HomeMy WebLinkAboutSpecial Liquor Control Order 2020-01LOCAL LIQUOR CONTROL COMMISSIONER OF THE VILLAGE OF ELK GROVE VILLAGE, ILLINOIS SPECIAL ORDER NO.2020-01 WHEREAS, on March 19, 2020, as a result of Governor JB Pritzker's Executive Order 2020-07, the Illinois Liquor Control Commission issued guidance on whether a license holder authorized to conduct on -premises alcoholic liquor sales only (On -Premises Only Retailers), may sell alcoholic liquor for consumption off of the licensed premises (Packaged Sales or To Go Sales), in order to relieve hardships to on -premise retail alcoholic liquor licensees as a result of the COVID-19 pandemic, subject to approval of the Local Liquor Control Commissioner; and WHEREAS, the Illinois Liquor Control Act prohibits any person to have in his possession for sale at retail any alcoholic liquor except in original packages (235 ILCS 5/6-22). The Commission has not authorized the sale of premixed cocktails in non -original containers for off -premises consumption; and WHEREAS, the Village of Elk Grove Village Local Liquor Control Commissioner is acutely aware of the hardships imposed as a result of the COVID-19 pandemic; and WHEREAS, consistent with the authorization granted by the Illinois Liquor Control Commission and in furtherance of the authority granted the Local Liquor Control Commissioner of the Village of Elk Grove Village, the following Special Order No. 2020-01 is hereby issued to all Elk Grove Village restaurants that currently hold a Class A or Class D liquor license that offers carry -out food orders during this COVID-19 pandemic effective immediately: IT IS HEREBY ORDERED: 1. Said restaurant retail license, which includes an on -premise only license, shall be authorized to conduct packaged sales, "To Go" sales, and curbside pickups intended to promote social distancing during the liquor sale hours for the licensed premises. 2. Temporary liquor delivery for all Class A and Class D liquor license holders is prohibited in the Village of Elk Grove Village. 3. All restaurants with a Class A or Class D liquor license shall only permit the sale of alcoholic beverages pertaining to their registered license along with the purchase of food orders available for pickup or curbside. 4. All alcoholic sales including beer, wine, pre -mix margaritas, sangrias, etc. shall be sold in the original sealed container pursuant to 235 ILCS 5/6-22. 5. All orders must be picked up inside the restaurant or be available for curbside pickup for a restaurant representative over twenty-one years of age to request the examination of the recipient's state -issued identification to ensure the recipient is over the age of twenty-one years. If such observation of the recipient or recipient identification cannot be accomplished while respective safe social distancing, the alcoholic liquor shall be returned with a full refund. 6. Alcoholic liquor conditions set forth in this Special Order No. 2020-01 herein are temporary and no additional fees or licenses are required. This Special Order 2020-01 shall be rescinded upon the termination of the COVID-19 emergency restrictions imposed by Governor JB Pritzker. Ordered th' t, day of April, 2020. Mayor C B.
