CONSENT AGENDA a. Consideration of a request from Queen of the Rosary Parish to waive fees for a temporary Class D Liquor License and a Food Caterer's License in the amount of$2,200 for an Alumni Gathering on Saturday,November 26, 2016 at 750 Elk Grove Boulevard. (The fee for a Class D Liquor License is $2,100 and the fee for a Food Caterer's License is $100. (It has been past practice of the Village Board to grant fee waivers for governmental and non-profit organizations.) b. Consideration to increase a construction contract with Landmark Contractors, Inc. of Huntley, IL for the Biesterfield and Wellington Streetscape Improvements Project in the amount of$29,006.18 from the Capital Projects Fund. (The original contract with Landmark Contractors, Inc. includes the installation of the new electronic message boards, the gateway arch and signage,the Pavilion sign, landscaping and irrigation. (The project scope was increased to include brick paver and landscaping work at Veteran's Memorial Park, necessitating a contract increase. (This contract total is still below the original contract budget. (Adequate funds are available in the Capital Projects Fund. (The Director of Community Development recommends approval.) c. Consideration to award a purchase contract through the National Joint Powers Alliance Page 1 of 5 (NJPA) Joint Purchasing Cooperative to Casey Equipment of Arlington Heights, IL for the purchase of one (1) LeeBoy 5000 Path Master Paver in the amount of$109,316.25 from the Capital Replacement Fund. (The Department of Public Works is purchasing one (1) LeeBoy 5000 Path Master Paver. (The LeeBoy 5000 Path Master Paver is available with base pricing established by the NJPA Joint Purchasing Cooperative and offered from Casey Equipment of Arlington Heights, IL. (The paver will be utilized for street patching operations. (Adequate funds are budgeted in the Capital Replacement Fund. (The Director of Public Works recommends approval.) d. Consideration to concur with the 2016 combined Village and Library property tax levy determination of$25,671,681 less the proposed abatement of$2,470,609 for a net levy $23,201,072. (This will be the tenth consecutive year that the Village Board is holding the line on property taxes. The non-pension portion of the Village tax levy is down $403,556 from last year while the pension portion is up $1,050,278. (The Library request is up $271,058 from last year. (The Director of Finance recommends approval.) e. Consideration to adopt Ordinance No. 3467 (attached) amending the Position Classification& Salary Plan of the Village Code of the Village of Elk Grove Village. (The ordinance deletes two (2) Cable Production Assistant positions in the Merit Pay Plan and adds two (2) Cable Production Assistant positions to the Step Pay Plan.) f. Consideration to adopt Ordinance No. 3468 amending Village Code sections 6-6-3-7 and 6-6-3-8 with respect to decriminalizing certain arrests for possession of cannabis and other sanctions for other cannabis and paraphernalia arrests. (The State of Illinois,pursuant to SB 2228 has decriminalized certain arrests for possession of Cannabis and Drug Paraphernalia. (The Police Department recommends the possession of Cannabis in an amount of 10 grams or less to be a civil law violation as opposed to a criminal offense and providing for increased fines for the the Ordinance violation of possession of between 11 grams and 30 grams of Cannabis. (Any person violating the provisions of Section 6-6-3-7 B-1 shall be subject to a civil law fine of not less than one hundred dollars ($100.00)nor more than five hundred dollars ($500.00) for each offense. (Any person violating the provisions of Section 6-6-3-7 B-2 shall be subject to a fine of not less than two hundred dollars ($200.00) nor more than($500.00) for each offense. ( Penalty of Section 6-6-3-8 F possession, sale or delivery of Cannabis Paraphernalia be amended to any person who knowingly possesses an item of Cannabis paraphernalia shall be fined not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00) for each offense. (The Deputy Police Chief recommends approval.) Page 2 of 5 g. Consideration to adopt Ordinance No. 3469 amending Section 6-4-5-1(C) of the Village Code as it pertains to parking restrictions on certain designated streets within the Village. (Following the acquisition of the former Hoskins Chevrolet dealership, Castle