HomeMy WebLinkAboutRESOLUTION - 21-06 - 4/25/2006 - MEMORANDUM OF UNDERSTANDINGRESOLUTION NO. 21-06 A RESOLUTION AUTHORIZING THE MAYOR AND VILLAGE CLERK TO EXECUTE A MEMORANDUM OF UNDERSTANDING BETWEEN THE VILLAGE OF ELK GROVE VILLAGE AND THE HEART OF A MARINE FOUNDATION PROUDLY SERVING ALL BRANCHES OF THE US MILITARY REGARDING THE DISTRIBUTION OF CERTAIN FALLEN SOLDIER MEMORIAL FUND DONATIONS NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois as follows: Section 1: That the Mayor be and is hereby authorized to sign the attached documents marked: Memorandum of Understanding between the Village of Elk Grove Village and the Heart of a Marine Foundation Proudly Serving All Branches of the US Military regarding the Distribution of Certain Fallen Soldier Memorial Fund Donations a copy of which is attached hereto and made a part hereof as if fully set forth and the Village Clerk is authorized to attest said documents upon the signature of the Mayor. Section 2: That this Resolution shall be in full force and effect from and after its passage and approval according to law. Walsh, Village Clerk MSMemomnofUnd«staMingPuMd nations Memorandum of Understanding between the Village of Elk Grove Village and the Heart of a Marine Foundation Proudly Serving All Branches of the US Military regarding the Distribution of Certain Fallen Soldier Memorial Fund Donations Whereas, the Village of Elk Grove (hereafter Village) is holding donations collected from various civic groups and volunteers for the Elk Grove Fallen Soldier Memorial Fund; and, Whereas, the purpose of the donation collection was to fund a memorial statue, memorial college scholarships, and assist military families facing hardship situations; and, Whereas, the donations collected for the military family assistance portion of the program amounts to $16,893.37; and, Whereas, the Heart of a Marine Foundation Proudly Serving All Branches of the US Military (hereafter Foundation) is a chartered 501(c)(3) not-for-profit corporation based in Elk Grove Village with a mission of providing assistance to all branches of military personnel and their families; and, Whereas, the Foundation by its nature is attuned to the financial hardship situations experienced by military personnel and their families; and, Whereas, the Village of Elk Grove desires to have the Foundation distribute or otherwise utilize the donations collected by the community for military family assistance following the terms and conditions contained herein. Therefore, be it agreed by the parties as follows: Section 1—Distribution of Funds The Village will provide the Foundation with. $16,893.37 of donated funds in three distributions as follows: • On or about May 2006, the Village will provide the Foundation with $5,631.12 • On or about May 2007, the Village will provide the Foundation with $5,631.12 • On or about May 2008, the Village will provide the Foundation with $5,631.13 With the final distribution in 2008, the Village's obligation to provide funding to the Foundation will be complete. For purposes of this Memorandum of Understanding, the Village will not provide any additional funds beyond the final distribution. The Village will have no obligation to provide any funds if the Foundation fails to abide by the stipulations set forth in this Memorandum as determined by the Village. Final Memorandum of Understanding Page 1 of Section 2 — Foundation Requirements/Distribution of Funds The Foundation agrees to only distribute or utilize the funds provided by the Village in Section 1 above in the following manner: • Only residents (including unincorporated residents with a mailing address) of Elk Grove Village, Arlington Heights, Schaumburg, Rolling Meadows, Itasca, Wood Dale, Bensenville, Des Plaines, or Mount Prospect are eligible to receive direct financial assistance or otherwise be assisted by the funds provided in Section 1. • Funding assistance will be provided to a person serving in any branch of the US military or the family of a person serving in any branch of the US military experiencing a financial hardship specifically attributable to said military service. • The Foundation shall use its best efforts to validate the existence of the financial hardship and determine that the hardship is based upon military service. • The Foundation shall determine how best to address the hardship situation by providing direct financial grants or otherwise purchasing goods, services, accommodations, or commodities to address the hardship situation. • The Foundation will accept all responsibility for administering, implementing, and financing the means and methods it chooses to address the hardship situation. Section 3 — Examples of Hardship Situations The Village and the Foundation agree that the following situations serve as a guideline for providing hardship funding assistance: • Assisting a military person wounded or injured while in military service; • Assisting the family of a military person who was injured while in military service. Such family assistance may include travel and accommodations for the family to visit the injured service person. • Assisting a military family needing home repairs due to the military service separating the soldier from their family. The aforementioned are guidelines. They do not cover every circumstance or situation that may arise and be addressed by the Foundation. Section 4 - Reporting The Foundation agrees to provide a report to the Village in April 2007, April 2008, and April 2009 detailing how the funds were utilized to assist a US military person or qualified family experiencing a hardship situation. Section 5 — Review The Village shall have the right at any time to review the Foundation's records and/or the Village may request information from the Foundation and the Foundation shall comply with the request regarding the distribution of funds to ensure the Foundation is following the provision of this Memorandum of Understanding. ]Final Memorandum of Understanding Page 2 of 3 Section 6 — Signatures By signing below, the parties acknowledge their obligation to comply with the terms and conditions of this Memorandum of Understanding: The Heart of a Marine Foundation Proudly Serving All Branches of the US Military Execution: By: (Signature) Its: critic) Attest: By: (Signature) Its: (Title) Village of Elk Grove Village Execution: By: Craig B.
