HomeMy WebLinkAboutRESOLUTION - 19-64 - 5/7/1964 - NEGOTIATIONS/LAND OWNERSRESOLUTICN NO. 19-64 A RESOLUTION AUTHORIZING NEGOTIATIONS AND AGREEMENTS BETWEEN a4NERS OF LAND AND THE VILLAGE OF ELK GROVE VILLAGE TO REIMBURSE IT FOR PAYMENTS TO BE MADE TO THE METROPOLITAN SANITARY DISTRICT FOR SEWERAGE SERVICE TO PROPERTIES LOCATED IN DU PAGE COUNTY WHEREAS, the Village of Elk Grove Village by Resolution No. 16-64 has authorized its President and Village Attorney to negotiate an agreement by and between it and the Metropolitan Sanitary District of Greater Chicago for sewerage service to some approximately ninety (90) acres of property lying in DuPage County and also in the Village of Elk Grove Village; and WHEREAS, by virtue thereof it is necessary that the Village agree to make payments to defer said cost so that the Metropolitan Sanitary District of Greater Chicago is left whole; and WHEREAS, said payments should be reimbursed to the Village plus said ad- ministrative costs which are necessary to accomplish same; and WHEREAS, the owners of the hereinafter described property and the future owners thereof should secure and pay the Village in this regard. NCW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage: Section 1. That the President and Village Attorney of the Village of Elk Grove Village be and are hereby authorized to enter into negotiations with the owners of some approximately ninety (90) acres of property south of Devon Avenue in the Village of Elk Grove Village, legally described to wit: The west half of fractional Northwest Quarter of Section 2, Township 40 North, Range 11, East of the Third Principal Meridian, also the North half of the Northwest Quarter of the Southwest Quarter of Section 2, Township 40 North, Range 11, East of the Third Principal Meridian, also a part of the East half of fractional West half of Section 2, Township 40 North, Range 11, East of the Third Principal Meridian, described as follows: commencing at the Northwest corner of said East half of said fractional West half; thence South 38 chains and 161 links; thence East 5 links; thence North 38 chains and 161 links; thence West 15 links to the place of beginning, excepting therefrom such part or portion thereof as has heretofore been dedicated to the State of Illinois for highway purposes by instrument dated July 12, 1937, and recorded July 14„ 1937, as Document #381700 in DuPage County, Illinois. for the purpose of affording said property sewerage service through the media of the Metropolitan Sanitary District of Greater Chicago and to negotiate reimburse- ment payment for same. It being further understood that any negotiations and agreements arrived at by said officials shall be subject to the ratification by -1- :o. the Preaident and Board of Trustees acting in regular session. Section 2. This resolution shall be in full farce and effect from and after its passage and approval according to law. PASSED AND APPROVED this 7th day of May, 1964. ATTEST: Eleanor G.