Chevrolet is thriving in their new location and in need of additional parking. (The Village is seeking to help mitigate the matter by opening parking on the west side of Randall Street from 5:00 a.m. to 11:00 p.m. (Adoption of this Ordinance would allow parking on the west side of Randall Street from 5:00 a.m. to 11:00 p.m.) h. Consideration to adopt Resolution No. 36-16 (attached) appropriating funds for engineering and construction of additional sidewalk and the cost difference between standard roadway lighting and the requested upgraded decorative LED lighting along Elmhurst Road as part of the I-90/Elmhurst Interchange project in the amount of $72,034.85 from the Business Leaders Fund. (The construction along Elmhurst Road between Oakton Street and Higgins Road is advancing as part of the 1-90 and Elmhurst Road full interchange project. (The Village was provided the opportunity to add sidewalk along the west side of Elmhurst Road from Interchange to Landmeier Road and upgrade from standard roadway lighting to decorative LED lighting along Elmhurst Road. (The total estimated cost for these improvements are $72,034.85. (An Intergovernmental Agreement between the Tollway, Illinois Department of Transportation, City of Des Plaines,Village of Mount Prospect, and the Village Elk Grove Village will be executed for this project once the terms and conditions are finalized. (It is recommended that a Resolution appropriating the funds be adopted. (Adequate funds are available in the BLF Funds. (The Director of Public Works has recommended approval.) i. Consideration to adopt Resolution No. 36-17 (attached) authorizing the Mayor to execute a Letter of Receipt stipulating the terms of an agreement for an application seeking a Cook County Class 6B Property Tax Exemption status pursuant to the Cook County Real Property Classification Ordinance as amended February 15, 2006 for certain real estate located at 1200 Lunt Avenue. (The Law Offices of Sarnoff& Baccash, on behalf of VK 1200 (Applicant), is seeking a Cook County Class 6B Property Tax Exemption for 1200 Lunt Ave. (The Applicant intends on purchasing the building and leasing it to an industrial user. The subject property consists of a 52,266 square foot building that is vacant and unused. (The Applicant intends on spending approximately $450,000 to refurbish the building including: replace dock drive, dock aprons, and driveway aprons to Village code; resurface and stripe parking lot; install storm water detention in parking lot; install energy efficient lighting in warehouse; demolish and renovate office space; install new dock seals and paint all dock doors and bollards; install a new roof, clean out drainage ditch in rear; improve fagade, landscaping, and signage per application packet. (The goal of Class 6B is to attract new industry, stimulate expansion and retention of existing industry and increase employment opportunities. The eligibility requirements for 6B status are new construction, substantial renovation or buildings that have been vacant Page 3 of 5 for a period of time. (This site qualifies as it involves occupation of an abandoned building for less than twenty- four(24)months continuous vacancy with a purchase for value,with significant rehabilitation, and special circumstances. (Property approved for Class 6B status allows the owner of the property to have the assessment level lowered for a period of twelve years. The assessment schedule is 10% of fair market value for ten years then 15%in the eleventh year and 20% in the twelfth year. Industrial property is currently assessed at 25% of fair market value in Cook County. (Upon approval,the Director of Business Development and Marketing will issue a Letter of Receipt to the Applicant. The Letter of Receipt will allow the Applicant to file an application with Cook County. Final approval is at the discretion of the Village Board and contingent with the Applicant completing the improvements stated in their application. Consideration to award a professional services contract retainer to Entertainment Management Group of Elk Grove Village, IL for the management and operation of the 2017 Mid-Summer Classics Concert Series in an amount of$39,500. (In order to lock in pricing for various components of the 2017 Mid-Summer Classics Concert Series, Entertainment Management Group is seeking a retainer. (The concert series is funded