HomeMy WebLinkAboutRESOLUTION - 15-11 - 4/12/2011 - CLASS 6B/901 LIVELY BLVD.RESOLUTION NO. 15-11 A RESOLUTION DETERMINING THE APPROPRIATENESS FOR CLASS 6B STATUS PURSUANT TO THE COOK COUNTY REAL PROPERTY CLASSIFICATION ORDINANCE AS AMENDED FEBRUARY 15, 2006 FOR CERTAIN REAL ESTATE LOCATED AT 901 LIVELY BOULEVARD, ELK GROVE VILLAGE, ILLINOIS WHEREAS, the Village of Elk Grove Village desires to promote the development of industry in the Village of Elk Grove; and WHEREAS, the Cook County Assessor is operating under an ordinance enacted by the Cook County Board of Commissioners, and amended from time to time, the most recent amendment becoming effective as of February 15, 2006, which has instituted a program to encourage industrial and commercial development in Cook County known as the Cook County Real Property Classification Ordinance; and WHEREAS, in the case of abandoned property, if the municipality or the Mayor and Board of Trustees, finds that special circumstances justify finding that the property is "abandoned" for purpose of Class 613, even though it has been vacant and unused for less than 24 months, that finding, along with the specification of the circumstances, shall be included in the resolution or ordinance supporting and consenting to the Class 6B application. Such resolution or ordinance shall be filed with the eligibility application. If the ordinance or resolution is that of a municipality, the approval of the Board of Commissioners of Cook County is required to validate such shortened period of qualifying abandonment, and a resolution to that effect shall be included with the Class 6B eligibility application filed with the Assessor; and WHEREAS, the Petitioner has applied for or is applying for Class 6B property status pursuant to said aforementioned ordinance, for certain real estate located at 901 Lively Boulevard, in the Village of Elk Grove Village, Cook County, Illinois, with the Property Index Number 08-27-400-087-0000, has proven to this Board that such incentive provided for in said ordinance is necessary for development to occur on this specific real estate. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois: Section l: That the request of the Petitioner to have certain real estate located at 901 Lively Boulevard, Elk Grove Village, Cook County, Illinois, legally described as follows, and with the Property Index Number 08-27-400-087-0000 declared eligible for Class 6B status pursuant to the Cook County Real Property Classification Ordinance as amended February 15, 2006, is hereby granted in that this Board and the Village of Elk Grove Village, Illinois, has determined that the incentive provided by the said Class 6B Tax Incentive Ordinance is necessary for the said development to occur on the subject property: LOT 1 IN GULLO INTERNATIONAL CONTEMPORARY PARK, BEING A RESUBDIVISION OF LOT 230 IN HIGGINS INDUSTRIAL PARK, UNIT 165, BEING A SUBDIVISION IN THE SOUTHEAST'A OF SECTION 27, TOWNSHIP 41 NORTH, RANGE 11, EAST OF THE THIRD PRINCIPAL MERIDIAN, (EXCEPTING THEREFROM THE NORTH 220 FEET OF THE EAST 420.00 FEET THEREOF), ACCORDING TO THE PLAT THEREOF RECORDED MAY 16, 1984 AS DOCUMENT 27088665, (EXCEPTING THEREFROM THAT PART CONVEYED TO ELK GROVE VILLAGE FOR ROAD PURPOSES BY TRUSTEE'S DEED DATED OCTOBER 12, 2004 AND RECORDED MARCH 28, 2005 AS DOCUMENT NUMBER 0508718000) IN COOK COUNTY, ILLINOIS. Section 2: That the Special Circumstances as outlined by the petitioner are attached hereto as Exhibit "A" and made a part thereof. Section 3: That the Village of Elk Grove Village, Illinois hereby supports and consents to the Class 6B Application and approves the classification of the subject property as Class 613 property pursuant to the Cook County Real Property Classification Ordinance and the Class 6B tax incentives shall apply to the property identified as Permanent Real Estate Index Number 08- 27-400-087-0000. Section 4: That the Mayor and Village Clerk are hereby authorized to sign any necessary documents to implement this Resolution. Keegan, Village Clerk Res66'fac901 Livelyspccial Exhibit "A" Special Circumstances Requested by Giovanni Gullo and Maria Gullo Family Limited Partnership Giovanni Gullo and Maria Gullo Family Limited Partnership, or an entity to be named later (collectively the "Applicant"), plans on completing its purchase of the property located at 901 Lively Blvd. in Elk Grove Village, Illinois (PIN: 08-27-400-087-0000) and leasing the same to 520 Machinery Sales, LLC for its own use consisting of warehousing and distribution of precision cutting machines. The subject property consists of a building that is approximately 5,600 square feet on a roughly 15,776 square foot site that was previously occupied by Status Graphic. In late 2008 Status Graphic began winding down its operations at the subject property, and by the beginning of 2009 it was down to one employee and using the warehouse as dead storage. In 2009, Status Graphic went bankrupt and the property was foreclosed on. In September, 2010 Status Graphic completely vacated the site, and since October 1, 2010 the subject property has been 100% vacant and unused. The subject property continues to sit 100% vacant and unused as of today and the Applicant intends to lease the site to 520 Machinery Sales, LLC for its own use consisting of warehousing and distribution of precision cutting machines. 520 Machinery Sales, LLC is currently located at 1701 Howard St. in Elk Grove Village and it needs to expand, and will therefore be moving its entire operation from that site to the subject property in order to do so. As of today, 520 Machinery Sales, LLC has five employees at its current facility and plans to bring all five to the new site as well as to hire 12 additional employees to work at the subject property. 520 Machinery Sales, LLC is eager to move into the subject property, however, before it can occupy and use the site, the subject property requires significant rehabilitation. Therefore, the Applicant has allotted approximately $75,000 to rehabilitate the site for 520 Machinery Sales, LLC's use. The improvements will be made with regard to, but not limited to the offices, bathrooms, walls, floors, ceiling, skylights and lighting. In addition, the Applicant plans to replace the landscaping and drive-in doors as well as repave the parking lot. Should the Applicant obtain a Class 6b Incentive on the subject property, it believes it can successfully lease the site to 520 Machinery Sales, LLC, which would result in approximately 22 permanent full-time jobs at the site and will keep an expanding Village Elk Grove Village company in the municipality. However, the viability of the same is contingent on the Applicant receiving a Class 6b Tax Incentive. The Applicant believes the Class 6b Incentive will allow it to secure 520 Machinery Sales, LLC as a tenant, which will fill a currently vacant site as well as retain and bring additional jobs to the Village of Elk Grove Village. It is for these reasons that it is necessary to grant the Applicant a Resolution supporting and consenting to a Class 6b Incentive for the above -referenced, property based on occupation of abandoned property for less than twenty-four (24) months continuous vacancy with a purchase for value, special circumstances and substantial rehabilitation.
