a certified copy of their Birth certificate and when re-
quired a certified copy of their Armed Service Record and Honorable
Discharge.
5. Eligible Register
The Commissioners will prepare, post and keep an "Eligible
Register" of the candidates successfully passing all examinations.
Candidates will take rank upon the "Eligible Register" in the order of
the relative excellence as determined by examination without reference
to priority of time of examination. A minimum grade of 70% is required
for listing on the "Eligible Register". This "Eligible Register" will
remain in force for two (2) years from the date of posting as to original
applicants. All vacancies to the Fire or Police Departments shall be
filled with the candidate heading the: list as to original appointments.

9. Probation
Original appointments shall be on probation for a period of
twelve months. In no case shall a probationer be discharged until after
the head of the department has received from the Board, a notice in
writing that the Board has approved such discharge.
Time served on probation shall be credited upon the period of
seniority.
During the probationary period the appointee's work shall be
evaluated and rated monthly by his commanding officer. During the first
eleven months of this period, the appointee may be dismissed, without
recourse, by the Board. From fifteen to thirty days prior to the end of
the probationary period, the chief of the department concerned shall
make a written recommendation to the Board for the dismissal or retention
of the appointee accompanied by ratings and comments to support such
recommendation. The Board's action on such recommendation shall be
final in all cases. The appointee, having served one year and being
approved for retention, shall be considered as having obtained a regular
appointment, subject to the rules and regulations of the department
concerned and the rules of this Board relating to promotion, suspension
or dismissal, providing he passes any further medical examinations which
may be required by the Board.
E. PRGMOTIONAL EXAMINATI MS
1. The General Board shall provide for promotion in the Fire and
Police Services on the basis ascertained merit and seniority in service

and examination. In all cases where it is practical, vacancies shall
be filled by promotion. All examinations for promotion shall be compe-
titive among such members of the next lowest rank as desire to submit
themselves to such examination. All :promotions shall be made from the
three having the highest rating. The method of examination and the rules
governing the same are the same as provided for applicants for original
appointment except as follows:
All officers who submit themselves for examination will be graded
according to the following schedule:

2. Promotional Preference
The Commission in determining next in order of rank in promotion-
al examinations herewith determines a policy of extending the examinations
successively through all the orders of rank in the services in an
endeavor to qualify suitable eligibles for the vacancy or vacancies
existing, before extending the examination to the general public.
3. In cries
Persons receiving injuries while on duty or in the discharge of
duty shall not be disqualified from promotion. When such injuries occur,
the chief of the department shall notify the Commission in writing, stating
the nature of the injuries and under what circumstances received.

4. Consolidation of Lists
Should the Commission deem it advisable to supplement the
number of names on any eligible register, by holding another examination
for the position; the register resulting from such supplemental exam-
inations, shall be consolidated wit'n the existing register, and the names
of eligibles shall take rank on suci� consolidated register in the order
of the highest percentage obtained in either examination without refereuc>
to priority of time of examination. It shall be the duty of the Board
to notify persons on the existing list, that a supplemental examination
will be held and will result in a consolidation of the two lists.
CHAPTER IV --- ORDER OF RANK, CLASSIFICATION
AND OATH OF OFFICE
Section 1 -- RANK
The order of rank in the Police: Department shall be as provided
by ordinance as follows: Chief of Police, Captain, Lieutenants,
Sergeants and Patrolmen.
The order of rank in the Fire Department shall be as follows:
Fire Chief, Captain, Lieutenants, Engineers, Firemen.
Section 2 -- CLASSIFICATION
The Board hereby classifies such offices in the Fire and Police
Services for the purpose of establishing classification and fixing and
maintaining standards of examinations and indicating lines of promotion.
Section 3 -- The maximum age of 35 years for police and 34 years for
fire service shall not apply to applicants for promotion in these
respective services. The age limits in this rule provided shall not

in any case apply to the Chief of Police or Fire Chief. Except in cases
of promotion, the age limits applying to said officers shall be a minimum
of 21 years.
Section 4 -- OATH CF OFFICE
Before entering upon his duty, any person about to become a member
of the Police or Fire Department shall take an oath ofoffice before any
person authorized to administer oaths in the State of Illinois and he
shall be issued a certificate of appointment by the Board of Fire and
Police Commissioners.
CHAPTER V -- REMOVALS. SUSPENSICNS. DISCHARGES.
INVESTIGATICN OF CHARGES
Section 1 -- REMGVALS
Removal from office, on suspension from service in the Fire or
Police Department, shall be in compliance with the Fire and Police
Commissioner's Act of the State of Illinois in Division 2, Sections 10-2.1-1
to 10-2.1-28 inclusive of Chapter 2,1, of the Illinois Revised statutes.
Section 2 -- SUSPENSIONS
The Chief of the Fire or Police Department shall have the right to
suspend any subordinate officer for a period of not to exceed five (5)
days as provided for in Section 10-2.1-17 of Chapter 24 of the Illinois
Revised Statutes, 1965.
Appeals from such order of suspension shall be heard by the Board
in the same manner as charges originally filed with said Board, subject
to the provisions of such statute.
Section 3 -- DISCHARGES
Persons holding positions in the Fire and Police Department shall

