HomeMy WebLinkAboutRESOLUTION - 35-16 - 10/25/2016 - Class 6B, 365 Criss Circle RESOLUTION NO. 35-16 A RESOLUTION DETERMINING THE APPROPRIATENESS FOR CLASS 6B STATUS PURSUANT TO THE COOK COUNTY REAL PROPERTY CLASSIFICATION ORDINANCE AS AMENDED JULY 17,2013 FOR CERTAIN REAL ESTATE LOCATED AT 365 CRISS CIRCLE,ELK GROVE VILLAGE, ILLINOIS WHEREAS,the Village of Elk Grove Village desires to promote the development of industry in the Village of Elk Grove; and WHEREAS,the Cook County Assessor is operating under an ordinance enacted by the Cook County Board of Commissioners, and amended from time to time, the most recent amendment becoming effective as of July 17, 2013, which has instituted a program to encourage industrial and commercial development in Cook County known as the Cook County Real Property Classification Ordinance; and WHEREAS,the Mayor and Board of Trustees, finds that special circumstances justify finding that the property is "abandoned" for purpose of a Class 6B designation, even though it has been vacant and unused for more than 12 months and there has been no purchase for value, that finding, along with the specification of the circumstances, shall be included in the resolution or ordinance supporting and consenting to the Class 6B application; and WHEREAS,the Petitioner has applied for or is applying for Class 6B property status special circumstances pursuant to said aforementioned ordinance for certain real estate located at 365 Criss Circle, in the Village of Elk Grove Village, Cook County, Illinois, with the Property Index Numbers 08-22-102-226-0000 and 08-22-102-227-0000 has proven to this Board that such incentive provided for in said ordinance is necessary for development to occur on this specific real estate. NOW, THEREFORE,BE IT RESOLVED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois: Section 1: That the request of the Petitioner to have certain real estate located at 365 Criss Circle, Elk Grove Village, Cook County, Illinois, and identified by Property Index Numbers 08- 22-102-226-0000 and 08-22-102-227-0000 declared eligible for Class 6B status pursuant to the Cook County Real Property Classification Ordinance as amended July 17, 2013, is hereby granted in that this Board and the Village of Elk Grove Village, Illinois, has determined that the incentive provided by the said Class 6B Tax Incentive Ordinance is necessary for the said development to occur on the subject property, legally described as follows: THE SOUTHEASTERLY 0.59 FEET OF LOT 62 IN HIGGINS ROAD COMMERCIAL SUBDIVISION,UNIT NO. 3, BEING A SUBDIVISION IN THE WEST %2 OF SECTION 22, TOWNSHIP 41 NORTH, RANGE 11, EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS; and THAT PART OF LOTS 63, 64, 65 AND 66 IN HIGGINS ROAD COMMERCIAL SUBDIVISION UNIT NUMBER 3, BEING A SUBDIVISION IN THE WEST 1/2 OF SECTION 22, TOWNSHIP 41 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN DESCRIBED AS FOLLOWS: BEGINNING AT THE MOST NORTHERLY CORNER OF LOT 63 AFORESAID; THENCE SOUTHWESTERLY ALONG THE NORTHWESTERLY LINE THEREOF 200.0 FEET TO THE MOST WESTERLY CORNER OF LOT 63 AFORESAID; THENCE SOUTHEASTERLY ALONG THE SOUTHWESTERLY LINE OF 1 LOTS 63 AND 64 TO THE MOST SOUTHERLY CORNER OF LOT 64 AFORESAID; THENCE SOUTHEASTERLY ALONG THE SOUTHWESTERLY LINE OF LOT 65 (BEING AN ARC CONVEX NORTHEASTERLY AND HAVING A RADIUS OF 140.0 FEET) FOR A DISTANCE OF 46.86 FEET TO A LINE 45.99 FEET (MEASURED AT RIGHT ANGLES) SOUTHEAST OF AND PARALLEL WITH THE NORTHWESTERLY LINE OF LOT 65 AFORESAID; THENCE NORTHEASTERLY ALONG SAID PARALLEL LINE 54.42 FEET; THENCE EAST 217.43 FEET TO A POINT IN THE NORTHEASTERLY LINE OF LOT 66 AFORESAID 82.29 FEET NORTHWESTERLY FROM THE MOST EASTERLY, NORTHEAST CORNER OF LOT 66 AFORESAID; THENCE NORTHWESTERLY ALONG THE NORTHEASTERLY LINE OF LOTS 63, 64, 65 AND 66 AFORESAID 417.29 FEET TO THE POINT OF BEGINNING, IN COOK COUNTY, ILLINOIS. Section 2: That the Special Circumstances as outlined by the petitioner are attached hereto as Exhibit "A" and made a part thereof. Section 3: That the Village of Elk Grove Village, Illinois hereby supports and consents to the Class 6B Application and approves the classification of the subject property as Class 6B property pursuant to the Cook County Real Property Classification Ordinance and the Class 6B tax incentives shall apply to the property identified as Permanent Real Estate Index Numbers 08- 22-102-226-0000 and 08-22-102-227-0000. Section 4: That the Mayor and Village Clerk are hereby authorized to sign any necessary documents to implement this Resolution subject to the petitioner completing the following conditions within twelve months of closing: a. Replace the dock and parking lot aprons, seal and stripe parking lot patching as necessary, and replace damaged parking bumpers; b. Replace gravel with grass on north side, remove stones adjacent to drive-in door, and replace sidewalk and stoops at west and main entrances; and c. Remove trees and invasive brush from drainage ditch, remove boulders on right-of-way. Section 5: That this Resolution shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 2511 day of October 2016. The subject property has special circumstances, which have made it difficult to lease,such as the fact that the 16-foot ceiling height, is considered low for today's industrial/warehouse users. Additionally,the subject is 45- years old,making it less desirable to many tenants looking for a newer building with higher ceilings and a more modern layout. Lastly, the subject lacks rear access,which has and will continue to diminish the marketability of the subject property to any potential tenantsibuyers. As stated above, the new lease is contingent upon the Village Board approving of the Class 6b tax incentive for this property. This project is not economically feasible and sustainable without an approved Class 6B tax incentive and the property will remain vacant. Most potential tenants are also considering locations nearby but outside of Cook County that have much lower real estate taxes.
