HomeMy WebLinkAboutPLAN COMMISSION - 06/02/1982 - SUBDIVISION CONTROL ORDINANCE FOR SIDEWALKS Minutes ELK GROVE VILLAGE PLAN COMMISSION Wednesday, June 2, 1982 The joint meeting of the Plan Commission and the Judiciary, Planning and Zoning Committee of the Elk Grove Village Board of Trustees was called to order by John R. Glass, Chairman, Plan Commission at 7:30 p.m. on Wednesday, June 2, 1982 in the Multi-Purpose Room of the Municipal Building, 901 Wellington Avenue. Members Present Members Absent Plan Commission: Glass, John R. , Chairman Mullen, George E. Cummins, Leah, Secretary Fulton, Clark Geinosky, Frederick C. Paliganoff, David J. Stangeland, Orrin J. Judiciary, Planning and Zoning Committee: Petri, James P. , Chairman None Bosslet, Joseph T. Hauser, Edward R. Staff Present Thomas F. Rettenbacher, Building Commissioner Steven J. Wylie, Administrative Intern Chairman Glass proposed that the Plan Commission and the Judiciary, Planning and Zoning Committee meet jointly once each quarter. It was agreed upon that the two bodies would meet the first Wednesday of the first month of each quarter at 8 p.m. The next joint meeting was therefore scheduled for 8 p.m. , July 7, 1982. The meeting proceeded on the following matters: Subdivision Control Ordinance Requirements for Sidewalks For a number of reasons, there are many properties within Elk Grove Village with no sidewalks. The discussion focused on the appropriate manner in which to rectify this situation and bring these properties into compliance with the Subdivision Control Ordinance. Trustee Petri noted that in some areas it might be a hardship to require the installation of sidewalks at the present time. Petri did, however, indicate that provisions needed to be made for the eventual installation of sidewalks. Building Commissioner Rettenbacher suggested perhaps requiring performance bonds. Secretary Cummins commented that contact should be made with the Greater 0.'--Hard Association of Industry and Commerce for guidance and perhaps use as a buffer between the Village and the business community. Steve Wylie, Administrative Intern, then relayed a message from the Village Manager that an option that might be considered by the Plan Commission Minutes - 2 - June 2, 1982 Subdivision Control Ordinance Requirements for Sidewalks (continued) Commission to guarantee sidewalk installation was the implementation of a sidewalk tax. Trustee Petri commented that with the Village responsible for installation, Elk Grove Village could end up with the financial burden. Trustee Hauser noted that the taxation that might come if a "drainage district" is created, the Village must be wary of overtaxation. Secretary Cummins inquired as to whether or not a property owner could be compelled to install a sidewalk when the site plans said property owner had originally submitted and which were, indeed, approved, had contained no provisions for sidewalks. The answer to the question was not readily available, so the two bodies collectively requested that the Village Attorney be forwarded the following questions: 1. Does the Village have any recourse in the instances of past occupancy permits being issued to owners when approved plans had shown no sidewalks? 2. Does the Village have any recourse in instances where past variances have been granted, but sidewalks would now be desirable? 3. Are the "Statute of limitations" in effect that would prohibit the Village from now requiring sidewalks from certain property owners? 4. What is the most appropriate action for Elk Grove Village to take to compel the installation of sidewalks? It was indicated that no Board of Trustees or Plan Commission action would be taken on this matter until the legal circumstances had been evaluated. Soil Erosion and Sedimentation Control Tom Cech, while serving in the capacity as Village Engineer, submitted language to amend the Subdivision Control Ordinance and provide Soil Erosion and Sedimentation Control requirements. The discussion centered on this submittal. Secretary Cummins suggested that a definition section be included with this document to make it more easily understandable. Trustee Petri agreed and mirrored concern for the common understanding of terms such as desilting basins and silt trays. It was requested that the Soil Erosion and Sedimentation Control Ordinance be forwarded to the Village Attorney for his review. The Attorney is specifically requested to evaluate whether the proposed ordinance should be independent or incorporated into the Subdivision Control Ordinance, as well as to examine the language. Tom Cech, Director of Public Works, and Ray Peterson, Village Engineer, were requested to attend the July 7 joint meeting to field questions concerning the proposed ordinance. Organization of the Zoning Ordinance A special subcommittee of the Plan Commission was formed to re-organize the arrangdment of the