be removed and discharged from service in the following manner:
a. The Board may suspend any member of the Fire or Police Department
against whom charges have been preferred, but not to exceed 30 days with-
out pay at any one time. The Board shall conduct a fair and impartial
hearing of the charges to be commenced within 30 days from the filing
thereof.
b. Charges shall be preferred in writing and signed by the party
making same and shall be filed with the Secretary of the Commission.
The charges shall specify the nature of the charge and shall designate
the time and place of the offense.
c, The accused shall be notified by registered mail or personal
notice in writing of such charges and shall appear before the Commission
for trial at a specified time and place. A person so charged shall be gi* n
an opportunity to employ counsel and be heard in his own defense at a
public hearing conducted by the Board.
d. The Board shall within 1.5 days after the trial is completed,
enter itis findings on the recora.s of the Commission.
Section 4 -- DATE GF HEARING
The time for the hearing and charges shall be set by the Board
within 30 days of the time the filing of such charges. Continuances
shall be granted from time to time upon motion of any party to the pro-
ceeding by order of the Board.
Section 5 -- FINDINGS AND ORDER
In case any member of the Fire or Police Department shall be found
guilty of the charges preferred against him after a hearing on same,

may be removed, discharged, or may be suspended for a period not exceeding
30 days without pay.
Section 6 -- RULES - CCNFLICTS

of the Fire and Police Department. In case of conflict, the rules and
regulations of the Board shall govern.

No person in the Fire Department or Police Department of the Village
of Elk Grove Village, Illinois, shall be under any obligation to contri-
bute to any fund or to render any political service and no such person
shall be removed or be otherwise prejudiced for refusing to do so. No
person in the Fire Department or the Police Department of the Village
of Elk Grove Village, Illinois, ;shall discharge, promote or reduce, or
in any manner change the official rank, or compensation of any other
person in such service, or promise or threaten so to do, for withholding
or refusing to make any contribution of money or service or any other
valuable thing for any political purpose, or in any other manner, direct-
ly or indirectly, use his official authority or influence, to compel or
induce any other person to pay or render any political assessment, sub-
scription, contribution, or service.
Section 8 -- POLITICAL ACTIVITIES
No person holding a position in the Fire or Police Department of
the Village of Elk Grove Village, Illinois, shall use his official
authority or influence or to coerce the political action of any person

or body, or to interfere with any election, or shall take an active part
in a political campaign, or shall seek or accept nomination, election,
or appointment as an officer of a political club or organization, or
serve as a member of a committee; of any such club or organization, or
circulate or seek signatures to any petitions provided for by any primary
or election law, or act as a worker at the polls, or distribute badges,
favoring or opposing a candidate: for election or nomination to a public
office, whether federal, state, county or municipal. But nothing in this
section shall be construed to prohibit, or prevent any such person from
becoming or continuing to be a member of a political club or organization
or from attendance at political meetings, from enjoying entire freedom
from all interference in casting his vote, or from expressing privately
his opinions on all political questions.
Section 9 -- VIOLATION OF RULES
All members of the Fire and Police Departments shall be subject to
the rules and regulations of such departments, and the rules and regula-
tions of the Board and a violation of such rules or regulations shall be
cause for the filing of charges before the Board, a subsequent hearing
and action by the Board on such charges as provided by statute.
Section 10 -- VIOLATION OF LAW
Any violation of the law of the municipality or state, or federal
law by any member of the Fire or Police Department of such municipality,
shall be cause for the filing of charges against that officer and sub-
sequent action thereon by the Board persuant to statute.

Section 11 - FINDING A DECISION
The finding and decision of the Board, following a hearing of charges,
shall be preserved by the Secretary, and notice of said finding and
decision sent to the officer involved and the department head for enforce-
ment. If the finding or decision is that an officer or employee is
guilty of charges, and removal or discharge is ordered, such order of
removal or discharge shall become effective forthwith.
CHAPTER VI-- GENERAL
Section 1
All officers and members of the Fire or Police Department shall
observe and obey all rules and orders of the Board of Fire and Police
Commissioners which are in ford; or which may be adopted hereafter, as
well as all rules and regulations for the operation of a Fire and
Police Department as adopted by the Village Board of Trustees now in
force, or which may be adopted hereafter.
Section 2
The Board of Fire and Police Commissioners shall have such other
power and duties as are given by the statutes of the State of Illinois.
These Rules shall be in full farce and effect ten (10) days after publi-
cation as provided by law and all Rules in conflict herewith be and the
same are hereby repealed.