by the I%Hotel/Motel Tax,video gaming revenue, tobacco license fees, a$50,000 donation by the Elk Grove Park District, and sponsorship donations. (The ninth annual Mid-Summer Classics Concert Series will consist of four concerts to be held during the month of July.) k. Consideration to adopt Ordinance No. 3470 amending sections 3-1-6, 3-19-4 & 3-19-10 of the Village Code of the Village of Elk Grove Village pertaining to alarm license fees and fines. (This ordinance updates the alarm licensing fee and fine structures. (Businesses will only be charged a fixed license fee of$25.00 per year, as opposed to fees in excess of$300.00 for some businesses. (This revision is in coordination with the implementation of a new alarm license management computer program. (Fines for false alarms will be increased by $50.00 for each level of false alarm threshold shown in the current schedule. (The Deputy Police Chief recommends approval.) 1. Consideration to adopt Resolution 38-16 authorizing the Mayor and Village Clerk to execute six (6) Drop Box Agreements with United Parcel Service (UPS) to allow UPS to maintain existing drop boxes at 890 Lively Boulevard, 2125 Lively Blvd, 221 King Street, 1050 Touhy Avenue, 1501 Nicholas Boulevard, and 2500 Greenleaf Avenue. (The previous Drop Box Agreement with United Postal Service expired on November 12, 2012. (UPS is current on the payments as stipulated in the previous agreement and has removed the existing Drop Box at 1800 Howard and restored the site to its previous condition. Pagel of 3 (The new Drop Box Agreements have a one (1)year term and provide for four(4) renewal terms of one (1)year. (The final termination date for all six (6) agreements is November 1, 2020. (The annual rent for each drop box will be $325. (The Assistant Village Manager recommends approval.) in. Consideration to adopt Resolution No. 39-16 (attached) authorizing the Mayor to execute a Letter of Receipt stipulating the terms of an agreement for an application seeking a Cook County Class 6B Property Tax Exemption status pursuant to the Cook County Real Property Classification Ordinance as amended February 15, 2006 for certain real estate located at 901 Greenleaf Ave. (The Law Offices of Sarnoff& Baccash, on behalf of Fanmar Inc. (Applicant), is seeking a Cook County Class 6B Property Tax Exemption for 901 Greenleaf Avenue. (The Applicant intends on purchasing the building for its use of metal fabrication including laser cutting, stamping, and precision welding. Fanmar has been in business since 1965. (The Applicant currently owns and operates out of two facilities in Bedford Park and Westchester. Due to business expansion Fanmar will relocate both operations to Elk Grove Village. Fanmar employs approximately 20 people. Fanmar will add 5 new jobs immediately and two new shifts shortly after opening which will add another 20 jobs. (The subject property consists of a 55,000 square foot building that is vacant and unused. (The Applicant intends on spending approximately $150,000 to refurbish the exterior of the building including: Replace dock aprons and driveway aprons to Village code; Resurface and stripe parking lot adding wheel stops; Clean dock drainage structures; Replace dilapidated concrete in rear of building; Clean out drainage ditch in rear; and Improve faVade, landscaping, and signage per approved packet. (Additionally, Fanmar has budget$500,000 for interior buildout and moving. (The goal of Class 6B is to attract new industry, stimulate expansion and retention of existing industry and increase employment opportunities. The eligibility requirements for 6B status are new construction, substantial renovation or buildings that have been vacant for a period of time. (This site qualifies as it involves occupation of an abandoned building for more than twenty-four (24) months continuous vacancy with a purchase for value with significant rehabilitation. (Property approved for Class 6B status allows the owner of the property to have the assessment level lowered for a period of twelve years. (The amendments are technical in nature to ensure the plan follows IRS Guidelines. Assets of the Plan shall be held in trust, with the employer, for the exclusive benefit of Plan participants and their beneficiaries. (The assets of the Plan shall not be diverted to any other purpose prior to the satisfaction of all liabilities of the Plan.) 7.
