ORDINANCE NO. zo ?z <br />AN ORDINANCE AMENDING SECTION 24.002, DISORDERLY <br />CONDUCT, OF THE MUNICIPAL CODE OF THE VILLAGE OF <br />ELK GROVE VILLAGE <br />WHEREAS, the Police Department of the Village of Elk Grove Village <br />has received numerous complaints concerning disorderly conduct, unlawful <br />congregation and vandalism occurring within the Village; and <br />WHEREAS, said unlawful activity is most prevalent in places of <br />public assemblage, including private property open to the public; and <br />WHEREAS, it has been requested both orally and in writing of the <br />Village by certain owners of said property that the Village enact and <br />enforce such ordinances as are reasonably necessary to abate disorderly <br />conduct, unlawful congregation, vandalism and the like; and <br />WHEREAS, such activity is deemed harmful to the welfare, safety <br />and general well-being of the residents of the Village and, therefore, <br />a nuisance. <br />NOW, THEREFORE, BE IT ORDAINED by the President and Board of <br />Trustees of the Village of Elk Grove Village, Cook, and Du Page Counties, <br />as follows: <br />Section 1: That Section 24.002, Disorderly Conduct, of the Municipal <br />Code of the Village of Elk Grove be and the same is hereby amended to read <br />as follows: <br />24.002. Disorderly Conduct. <br />A. It shall be a.nuisance a.nd, therefore, unlawful for any <br />person to disturb the peace and quiet of the Elk Grove <br />Village or any portion thereof by disorderly conduct. <br />B. Disorderly conduct shall be committed by any person <br />when he knowingly: <br />1. Does any act in such unreasonable manner as <br />to provoke, make or aid in making a breach of peace; <br />2. Does or makes any unreasonable or offensive <br />act, utterance, gesture or display which, under the <br />circumstances, creates a clear and present danger of <br />a breach of peace or imminent threat of violence; or <br />3. Refuses or fails to cease and desist any <br />peaceful conduct or activity likely to produce a breach <br />of peace where there is an imminent threat of violence <br />and where the police have made all reasonable efforts to <br />protect the otherwise peaceful conduct and activity, and <br />have requested that said conduct and activity be stopped <br />and explain the request if there be time; or <br />
