AN ORDINANCE AMENDING VARIOUS PROVISIONS OF CHAPTER 21
MASSAGE ESTABLISHMENTS OF THE VILLAGE CODE OF THE VILLAGE
OF ELK GROVE VILLAGE
BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk
Grove Village Counties of Cook and DuPage Illinois as follows:
Section 1: That the definition of Massage Establishment as set forth in Section
3-21-1 Definitions be and the same is hereby amended to read as follows:
Massage Establishment: Any establishment having a fixed place of business
where any person, firm, association or corporation engages in or carries on or permits to
be engaged in or carries on any of the activities mentioned in this Chapter. A Massage
Establishment must be an ancillary use to a hotel, a hair salon/spa, a health club or a
medical facility. As an ancillary use to a hotel, there must be a full spa, sized and
equipped as approved by the Village Health Department.
Section 2: That Paragraph D -2-C of Section 3-21-3 Business License and
Filing Fee be amended by adding a semi -colon (;) after the word turpitude and by further
adding the word "or". Paragraph D is further amended by adding a sub -paragraph 3
which shall read as follows:
3. A person who is not of good character and reputation in the community in
which he resides, works or who is not of good character and reputation in the
Village of Elk Grove Village. A person who. has been employed in an
establishment which has been closed or suspended or whose license has been
suspended or revoked by a law enforcement agency or municipal entity for
crimes or offenses involving prostitution or matters of moral turpitude will be
deemed to be a person who is not of good character and reputation in the
community where the above -slated activity has occurred.
Section 3: That Section 3-21-4 B. 2. be amended as follows:
2. Written proof that the individual is at least eighteen (18) years of age.
Section 4: That Section 3-21-16 Employment Age Restrictions be amended to
read as follows:
3-21-16 Employment Age Restrictions - It shall be unlawful for any owner,
proprietor, manager or other person in charge of any massage
establishment to employ any person who is not at least eighteen (18) years
of age.
Section 5: That Section 3-21-18 C. Initial Application Fee shall be amended by
providing for a non-refundable application fee of two hundred fifty dollars ($250.00).
Section 6: That Section 3-21-21 Penalty be amended to read as follows:
3-21-21 Penalty - Any person, firm or corporation who violates any of
the provisions of this Chapter shall be subject to a fine of not less
than two -hundred fifty dollars ($250.00) nor more than one -
thousand dollars ($1,000.00) for each violation, and a separate
violation shall be deemed committed on each day during or on
which a violation occurs or continues to exist. In addition to any
fine, the Village may proceed to suspend or revoke the license as
provided in Section 3-21-6.
Section 7: That the Village Clerk is hereby authorized to publish this Ordinance
in pamphlet form.
Section 8: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication according to law.
