Trudan, Deputy Director of Engineering & Community Development Petitioner: Norm Samelson John Oehler Will Battles Chairman Glass called the meeting to order at 7:06 p.m. Item 1: September 21, 2011 Meeting Minutes Commissioner Ayers moved to approve the minutes. Commissioner Thompson seconded the motion. Upon voting (Hauser, Meyers, Glass, Paliganoff, Ayers, Thompson, Schumm, AYES, Geinosky, Henrici ABSENT) the motion carried. Item 2: Nostalgia Lane Motorsports, Ltd.—Special Use & Text Amendment 837-B Oakton Street Commissioner Paliganoff announced that tonight is his last Plan Commission meeting. He will be moving to Florida after serving over 31 years on the Plan Commission. Chairman Glass noted that Secretary Geinosky is absent. Commissioner Meyers made a motion to make Commissioner Paliganoff the Acting Secretary. Commissioner Hauser seconded the motion. Upon voting (Hauser, Meyers, Glass, Paliganoff, Ayers, Thompson, Schumm, AYES, Geinosky, Henrici ABSENT) the motion carried. Chairman Glass read the legal notice into the record. Chairman Glass noted for the record that the Public Hearing notices were mailed to neighbors and properly published in the Daily Herald, but staff documentation was not immediately available. Chairman Glass noted that the property was also properly signed. Acting Secretary Paliganoff swore in the petitioners. 2 N. Samelson, the attorney representing Nostalgia Lane Motorsports, Ltd led the questioning of the petitioner, John Oehler, owner of Nostalgia Lane Motorsports, Ltd. and the 837-B Oakton Street property,., , S "ki N. Samelson asked the petitioner to describe the current operations of Nostalgia Lane Motorsports. J. Oehler explained that Nostalgia Lane currently operates in Machesney Park, Illinois. Nostalgia Lane has had a dealer license at this location since 2008. The business involves restoration of rare documented cars to their original condition, including the original paint, nuts, and bolts. The proposed property would be used solely as an automobile showroom for internet based sales. No repair or maintenance of any kind would take place at the proposed location. J. Oehler explained that the value of original cars is high and the internet is a powerful tool to reach out to car collectors across the nation. N. Samelson asked the petitioner what the hours of operation would be. J. Oehler explained that the proposed hours of operation would be by appointment only between the hours of 1:00 p.m. and 5:00 p.m. Monday through Friday. Commissioner Schumm asked the petitioner if seven cars would have enough room within the facility. J. Oehler responded that there would be enough room. The cars are dropped off at the facility and driven inside. J. Oehler included seven cars in the petition as a maximum number for the property, but does not anticipate that many being there on a regular basis. N. Samelson asked the petitioner where the restoration work would be completed. J. Oehler explained that the car restoration work is completed in Green Bay, Wisconsin. After the restoration work is completed, the cars would be transported to Elk Grove Village via trailer. Commissioner Schumm asked if adequate parking was available. J. Oehler noted that the existing parking lot holds 58 cars and that the businesses currently at the location only use half of the available spaces. Chairman Glass recommended that each petitioner speak before the Plan Commission prior to any other additional questions. N. Samelson introduced W. Battles as expert witness to testify on issues related to zoning and land use. W. Battles curriculum vitae was handed out to the Plan Commission and it was the consent of the Plan Commission to accept W. Battles as an expert witness. N. Samelson asked W. Battles if the proposed use would have any deleterious effects on the surrounding property or adversely impact traffic volume on Oakton Street. W. Battles testified that the proposed use would have no deleterious effects on the surrounding properties. He went on to explain several exhibits which showed the interior and exterior layout of the property. The property is 2,389 square feet with interior dimensions of 30.6 by 78.0 feet. The ceiling height of the 837-B unit is 15 feet and contains one 14 foot drive-in door. The unit is equipped with an alarm system and a fire suppression system. W. Battles stated that only two to four cars were expected to be sold at the location each year and as such, the proposed use would have no deleterious effects on traffic volume on Oakton Street. 