ELK GROVE VILLAGE PLAN COMMISSION
Wednesday, June 18, 1980
A regular meeting of the Plan Commission was called to order at 8 p.m.
on Wednesday, June 18, 1980 in the Multi-Purpose Room of the Municipal
Building, 901 Wellington Avenue.

Impact Zoning
Wayne White, a representative of Gould Research Laboratories,
presented a simulation exercise on the energy crisis.
Docket 80-2: Semar Petition for Annexation and Rezoning
Robert Marx, Attorney, and Herman Semar, Builder, were present
to represent the petitioners. The petitioners were requesting that
the Village annex 10.46 acres of property located at the southwest
corner of Biesterfield and Beisner Roads. The annexation would be
made contingent on the property's being zoned O-T, Office-Transition
District. The Village's Official Map shows the prperty zoned R-3,
Single Family Residence District.
Marx stated that he had met with Ronald Cope, attorney for
several residents in the area, and had come to the conclusion that
neither the residents nor the petitioner preferred to move the office
building to the southern portion of the 10.46 acre parcel.
Cope explained that the residents in the area could support the
petition for annexation and rezoning provided that several conditions
are satisfied. Below is a listing of the proposed conditions and both
the petitioners and Plan Commissioners' reactions to each proposed
condition:
(1) The compensatory storage area be dedicated to
the Village as natural open space and remain as natural
open space.
Marx commented that he had no objection to this suggestion, provided
that the building could be constructed as proposed.

Steven Halberg.reported that the staff of the Elk Grove Park
District would be interested in taking over the land and use it as
natural open space.
The consensus of the Plan Commission was to reject this suggestion
and instead recommend that the Village Attorney include adequate pro-
tection in the Pre-annexation Agreement to insure that the southern
portion of the parcel remain as open space and a compensatory storage
area.
(2) That the storm water drainage runoff connection
be designed to go around the compensatory storage
area (natural open space) and not through this area.
Marx commented that the petitioners would be willing to make this
adjustment to the plan.
The consensus of the Plan Commission was to support this change,
provided that it meets with the village Engineer's approval.
(3) That Lincoln Street not be annexed to the Village
if this is legally possible under annexation laws.
In the alternative, and as a condition for annexation,
that it be part of the annexation agreement that no
driveways or roads of any kind may be built connecting
Lincoln Street to the subject property.
Marx indicated that the Village would be forced to annex a section
of Lincoln Street, but that the petitioners had no intention to provide
access to their property from Lincoln Street.
The consensus of the Plan Commission was to recommend that the
Pre-annexation Agreement prohibit access to the development from Lincoln
Street.
(4) That there be 6 to 7 foot high berming and
landscaping along the southwest corner and south
end of the parking area as shown in the diagram.
Marx noted that the site plan had been revised to accommodate this
request from the homeowners.
The consensus of the Plan Commission was to support the change.
(5) That a 20 foot wide bermed and landscaped area
be established separating the residential properties
to the west from the subject site, as previously
represented by the developer.
Marx explained that the site plan had been revised to accommodate

(6) That there be no further widening of the Beisner
Road right-of-way, whether for roads, sidewalks or
other improvements within the natural open space area.

Marx stated that the petitioners would agree to improve Beisner
Road in whatever manner was required by the Village.
Henrici recommended that Beisner Road be widened to 40 feet from
Biesterfield Road to the second driveway entrance of the proposed
office development.
The consensus of the Plan Commission was to concur with Henrici 's
comments, and also to recommend that the sidewalk along Beisner Road
not be extended through the compensatory storage area.
(7) That the existing drainage easement remain within
the Itasca Meadow subdivision; that is, this easement
not be annexed to the Village and that the Township
keep and maintain the existing drainage.
Marx related that the property is not owned by the petitioners
and that they would be willing to agree with the suggestion.
The consensus of the Plan Commission was to concur with the
suggestion.
(8) That the Plan Commission make a finding and
recommendation in keeping with the recommendation of the
developer's planner, Rolf Campbell, that the west property
line of the subject property, as buffered by berming
and landscaping, serve as the boundary line separating
the office and transitional zoning from the residential
zoning and that no further intrusion of office and
transitional zoning or any other commercial or business
zoning take place on property to the west of the
subject property. That the Plan Commission find that
the special and unique design of this development allows
for its establishment at this particular location but
that the special precautions taken to insulate this
property from the rest of the residential property to
the west and south are a major consideration in
recommending the annexation and proposed zoning.
Marx noted that he had no objection to the suggestion, provided
that it did not restrict the petitioner from constructing the proposed
office complex.
The consensus of the Plan Commission was to reject the suggestion.
It was noted that the Comprehensive Plan is currently being updated,
and that the future use of the land west of the subject parcel would
be considered along with the other unincorporated areas within the
planning area of the Village.
Cummins declared that she is opposed to the petition because the
proposed use violates the basic principals of planning by intruding
into a residential area. She stated that the rezoning of the subject
parcel would have a "domino effect" of forcing a commercial zoning
of the property west of the subject parcel which fronts on Westerfield
Road. Cummins expressed concern about the amount of traffic that
would be generated by the proposed development. Cummins also stated
that she was disappointed that the homeowners in the area are compromising
their previous opposition to the petition, and she urged the homeowners

to fight the proposed annexation at the Public Hearing before the
President and Board of Trustees. *
Glass moved to direct the Chairman to prepare a recommendation_
that the President and Board of Trustees approve the request for pre-
annexation rezoning, subject to the conditions that have been discussed
at the recent meetings of the Plan Commission. Geinosky seconded the
motion.
Stangeland moved to amend the motion to state that the petitioner
should be required to install deacceleration lanes on Biesterfield
Road, with the approval of the Cook County Highway Department.
Paliganoff seconded the motion. The Secretary called the roll on
the amendment and the following responded 'AYE' : Stangeland, Mullen,
Glass, Geinosky, Kenna; 'NAY' : Paliganoff; 'PASS' : Cummins; whereupon
the Chairman declared the motion carried.
The Secretary then called the roll on the motion to recommend
approval of the request for pre-annexation rezoning and the following
responded 'AYE' : Stangeland, Paliganoff, Mullen, Glass, Geinosky,
Kenna; 'NAY' : Cummins; whereupon the Chairman declared the motion
carried.
Marx asked that the Plan Commission's finding of fact note that
the petitioners had made numerous concessions in response to the
requests from the nearby homeowners.
First Resubdivision of Winston Grove Section 22 North
Cummins moved to approve a two-lot subdivision of Village property
located at 1635 Biesterfield Road. Mullen seconded the motion and all
present voted 'AYE' .
The meeting adjourned at 11 :45 p.m.
