ORDINANCE NO. <br />AN ORDINANCE AMENDING ARTICLE 14, TRESPASS OF THE <br />MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE. <br />WHEREAS, there exists within the corporate limits of the Village <br />of Elk Grove Village, an area hereinafter known as the Planned Unit <br />Development Area, which area is hereinafter specifically defined, and <br />WHEREAS, all common areas, private roadways, trails, terraces, <br />parkways or parking areas within said Planned Unit Development Area <br />are owned and controlled by one or more of the following associations: <br />The Elk Grove Estates Custom Lots Association <br />The Elk Grove Estates Townhome Condominium Parcel C Association <br />The Elk Grove Estates Townhome Condominium Parcel E Association <br />The Elk Grove Estates Homeowners Association (Lake Assn.) <br />The Elk Grove Estates Townhouse Association II <br />Elk Grove Village on the Lake Association; and <br />WHEREAS, each of such associations have adopted resolutions, <br />Exhibits A through H inclusive, requesting the Village of Elk Grove <br />Village to regulate trespassers within said owned areas. <br />NOW, THEREFORE, BE IT ORDAINED by the President and Board of <br />Trustees of the Village of Elk Grove Village, as follows: <br />Section 1: <br />That Section 23.1402, Article IXV of the Municipal <br />Code of the Village of Elk Grove Village be and is hereby amended <br />by adding thereto the following: <br />"E. The entry upon or failure or refusal to depart the <br />premises hereinafter described by any person other than <br />a member or invitee of any of the following described <br />associations and authorized personnel of the Village of <br />Elk Grove Village for Village purposes. The premises, <br />for purposes hereof, shall include any common area, <br />private roadways, trails, terraces, parkways or parking <br />areas within that area bounded on the north by Cosman <br />Road between Bisner Road on the west and the lot line <br />perpendicular to the west end of Walter Street on the <br />east. And, by the north lot line of the properties <br />facing Burgundy Court between the lot line perpendicular <br />to the west end of Walter Street and Chelmsford Lane. <br />Bounded on the east by Chelmsford Lane between Wellington <br />Avenue and Stonehaven and the east boundary of properties <br />facing Wellington Avenue between Chelmsford Lane and <br />Biesterfield Road. <br />