3 N. Samelson asked the petitioner what type of signage would be located at the property. W. Battles explained that signage located on the front entrance door would be no greater than 10 square feet. J. Oehler stated that no other signs or advertisements would be displayed. N. Samelson asked J. Oehler if the parking lot would accommodate a trailer. J. Oehler stated that the existing parking lot has the necessary maneuvering space to permit a trailer to be brought into the parking lot. Commissioner Ayers asked why no office or desk was proposed on the site plan. J. Oehler explained that he owns the building as well as Broadway Electric Company, which is also located at the property. J. Oehler stated he would do any office work within the Broadway Electric Company. Commissioner Ayers asked if the hours of operation by appointment only was legal as it relates to the business license. J. Oehler stated that the operation complied with State licensure law and was legal. Commissioner Paliganoff asked the petitioner if there were any concerns of vandalism or theft. J. Oehler responded that he had not experienced any vandalism or theft at the current location and does not anticipate any issues with regards to security in Elk Grove. Commissioner Paliganoff asked the petitioner who owned the business. J. Oehler explained that he and his wife were both stakeholders, but that he ran the business. Commissioner Meyers complimented the petitioner on the presentation and the appearance of the building and asked where maintenance would occur if the car arrived from Green Bay still requiring work. J. Oehler stated that he would perform any maintenance at his home garage. Commissioner Meyers asked if there would be incidents when a commercial trailer would be used to transport the cars and whether the truck would be able to enter the parking lot. J. Oehler responded that commercial trailers have been used in the past and that the trailer would have to be unloaded onto Oakton Street. Commissioner Meyers asked the petitioner if Nostalgia Lane would conduct any open houses for auction purposes. J. Oehler responded that no auctions or open houses would take place at this site. The business does not have a large car collection or the facility space to warrant such an activity. Chairman Glass asked how much one of the cars in the submittal documents was worth. J. Oehler explained that one car in the documents was sold for$175,000. Commissioner Paliganoff asked the petitioner if there were any concerns with hazardous chemicals in the original paints. J. Oehler explained the various types of paint used and stated that he did not believe the use of lead paint would present a problem. He explained that the cars are professionally painted and that he did not add any paint drips to increase the authenticity. Chairman Glass asked the petitioner how many cars are sold in-state versus out-of-state. J. Oehler stated that about one car out of ten cars were sold in-state. Chairman Glass recommended adding language to condition number seven of the Text Amendment to necessitate the petitioner obtaining a State dealer license. Chairman Glass also recommended a 4 condition to the Special Use limiting the number of cars in the property to the seven proposed in the submittal. RECOMMENDATION Commissioner Hauser recommended approval of the following text amendment pertaining to Automobile Showrooms for Internet Based Sales in Section 7-E-3.A of the Zoning Ordinance pertaining to Special Uses in I-1 and I-2 Industrial Districts, subject to the following conditions: I. Except for the arrival and departure of automobiles, all activities shall occur completely within the enclosed building. 2. The use shall be limited to display of vehicles to customers by appointment only and related office use. 3. Vehicles on display must be in a"ready for sale" condition and no vehicle maintenance or repairs shall take place in the showroom or on the site in which it is located. 4. No more than one(1) such use shall be permitted in a multi-tenant structure. 5. No outdoor advertising inviting the general public to the showroom shall be permitted. 6. In granting a Special Use Permit for Automobile Showrooms for Internet Based Sales, the Village shall consider compatibility with surrounding uses, the benefit to the Village to be derived from the granting of the special use permit, a finding that the traffic generated from the use will not have deleterious effect on existing uses in proximity to the proposed use nor on the adjacent streets, that the building size is adequate for the operation, including the number of vehicles anticipated, in the showroom, and whether sufficient parking exists for the number of employees and the prospective customers to the use. 7. That the business be in compliance with applicable regulations of the Illinois Secretary of State's Office with respect to licensing, and obtain a State Dealer License. Commissioner Thompson seconded the motion. Upon voting (Hauser, Meyers, Glass, Paliganoff, Ayers, Thompson, Schumm, AYES) the motion carried. Commissioner Meyers moved to recommend approval of the Special Use petition for Nostalgia Lane Motorsports, Ltd for property located at 837-B Oakton Street subject to the following condition: 1. No more than seven vehicles can be stored at the location at one time. Commissioner Hauser seconded the motion. Upon voting (Hauser, Meyers, Glass, Paliganoff, Ayers, Thompson, Schumm, AYES)the motion carried. 5 Item 3: Adjournment Commissioner Paliganoff motioned to adjourn the meeting and Commissioner Thompson seconded the motion. Upon voting (Hauser, Meyers, Glass, Paliganoff, Ayers, Thompson, Schumm, AYES, Geinosky, Henrici ABSENT) the motion carried.
