Elk Grove Village Plan Commission
March 1 , 1978
The regular meeting of the Plan Commission was called to
order by acting Chairman William Wesley at 9: 10 P.M. on Wednesday,
March 1 , 1978 in the Council Chamber of the Municipal Building, 901
Wellington Avenue.

Docket 78-3: Berg Annexation and Rezoning
The Plan Commission, acting as a Zoning Commission, reconvened
a Public Hearing held on February 15, 1978 to consider evidence for
the establishment of an office building on approximately one acre of
land located at 304 Devon Avenue. The petitioner was requesting that
the subject property be annexed into the Village contingent on the
property being rezoned to 0-T, Office Transitional District. The
Village's Official Map indicates the property to be zoned R-3, Residential
District.
Brian Berg, Engineer, was present to represent the petitioner.
Wesley began the hearing by stating that the Plan Commission had
rescheduled the Public Hearing to enable Mr. Berg adequate time to
obtain a letter of direction from the owners of the property authorizing
him to appear on their behalf.
Mr. Berg began his presentation by stating that he had obtained
the required letter of direction from the property owners. Berg
continued by submitting a Plat of Survey and a Plat of Annexation to
the Plan Commission. Berg noted that he proposed to develop the
property in two phases . During the first phase he planned to enlarge
the existing parking lot, demolish the existing small shack, provide
a general cleanup of the property site, and remodel the existing
residential structure. Berg stated that during the first phase
(approximately 5 years) he planned on occupying the existing residential
structure for his professional offices . Berg concluded by stating
that he became financially able, he would begin the second phase of
the proposed project. He noted that the second phase included the
construction of a new office building and the demolishing of the
existing residential structure. He noted that the subject property
would be fully developed within a five to ten year period.
Hauser began the questioning by asking Berg's reaction to the
Police Department's statement that the ten year time period for the
subject property was excessive. Berg responded by stating that he
did not feel that the time period was excessive because the ten year

period would allow him the time necessary to meet the financial
obligations of the proposed development. Hauser next asked how wide
the subject property was . Berg stated that the property was 130 feet
wide. Hauser concluded his questioning by asking Berg's reaction to
the Building Commissioner's statement which indicated that the existing
residential structure would be within the Fire Limits as defined by
Ordinance 1146. Berg noted that it was true that if the property were
rezoned, it would fall under the Fire Limits ; however, he argued that
the existing structure was not near any other structure and therefore
he contended that the residential structure would be much less of a
fire hazard than what was permitted by Village ordinance.
Glass continued the questioning by asking if the petitioner had
attempted to obtain the necessary easements from the abutting property
owner so that he could put in the water main connection. Berg stated
that he had not contacted the neighboring property owner. Glass next
asked when the petitioner planned on putting in the water mains . Berg
stated that the water main would be installed during the second phase
and he estimated that it would be in the ground within a ten year
period. Glass stated that if the petitioner did not promptly install
the water main, it would automatically require the development to
utilize the existing well water. Glass noted that allowing the
utilization of separate wells was against Village policy. Berg
responded by stating that he was planning on utilizing the existing
well for water until he was financially able to install the water main j
(within a ten year period) .
Glass concluded his questioning by asking what the petitioner
planned on doing to protect the residential area which was located
to the west of the subject property. Berg contended that the nearby
houses were being sold and that the entire area would eventually be
developed commercially.
Petri began his questioning by asking if the proposed office
building would be utilized by any other firms besides Berg's Engineering
firm. Berg stated that he did plan on renting office space for other
commercial uses . Petri continued by asking why the petitioner wanted
to develop in Elk Grove and not in the County. Berg stated that his

engineering business was in Elk Grove Village for over eight years and
he wanted to be identified with the community. He also stated that
he wanted to be assured the right to utilize the various Village services, j
including Fire and Police.
Next, Wesley asked if the petitioner intended on changing the grade
on the subject property. Berg stated that he did plan on changing the
grading with berms and other landscaping techniques . Wesley continued
by asking the petitioner if he would be willing to fully develop the
property within five years . Berg stated that he would probably agree
to the five year limit.
Hauser concluded the questioning by asking what plans the petitioner
had to make the subject property more aesthetic. Berg stated that he
planned on cleaning up the area and landscaping the site with bushes .
At this point the Commission concluded their questioning and Wesley
asked if anyone in the audience had any questions or statements . There
were approximately fifteen residents present and their concerns were

as follows : (1) if the rezoning were permitted it would be a violation
of spot zoning; (2) the proposed office building would place an unfair
burden on the neighboring residential area; and (3) the requested ten
year length of the project was too long a period.
Upon the conclusion of the resident's presentation, Wesley closed

The meeting adjourned at 10:30 p.m.