contents of the Zoning Ordinance. The proposed changes were discussed. Plan Commission Minutes - 3 - June 2, 1982 Organization of the Zoning Ordinance (continued) Subcommittee Chairman Geinosky indicated that the purpose of the reorganization was to form a more easily referenced and understandable document. There have been problems in locating information within the present Zoning Ordinance. Geinosky reported that many Zoning Ordinances were sampled and that the proposed changes to the Elk Grove Zoning Ordinance were modeled after the style of the Schaumburg Zoning Ordinance. The Schaumburg Ordinance was felt to be the most appropriately arranged. Geinosky added that there was no intent to alter the contents of the document. Discussion followed concerning the problems those familiar with the current Zoning Ordinance might have with a reorganized one. It was suggested that a cross-referencing section should be included to eliminate this problem. Paliganoff commented that it might be appropriate to accompany the revised Zoning Ordinance with a cover letter. Chairman Glass then ordered the proposed changes forwarded to the Village Attorney for review. Conditional Business Use The Plan Commission studied the possibility of permitting conditional business uses in the areas of Higgins Road, Busse Road and Elmhurst Road, and has asked the Village Board of Trustees to consider the matter as well. Commissioner Cummins spoke as the representative for the subcommittee on this topic and stated that consideration was given to this proposal because of the community benefits derived from the added business activity. She commented that the areas being considered rendered themselves naturally to the development of commercial activity. Discussion turned to the omission of Devon Avenue from the list of thoroughfares to be considered. Cummins stated she was only interested in permitting conditional property uses east of the VFW Hall on Devon Avenue. She indicated the land west of the VFW should be held in abeyance until it was learned how the property outside of Elk Grove Village south of Devon Avenue was developed. Chairman Glass stated that property owners west of the VFVT should be afforded some respect as the area might someday be annexed to Elk Grove Village. Trustee Hauser suggested omitting Devon Avenue from the list of thoroughfares to be considered for conditional property use rather than divide it. It was noted that Meacham and Rohlwing Roads were omitted from consideration because it was unclear how and when certain areas were going to develop. Chairman Glass stated that he was in favor of leaving. the -Zoning Map as it is and treating variances on a case-by-case basis. He added that the major standing of the Plan Commission on this matter is that it is not adverse to encouraging business development in certain areas. Trustee Hauser echoed this view and added that he was in favor of not being overly restrictive regarding permitted uses in these areas. The precise action to be taken was not finalized and the matter will be given further consideration. Parking Regulations Chairman Stangeland of the Parking Regulations Subcommittee reported that, after thorough study, the only parking regulation change recommended t • Plan Commission Minutes - 4 - June 2, 1982 Parking Regulations (continued) by the subcommittee was that the Zoning Ordinance be amended to specify 10' x 20' stalls in place of the current 200 square feet. Stangeland said that the downsizing of automobiles should not be overreacted to by the Village-wide downsizing of parking spaces. The subcommittee also foresees a problem of enforcement if parking stalls are alternately sized. The rest of the members of the Plan Commission and the Judiciary, Planning and Zoning Committee concurred with the recommendation of the Parking Regulations Subcommittee. Thoroughfare Report The Plan Commission is concerned with the adoption of an updated Thoroughfare Report and sought direction from the JPZ committee. Chairman Glass first requested authorization to obtain consultation to prepare an appropriate Report. It was pointed out that considering the advanced developmental state of the Village, circumstances might not warrant a significant expenditure of funds for the creation of a complex new document. Jointly, the two bodies decided to forward the matter to the Village Attorney for review and direction regarding the obligation the Village has to produce and adopt a Thoroughfare Report. Trustee Petri indicated that the JPZ Committee would consult with the Attorney. School Property - Change of Use Chairman Glass informed the JPZ committee that School Property - Change of Use had been placed on the Plan Commission agenda. Downsized Housing After a brief discussion of the definition of downsized housing, the Plan Commission requested to be kept appraised of the findings of the Housing Commission.
